Dear Mr. Chairman:

Under the Ethics in Government Act of 1978, Presidential nominees requiring Senate confirmation who are not expected to serve in their Government positions for more than 60 days in a calendar year are not required to file public financial disclosure reports. The Act, however, contains a provision in Section 101(b) which allows the committee holding the confirmation hearing to request any financial information it deems appropriate from the nominee.

We understand that your Committee desires to receive a financial disclosure report (SF 278) from any Presidential nominee for whom your Committee holds a confirmation hearing, along with a written opinion from this Office regarding any possible conflicts of interest.

Therefore, I am forwarding a copy of the financial disclosure report of Charles William Burton, who has been nominated by President Clinton for the position of member of the Board oi Directors of the United States Enrichment Corporation. Because Mr. Burton is not expected to serve more than 60 days in any calendar year, the enclosed report and this letter are submitted to you in accordance with your Committee.s confirmation procedures and will be available for public inspection only to the extent provided by your practices. There is no authority under the Act for public release of this material by the executive branch.

We have reviewed the report and have obtained advice from the United States Enrichment Corporation concerning any possible conflict in light of its functions and the nominee.s proposed duties. Also enclosed is a letter, dated March 13, 1995, which discusses Mr. Burton.s ethics agreements with respect to recusals and other matters.

Based thereon, we believe that Mr. Burton is in compliance with applicable laws and regulations governing conflicts of interest.
