SEC. 201. (b) Section 4 (a-2) of the Act is further amended by adding the following subsection:

"(iv) any day with respect to which the Board finds that, though not subject to the disqualification pro

vided in paragraph (iii), he failed to report for work

and perform his assigned duties during a stoppage of

work because of a strike in the establishment, premises, or enterprise at which he was last employed."

SEC. 201. (c) Section 4 (b) of the Act is repealed in its entirety, and sections 4 (c), 4 (d), and 4 (e) are redesignated as, sections 4 (b), 4 (c), and 4 (d), respectively.

To amend the national emergency provisions of the LaborManagement Relations Act, 1947, so as to provide for dissolution of injunctions thereunder only upon settlement of disputes.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) section 209 (b) of the Labor-Management Rela4 tions Act, 1947 (29 U.S.C. 179 (b)), is amended by strik5 ing out the words "and shall certify the results thereof to 6 the Attorney General within five days thereafter". 7 (b) Section 210 of such Act (29 U.S.C. 180) is 8 amended by striking out the words "Upon the certification 9 of the results of such ballot or upon a settlement being 10 reached, whichever happens sooner" and inserting in lieu 11 thereof "Upon a settlement being reached".

A BILL

To amend the Labor Management Relations Act, 1947, to provide for the settlement of emergency labor disputes affecting commerce which imperil the health and safety of a major region of the Nation.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) the first sentence of section 206 of the Labor Man4 agement Relations Act, 1947, is amended to read as fol5 lows: "Whenever, in the opinion of the President, a threat6 ened or actual strike or lockout in an industry affecting com7 merce will, if permitted to occur or to continue, imperil the 8 health and safety of the Nation or a major region thereof, 9 he may appoint a board of inquiry to inquire into the issues 10 involved in the dispute and to make a written report to him 11 within such time as he shall prescribe.".

1 (b) (1) Section 208 (a) (i) of such Act is amended to

"(i) is in an industry affecting commerce; and".

(2) Section 208 (a) (ii) of such Act is amended by

5 striking out the words "health or safety of the Nation or

7 (c) Section 209 (a) of such Act is amended by striking

8 out the words "national health or safety" and inserting in

9 lieu thereof the words "health or safety of the Nation or a 10 major region thereof".

SEC. 2. (a) Congress hereby finds—

(1) that the present procedures established by sections 206-210 of the Labor-Management Relations Act, 1947, and section 10 of the Railway Labor Act for dealing with labor disputes which threaten the health or

safety of the Nation or a substantial part of its population
