World War I

This act restated and enacted
into positive law as title 38,
U.S.C., effective Jan. 1,
1959, the then existing law
providing this benefit (act
of June 17, 1957, as amended
by acts of Aug. 28, 1957,
and Sept. 7, 1957).
Effective July 1, 1960.
Excludes from consideration
as income payments of the 6-
months' death gratuity; do-
nations from welfare organi-
zations; VA payments of
pension, compensation, de-
pendency and indemnity
compensation, insurance, or
servicemen's indemnity; so-
cial security lump sum
death payments; retirement
benefits equal to contribu-
tions; amounts equal to
amounts paid for the vet-
eran's just debts, the ex-
penses of last illness and ex-
penses or burial not reim-
bursed by the Veterans'
Administration; proceeds of
fire insurance policies and
earned income of children.
All waived income counts.
Eliminates exclusion from in-
come of annuities paid by
service departments to sur-
vivors of deceased retired
members of the Armed
Forces, which was provided
by sec. 11, act of Aug 8,
1053 (codified by act of
Aug. 10, 1956 as 10 U.S.C.
1441).

Net worth may result in denial of pension.

Bavings provision protects persons on pension rolls on

June 30, 1900, unless they

aleet nension under this act.
