Railroads and airlines. Selective strikes. When RLA medi
ation efforts fail, employees may
strike selectivity, but President
may require partial operation to
extent that services cannot be
provided by other means, and
their termination would imperil
national health or safety. Any
agreement won by selective strike
must be offered to those not struck.
Emergency procedures. If dispute
threatens to deprive any section
of country of essential transporta-
tion service, President may in-
voke emergency proceedings,
terminating all strikes for 60 days.
At end of 60-day period, Presi-
dent would have following options
to be used in any sequence: (a) an
additional cooling-off period of
not more than 30 days, (b) a
selective strike subject to the
limitations specified in the bill,
(c) final offer selection.
Government operation
and employees are
deprived of retroactive
pay for such period.
Selective strike in rail in-
dustry defined as not
more than 2 carriers or
groups of carriers in
any 1 of the 3 regions
and the aggregate
revenue ton-mile trans-
ported does not exceed
20 percent of total
revenue ton-miles trans-
ported by all carriers in
that region in preced-
ing year. If only 1 car-
rier is struck, the reve-
nue ton-mile limitation
shall not apply in that
region.
