FOREWORD

HIS compilation of the rules of procedure and appeals of the various courts and quasi-judicial bodies, before which the Oklahoma lawyer appears, has been carefully prepared to fill a much-needed and long-felt want. It contains the rules governing the Oklahoma Supreme Court, Industrial Commission, Probate Procedure, Procedure of Interstate Commerce Commission, United States Circuit Court of Appeals, United States Supreme Court, with Equity Rules of United States Courts and the rules of the Criminal Court of Appeals of Oklahoma. No pains have been spared to make this book exhaustive and accurate; a guide has been added showing what rules govern, and a complete index has been carefully worked out showing by rule nutuber and page number where each rule is to be found. It is confidently hoped that these features will make the book a handy and reliable source for information not elsewhere found in one publication.

We commend it to the lawyer as a short and correct guide to what procedure obtains in the various courts; as a ready reference on questions of appellate procedure and the requirements exacted by the numerous quasi-judicial bodies on matters originally before them and appeals therefrom.

GUIDE TO THE RULES GOVERNING THE COURTS IN WHICH THE OKLAHOMA LAWYER APPEARS. Justice of Peace: Practice is governed by Oklahoma Code. County Court: Practice is governed by Oklahoma Code and rules adopted by each court, except probate procedure, the rules for which are prescribed by Supreme Court. See page 15.

District Court: Practice is governed by Oklahoma Code and rules adopted by each court.

Criminal Court of Appeals: Practice is governed by rules of Criminal Court of Appeals.

Supreme Court Commission: Practice is governed by rules of Supreme Court. See page 1.

Supreme Court of Oklahoma: Practice is governed by Oklahoma Code and rules adopted by Supreme Court. See page 1.

Industrial Commission: Appeals are governed by rules prescribed by Supreme Court. See page 11.

Corporation Commission: Practice is governed by Oklahoma Code, the procedure being same as in District Court sitting as a court of equity.

United States Commissioner: Common law procedure governs except when holding preliminary hearing when procedure is same as prescribed by Oklahoma Code for similar hearing.

Bankruptcy Court: Common law procedure governs. United States District Court: In criminal cases, common law procedure governs; in civil actions at law, procedure follows Oklahoma Code; in equity cases, equity rules govern. See page 129.

Inter-State Commerce Commission: Procedure is prescribed by special rules. See page 22.

Circuit Court of Appeals: Special rules govern procedure.

ORGANIZATION OF THE FEDERAL COURTS IN THE

STATE OF OKLAHOMA.

From Sec. 101, Judicial Code, 36 Stat. at L., 1122 Comp. St., 1911, p. 179, 1912, Supp. S. A. Vol. 1, p. 181.

"The State of Oklahoma is divided into two judicial districts to be known as the eastern and western districts of Oklahoma. The eastern district shall include the territory embraced on the first day of July, nineteen hundred and ten, in the counties of

Terms of the district court for the eastern district shall be held at Muskogee on the first Monday in January; at Vinita on the first Monday in Marsh; at Tulsa on the first Monday in April; at South McAlester on the first Monday in June; at Ardmore on the first Monday in October and at Chickasha on the first Monday in November each year.

The western district, shall include the territory embraced on the first day of July nineteen hundred and ten, in the counties of

Terms for the district court of the district shall be held in Guthrie on the first Monday in January; at Oklahoma City on the first Monday in March; at Enid on the first Monday in June; at Lawton on the first Monday in September; and at Woodward on the first Monday in November: Provided, That suitable rooms and accommodations for holding court at Woodward are furnished free of expense to the United States. The clerk of the district court for the eastern district shall keep his office at Muskogee and the clerk for the western district at Guthrie, and shall maintain an office in charge of himself or a deputy at Oklahoma City."
