Reporting Problems in Education

Elementary and secondary schools must report EEO information to EEOC and HEW (Federal Financial Assistance Programs).

The EEO-5 "Elementary Secondary Staff Information Survey" was first required of respondents by EEOC in 1973. There are about 16,000 school districts in the United States with 90,000 schools. Not all of these, however, fall under Title VII coverage. Approximately 7,400 school districts and 70,000 schools are required to fill the EEO-5 form bringing the total number of annual respondents to 77,400. EEOC estimates the form requires 5 hours on the average to be completed and filed.

Under Title VII of the Civil Rights Act of 1964, institutions with over 100 employees must file the EEO-6 "Higher Education Staff Information Survey" to EEOC. There are approximately 3,000 institutions that must file this report. EEOC estimates the survey requires 5 hours on the average to complete.

The employee workforce is broken into six functional areas: executive, administrative, managerial, faculty and secretarial, clerical and technical, paraprofessionals and skilled crafts. Within each of these areas, the workforce is broken down by pay, sex, and ethnic origin.

In addition institutions receiving Federal financial assistance are subject, under Title VI, to HEW compliance reviews, employee discrimination complaint investigation, and periodic data collection.

Schools must formulate, maintain, and at times submit AAP's to the Office for Civil Rights (HEW). The statistical portion of the required plan nearly duplicates the EEOC required EEO-6 survey form. Although not completely duplicative, similar material is asked for in a different format.

The following forms (Figures 13 and 14) show the similarity in requested information.

The Commission believes that the use of the EEO-6 for the statistical portion of the AAP would eliminate unnecessary duplication.
