(f) To approve or disapprove the noncollection or refund of fees, to extend the period within which a mortgagee or lender is required to take action in order to prevent the expiration of a multifamily housing commitment or in order to reopen an expired multifamily housing commitment, and to approve or disapprove the retroactive reinstatement or reopening of an expired multifamily housing commitment.

§ 200.52c Director of the Land Development Division.

To the position of Director of the Land Development Division there is delegated the following basic authority and functions: To develop and recommend the policies and establish operating plans and procedures for the insurance of mortgages under Title X of the National Housing Act, and to direct the operation of the land development program. § 200.55 Assistant Commissioner for Property Improvement and Deputy. To the position of Assistant Commissioner for Property Improvement and under his general supervision to the position of Deputy Assistant Commissioner for Property Improvement there is delegated the following basic authority and functions:

(a) To act with the Commissioner in the determination of basic policy and to be a member of the Executive Board.

(b) To direct the activities of the Property Improvement Division.

(c) To develop and recommend policies and establish operating plans and procedures for the insurance of property improvement loans under section 2 of Title I of the National Housing Act, and for the liquidation of defaulted Title I loans acquired in connection with the settlement of claims.

(d) To exercise the authority of the Commissioner under the regulations governing the insurance of loans under section 2 of Title I of the National Housing Act in any instance which is subject to the approval of the Commissioner.

(e) To issue or cancel contracts of insurance under Title I of the National Housing Act and transfer such contracts and the rights and benefits accruing thereunder between lending institutions

(f) To reject or accept for insurance loans or advances of credit made under the provisions of section 2 of Title I of the National Housing Act that require the prior approval of the Federal Housing Commissioner.

(g) To institute precautionary measures with respect to any dealer or contractor operating under the provisions of section 2 of Title I of the National Housing Act.

(h) To direct and supervise surveys of Title I lending institutions to assure compliance with established policies and terms of insurance contracts.

Assistant Commissioner for Home Mortgages and Deputy.

To the position of Assistant Commissioner for Home Mortgages and under his general supervision to the position of Deputy Assistant Commissioner for Home Mortgages there is delegated the following basic authority and functions:

(a) To act with the Commissioner in the determination of basic policy and to be a member of the Executive Board.

(b) To develop and recommend policies and establish operating plans and procedures for the insurance of home mortgages, other than those insured under sections 221 (h), 235, and 237, and the insurance of rehabilitation loans under section 203 (k) of the National Housing Act.

(c) To approve or cancel the approval of financial institutions as approved mortgagees.

(d) To supervise activities in connection with the Certified Agency Program and to designate, qualify and certify approved mortgagees as agents of the Federal Housing Administration to process mortgage insurance applications and issue commitments for insurance.

(e) To develop and establish policies and procedures for the servicing of insured and Secretary-held home mortgages, to review and evaluate home mortgage insurance default experience, and to provide technical advice and guidance to approved mortgagees and field offices on insured and Secretaryheld home mortgage servicing problems.

(f) To direct the activities of the Mortgage Servicing Officer and the Special Assistant for Home Improvement Program.

(g) To review cases relating to expenditures to correct or compensate for

structural defects in houses financed with insured mortgages and to approve or reject, without referral to the Structural Defects Committee, those requests for financial assistance which he determines do not involve circumstances of an exceptionally difficult or questionable nature.

Assistant Commissioner for Multifamily Housing and Deputy.

To the position of Assistant Commissioner for Multifamily Housing and under his general supervision to the position of Deputy Assistant Commissioner for Multifamily Housing there is delegated the following basic authority and functions:

(a) To act with the Commissioner in the determination of basic policy and to be a member of the Executive Board.

(b) To develop and recommend policies and establish operating plans and procedures for the insurance and servicing of all multifamily housing mortgages; the insurance of home mortgages under sections 221(h), 235, and 237; nursing home mortgages; equity investments in multifamily housing; mortgages for the construction and equipment of group medical facilities; for urban renewal housing rehabilitation loans; and for technical and loan assistance to nonprofit sponsors of low and moderate income housing.

(c) To be responsible for the coordination and general supervision of the Project Mortgage Insurance Division, the Low and Moderate Income Housing Division, the Project Mortgage Servicing Division, and the Special Assistants for Cooperative Housing, Nursing Homes, and Rehabilitation.

(d) To approve the sale and terms of sale of mortgages taken as security in selling property acquired in connection with Federal Housing Administration insurance claims; to approve the modification in the terms of project mortgages insured by the FHA, excepting approval or disapproval following initial endorsement of increases in project mortgage amounts; and to approve the modification of or authorize the foreclosure of any project mortgage acquired and held as a result of assignment under terms of the insurance contract or taken back and

(h) To be responsible for administration of the rent supplement program, the homeownership assistance, and rental housing assistance programs, the credit assistance program under section 237; and for the administration of the direct loan program for housing for the elderly or handicapped under section 202 of the Housing Act of 1959, and for conversion of section 202 projects to insured private financing with interest assistance under section 236 of the National Housing Act. (i) To act for the Commissioner in approving applications for financial assistance under section 106 of the Housing and Urban Development Act of 1968 and section 207 of the Appalachian Regional Development Act of 1965, as amended, and in approving the waiver of interest on such loans made to nonprofit organizations under the Appalachian Regional Development Act of 1965.

(j) To be responsible for the administration of FHA's responsibility with respect to the nonprofit hospital mortgage insurance program and for coordination with the Department of Health, Education, and Welfare on the program.

(k) To act for the Commissioner in approving or directing approval of loans for housing for the elderly or handicapped under section 202 of the Housing Act of 1959, including full authority to make contracts, sign and execute documents and take any action incident thereto.

(a) To direct mortgage servicing operations for all multifamily housing programs.

(b) To develop and recommend policies and establish operating plans and procedures for the servicing of project mortgages.

(c) To approve modification in the terms of project mortgages insured by the Federal Housing Administration, excepting approval or disapproval following initial endorsement of increases in project mortgage amounts; and to approve the modification of or authorize the foreclosure of any project acquired and held as a result of assignment under the terms of the insurance contract or taken back and held in connection with the sale of an acquired property.

(d) To exercise the authority of the Commissioner as holder of the preferred stock in any corporation or under any regulatory agreement or other agreement made for the purpose of controlling or regulating a housing project on which there is a mortgage held or insured by the Commissioner.
