§ 50.15

Fee structure for unpublished data from the 1960 Population and Housing Census.

(a) The Bureau of the Census is willing to furnish from the 1960 Census of Population and Housing certain data by census tracts and enumeration districts

Data available

in advance of publication or from tabulations not to be published, provided there is no serious interruption of the Bureau's regular work program. Following is the fee structure for the data listed below. Other special tabulations of data may be arranged by requesting a special cost estimate.

1. Final counts of total population and housing units by
enumeration districts. These districts are established
for taking the census and have about 700 inhabitants
on the average.

2. Selected population and housing characteristics (Special
Table PH-1)-complete count data on age, sex, color,
marital status and household relationship; housing
units by tenure, color of household head, and vacancy
status, condition and plumbing, number of rooms,
number of persons and number of persons per room,
value of property and contract monthly rent:
a. For enumeration districts----

b. For untracted areas by minor civil divisions and
related areas, 1.e., wards of each city of 25,000 or
more for which wards have been established,
urban places of 2,500 or more, and rural re-
mainder of each minor civil division.

3. Unpublished sample population and housing data for un-
tracted areas by minor civil divisions and related areas
(as described in 2b. above). Data are arranged in nine
tables designated as Special Tables PH-3 to PH-11.
4. Supplementary sample tract data on population char-
acteristics relating to residence in 1955, labor force,
place of work in more detail than published, and on
characteristics of housing units, year structure built,
year moved into unit, stories and elevators, trailers,
source of water, and sewage disposal. Data appear in
table designated as Special Table PH-2.

Fee

$2.00 for each 75,000 population or fraction thereof.

$20 for each contiguous area of 100,000 inhabitants, or fraction thereof, within a State. Minimum order $100. $4.00 per county.

$4.25 per 100 tracts or fraction thereof, except in New England States where special quotation is necessary.

nized in the 1960 Census, for all places containing fewer than 10,000 inhabitants, and for places with more than 10,000 inhabitants but with fewer than 400 housing units with nonwhite head. (For places of 10,000 inhabitants or more with 400 or more housing units with nonwhite head, the data are available from the census publications.) These data are used to obtain counts and classifications of "substandard" housing units as defined by the Public Housing Administration. (A unit is defined as substandard by Public Housing Administration criteria if it is either (a) dilapidated or (b) lacks one or more of the following plumbing facilities: hot and cold piped water inside the structure, flush toilet inside the structure for exclusive use of the occupants of the unit, and bathtub (or shower) inside the structure for exclusive use of the occupants of the unit.) The table outline showing data to be furnished and the fee structure follow:

cost; or that a preliminary investigation must be conducted. When an investigation is completed, information will be furnished as to the cost of preparing the material, or as to the reason if the statistics cannot be compiled from our basic records.

§ 50.35 Fee structure for seasonal adjustments of time series.

The Bureau of the Census carries out seasonal adjustments of time series for other Government agencies, nonprofit organizations, and for appropriate foreign governments as a matter of international courtesy. The adjustments may be based on monthly or quarterly data collected by the Bureau of the Census or furnished by the requesting organization. Series submitted for adjustment must be for a period of not less than four years and not more than 50 years, must be continuous, and have no more than six digits in a single month or quarter. In addition to the seasonal adjustment factors and the seasonally adjusted series, charts and summary measures of the seasonal, cyclical, and irregular characteristics of the series are provided. The charge for furnishing these series, including card punching, is $8 per series for the standard program and $8 per series for various experimental programs.

§ 50.40

Fee structure for statistics for city blocks in the 1970 Censuses of Population and Housing.

(a) General: In the 1970 Censuses of Population and Housing, the Bureau of the Census will tabulate and publish data for city blocks for all cities with a population of 50,000 or more in the 1960 Census or subsequent special census conducted by the Bureau of the Census. The data include: count of population, the number of housing units, tenure, value or rent, plumbing and other facilities, the number of occupied units with Negro household head, the number of units with 1.01 or more persons per room, and other selected population and housing characteristics. Additional information on an unpublished basis may be available at cost of reproduction.

(b) Additional coverage through cooperation or contract. In addition to data for cities of 50,000 or more, the Bureau

will also tabulate and publish block statistics for smaller cities and for certain other areas provided the appropriate regional planning group or local authority agrees to provide the necessary assistance or contracts for the statistics as described below for the particular type of

area.

(1) Cooperation for remainder of an urbanized area of the SMSA.

(i) In addition to data for cities of 50,000 or more, the Bureau will tabulate block data for the remainder of an urbanized area of the Standard Metropolitan Statistical Area provided a metropolitan regional planning group agrees to cooperate as follows:

(a) For urbanized areas to be enumerated by mail, review the map prepared by the Bureau of the Census and help to prepare the Address Coding Guide to identify blocks.

(b) For urbanized areas not to be enumerated by mail, review the map prepared by the Bureau of the Census.

(ii) When the regional group does not provide the required cooperation, as stated above, an individual locality may do so and assure block tabulations for the area for which the assistance is provided. In such instances the local authority must sign a letter of intent by May 1, 1968, agreeing to review the maps by July 1, 1968, and the Address Coding Guide by November 1, 1968, if needed.

(iii) The Bureau will provide the cooperating organization with two copies of the machine tabulation sheets and one copy of the map. Additional copies will be provided at cost.

(iv) In urbanized areas, for cities whose last official census count was less than 50,000 but which are reported with a population of 50,000 or more in the 1970 census and where cooperation was provided, block data will also be tabulated and published.

(2) Contract block statistics for urban places outside 1970 urbanized areas.

(i) For cities with the last official population of less than 50,000 block data will be tabulated and published only if the local authorities:

(a) Submit by July 1, 1968, a signed copy of the contract furnished by the Bureau, and an advance payment of $200 in the form of a check or money order made payable to Census-Department of Commerce.

(b) Furnish by September 1, 1968, block maps prepared according to the Bureau's specifications and assist in the preparation of the Address Coding Guide, if needed.

(iii) The above fee covers the tabulation and publication of the data, with 100 copies of the report to be provided to the purchaser. The fee will be refunded to any city which contracts for the data and reaches a population of 50,000 or more in the 1970 Census.

(c) Determination as to 1970 urbanized areas. To determine whether a city or other area is within the anticipated limits of the 1970 urbanized area, the city should determine whether it was in the 1960 urbanized area, since the 1960 urbanized areas are automatically part of the 1970 areas. Maps of the 1960 urbanized areas are shown in the 1960 Census of Population report, Volume I, Characteristics of the Population, Part A, Number of Inhabitants. If the city was not part of the 1960 urbanized area, an inquiry should be directed to the Bureau.

(d) Directing requests and inquiries. Requests to participate in the foregoing programs should be addressed to the Director, Bureau of the Census, Washington, D.C. 20233. Inquiries as to the method of enumeration to be used for an SMSA, whether or not metropolitan planning officials have agreed to perform the required preparatory work to permit the tabulation of block statistics for urbanized areas, and other inquiries relating to the program should also be addressed to the Director.

60.12 Subpoena or other compulsory process. AUTHORITY: The provisions of this Part 60 issued under 5 U.S.C. 301, 552, 553; 32 F.R. 9734.

§ 60.1 Scope and purpose.

(a) This part contains the rules whereby the materials specified in 5 U.S.C. 552(a) (2), and the identifiable records requested under 5 U.S.C. 552(a) (3), are to be made publicly available by the Bureau of the Census.

(a) Materials required to be published pursuant to the provisions of 5 U.S.C. 552(a)(1) have been and shall continue to be so published, in one of the following ways:

(1) By publication in the FEDERAL REGISTER of the Department Orders of the Department of Commerce, including any supplements and appendices thereto, and of appropriate Secretary of Commerce Circulars and Department Administrative Orders;

(2) By publication in the FEDERAL REGISTER of agency rules and regulations, and by their subsequent inclusion in the Code of Federal Regulations;

(3) By publication in the FEDERAL REGISTER of appropriate general notices; and

(4) By other forms of publication, when incorporated by reference in the FEDERAL REGISTER with the approval of the Director of the Federal Register.

(b) Those materials which are published in the FEDERAL REGISTER pursuant to 5 U.S.C. 552 (a) (1) shall, to the ex

tent practicable and to further assist the public, be made available for inspection and copying at the facility identified in § 60.5(c).

§ 60.5 Availability of materials for inspection and copying.

(a) The Director, Bureau of the Census shall, as provided in 5 U.S.C. 552 (a) (2) and subject to other provisions of law, establish and maintain a reference facility for the public inspection and copying of:

(1) Final opinions, including concurring and dissenting opinions, as well as orders, made in the adjudication of cases;

(2) Those statements of policy and interpretations which have been adopted by the Bureau and are not published in the FEDERAL REGISTER;

(3) Administrative staff manuals and instructions to staff that affect a member of the public;

(4) Current indexes providing identifying information for the public as to any matter which is (i) issued, adopted, or promulgated after July 4, 1967, and (ii) required to be made available or published by section 552(a) (2);

(5) Such additional materials as the Bureau of the Census may consider desirable and practicable to make available for the convenience of the public.

(b) The Bureau may, to prevent unwarranted invasion of personal privacy, delete identifying details when it makes available or publishes an opinion, statement of policy, interpretation, or staff manual or instruction, and shall, in each such case, explain in writing the justification for the deletion.

(c) The above materials may be inspected in the Bureau of the Census reference facility located at the Library Branch, Room 2455, f.o.b. No. 3, Bureau of the Census, Washington, D.C. 20233. This facility is open to the public Monday through Friday of each week, except on official Federal holidays, between the hours of 9 a.m. and 4:30 p.m. There are no fees or formal requirements for such inspections. Upon request, however, the facility will arrange to have copies of the above materials made at the cost shown in § 60.9 (b) (3).

(d) Correspondence concerning the materials available in the facility should be sent to the above address. The telephone number of the facility is 440-1314, Area Code 301.

§ 60.6 Confidentiality of data collected by the Bureau of the Census.

(a) The Bureau of the Census is required by law to keep certain records confidential. Protection against unauthorized disclosures is provided by Title 13, U.S.C., Section 9(a).

§ 60.7 Requests for identifiable records.

(a) The procedures of this section are applicable only to those records not customarily available to the public as part of the regular informational activities of the Bureau. The procedures and fees specifically do not apply to applications for personal census information. Applications for personal census information should be directed to the Bureau's Personal Census Service Branch at Pittsburg, Kansas.

(b) A person who wishes to inspect such a Bureau record should complete Form CD-244, "Application to Inspect Records," and submit this form, in person or by mail, to the facility identified in § 60.5(c). Copies of Form CD-244 are available from the reference facility.

(c) An application form shall be submitted for each record or group of records related to the same general subject matter. Each application form shall be accompanied by the nonrefundable application fee of $2.

(d) Detailed instructions for the completion of Form CD-244 are stated on the back of the form. Employees of the facility will assist the public to a reasonable extent in completing the form; however, the responsibility rests with the applicant for identifying each record sought in sufficient detail so that it can be located by personnel familiar with the filing of agency records. Each application shall clearly itemize, when there are more than one, each record requested so that it may be identified and its availability separately determined.

(e) The staff of the facility will review the application for completeness, and will record receipt of the fee. If the application appears in order, it shall be forwarded to the Bureau official who would appear to have official custody of the requested record to determine whether it is an identifiable and disclosable record. If the application is incomplete in some substantial and material respect, it shall be promptly returned to the applicant to complete.
