§ 68.1

Reissuance and purpose.

This part reissues DoD Instruction 1000.7, dated June 28, 1960, which is superseded to prescribe a uniform identification and privilege card (DD Form 11731) for issue to dependents of members of the Uniformed Services, civilians accompanying or employed by the Uniformed Services, foreign personnel subEject to NATO Status of Forces Agreements who are entitled to medical care in accordance with DoD Directive 6310.7, "Medical Care for Foreign Personnel Subject to the North Atlantic Treaty Organization (NATO) Status of Forces Agreement (SOFA)," dated December 18, 1962,2 and for such purposes as may be determined.

§ 68.2 Policy and scope.

(a) DD Form 1173 shall be used throughout the Department of Defense for identification of those categories of persons listed in § 68.1, and as an authorization card for the benefits or privileges administered by the military departments to which those persons may be entitled. No other forms shall be used for such purposes, except as provided in this part.

(b) The DD Form 1173 shall be printed in black security-type ink on a paper insert with an identification of passport-type photograph of the bearer and laminated between two sheets of plastic.

(c) DD Form 1173 shall not be issued to individuals when eligibility for or usage of the card for periods of 30 days or less is indicated. Except in unusual cases, DD Form 1173 shall not be issued to minor dependents under ten years of age. Normally, certificates of these minors for eligibility for medical care in civilian medical facilities will be the responsibility of the accompanying parent, member or acting guardian.

(d) DD Form 1173 will replace all other identification or organization cards now prescribed by the military departments for the categories of personnel indicated above, except as may be required for additional identification for access to classified areas; activities or installations, or at the discretion of the headquarters of the military department concerned, to satisfy unusual requirements which cannot be met by DD Form 1173.

(e) DD Form 1173 shall generally not be issued to military personnel except on an individual basis. DD Form 1173 may be issued to a member of the Armed Forces if the Secretary of the Service concerned or his designee, considers the issuance to be in the Service's interest. DoD Instruction 1336.2, "Identification Cards for Issue to the Members of the Armed Forces of the United States," dated June 12, 1967 (Part 67 of this subchapter), prescribes the identification card to be issued to members in an active, inactive or reserve status. § 68.3

Procedures.

(a) Application for issuance of the DD Form 1173 ID card shall be made on DD Form 1172 (see § 68.5).

(b) The method of control and record of issuance of DD Form 1173 shall be as determined by the respective military departments.

(c) Existing official criteria relative to the determination of eligibility and identification of individuals will apply to the issuance of DD Form 1173.

(d) The DD Form 1173 shall be effective for the contracted period of service of the sponsor upon whom the entitlement is based, in the case of dependents of members of the Uniformed Services, or, in the case of minors, the 21st birthday, if it occurs prior to the termination of the service of the sponsor except that for entitlement to medical care, the provisions of DoD Directive 6010.4, "Dependents' Medical Care," dated April 25, 1962 (Part 70 of this subchapter), and Public Law 89-614 will apply.

(e) DD Forms 1173 issued to personnel other than dependents of members of the Uniformed Services, or to dependents of personnel having no contracted period of service, such as deceased and retired military personnel, may be assigned an expiration date as prescribed by the military departments, but not later than 6 years from date of issuance.

(f) DD Forms 1173 issued to the dependents of a retired or deceased member who will reach age 65 before the normal 6-year expiration date would occur, will show an expiration date reflecting the date preceding the day on which such a person will reach age 65.

(g) The military departments will ensure that sponsors are directed to notify the appropriate authority immediately upon any change in status that would terminate or modify the right to any of the benefits for which the DD Form 1173 may be issued. Survivors of deceased personnel will likewise be so directed.

(h) All dependents of each sponsor will be listed on the application Form DD 1172 (see § 68.5). A separate DD Form 1173 will be issued to each dependent 10 years of age or older. DD Forms 1173 shall not be reissued solely because of changes in the grade of the sponsor. (i) Instructions for preparation of items 4, 9, 11, 14, and 15 of DD Form 1173 are shown in § 68.4; other items on the Form are self-explanatory.

(j) Privileges and facilities not authorized for the holder of DD Form 1173 will be blocked out.

U-Unremarried Widow; UW-Unremarried Widower. When issued to a person who is not a dependent, the words "and Relationship” will be lined out.

Item 9 In those special circumstances which permit children 21 and over entitlement to medical care and other privileges, indicate, after date of birth (INC) for incompetency, or (SCH) for attendance at an approved school.

Item 11 Present status of sponsor will be indicated by code as follows:

AD-Active Duty; RET-Retired; Deceased; CIV-Civilian;

FM-Foreign Military Personnel.

Item 14 Signature of cardholder in those instances where the individual is incompetent will be coded as (INC).

Item 15a The positive entry "YES" will be entered when bearer is entitled to medical care in Uniformed Services facilities. These include:

a. Eligible spouses and children of members of the Uniformed Services who are on active duty for a period of more than 30 days.

b. Eligible spouses and children of active duty members who died while on active duty for a period of more than 30 days.

c. Eligible spouses and children of retired members and deceased retired members, including the spouses and children of those reservists entitled to retired pay under the provisions of DoD Directive 1340.7, "Notifica-t tion of Eligibility for Retired Pay for Members of Reserve Components," dated March 29, 1967. d. Eligible parents and parents-in-law of members of the Uniformed Services who are on active duty for a period of more than 30 days and of members who died while on such duty.

e. Eligible parents and parents-in-law of retired members and of deceased retired members.

Item 15b The positive entry "YES" will be entered for persons who fall in categories of a through c, above. The "effective date" will be as follows:

a. For persons in category a, above, the most recent date the person became an eligible dependent, or December 7, 1956, whichever is later.

b. For persons in category b and c, above, the date the person became an eligible dependent, or January 1, 1967, whichever is later.

c. The date a person becomes an eligible dependent is one of the following as appropriate:

1. Date of marriage to sponsor; or

2. Date of sponsor's last entry on active uty after a break in service of more than 4 hours; or

3. Date of sponsor's initial entry on coninuous active duty (no break in service of nore than 24 hours); or

4. In the case of children, the date: of irth; of adoption by sponsor; or on which he child became a dependent of sponsor. d. Block out item 15b on cards issued to ersons

1. In categories b and c, Item 15a, above, ! the foregoing persons are 65 years of age r older and are entitled to hospital insurnce benefits under title I of the Social Secuity Amendments of 1965.

2. In categories d and e, Item 15a, above.

69.4 Concept of operation.

69.5 Responsibilities and functions. 69.6 Authorities.

AUTHORITY: The provisions of this Part 69 are issued under sec. 301, 80 Stat. 379; 5 U.S.C. 301; sec. 202, 76 Stat. 517; 10 U.S.C. 133; Recurring Provision of the Department of Defense Appropriations Act, General Provisions; and chapter 1041, 70A Stat. 442; 10 U.S.C. 7204.

$69.1 Purpose.

(a) This part assigns to a single Military Department responsibility for budgeting and funding for both operation and logistic costs of all overseas dependents schools in a geographical area (§ 69.5(b))

(b) It provides for the establishment of a Department of Defense Overseas Dependents Schools System operated by the Military Departments under the policy direction of the Assistant Secretary of Defense (Manpower and Reserve Affairs).

$69.2 Applicability.

The provisions of this part apply to all components of the Department of Defense.

As used in this part, the following definitions will apply:

(a) “Overseas Dependents Schools" are schools established by the DoD in overseas areas (with the exception of Alaska, Hawaii, Puerto Rico, Guam, the Virgin Islands, and Wake Island) for the purpose of providing elementary and secondary education for minor dependents of DoD military and civilian personnel stationed overseas.

(b) "School-Unique Items" are those items of supply, materials and equipment which are peculiar to the operation of an educational program and are not usually available through normal military supply stocks. School-unique equipment includes all movable items of equipment and furniture used in the educational program, which are not normally attached to, or when installed, become a part of the building. Examples of schoolunique items of equipment are shop power tools, special equipment in home economics rooms, such as stoves and refrigerators, and language laboratories.

(c) "School Professional Personnel" are those civilian personnel employed in the DoD Overseas Dependents School System, either on a school-year or calendar-year basis, whose duties involve classroom or other instruction or administration, supervision or direction of school programs, including other school positions which require academic credits in educational theory and practice.

(d) "Logistic Support" includes the provision of suitable and adequate school facilities: Dormitories (when required); area and district offices; all equipment normally attached to the building; school logistics personnel; services, such as maintenance and repair of facilities, custodial, transportation of students, utilities, school lunch (where required); housing for school personnel; and other logistic services necessary to enable the geographic manager to accomplish his mission; all exclusive of military construction in excess of $25,000.

§ 69.4 Concept of operation.

(a) The DoD Overseas Dependents Schools System shall be divided into three geographical school areas for operation and administration: European, Pacific, and Atlantic. The European and Pacific school areas shall be subdivided into school districts. The Atlantic Area will be a combination school areadistrict.

(b) In developing school districts and determining the number required, the Secretaries of the Military Departments will:

(1) Consider student load, geographical location of schools, consolidation of academic functions, and personnel economies; and

(2) Seek to achieve maximum consolidation of academic functions which will permit personnel economies without diminution of the quality of education provided to dependent children. The initial proopsed district organization and any subsequent changes thereto will be submitted to the ASD (M&RA) for approval prior to implementation. § 69.5

Responsibilities and functions.

(a) Under the direction of the Secretary of Defense, the Assistant Secretary of Defense (Manpower & Reserve Affairs) is responsible for establishing the policies for the organization, operation, administration and logistic support of the Overseas Dependents Schools System of the Department of Defense. To carry out the above responsibilities, ASD (M&RA) will perform the following functions:

(1) Determine the general educational goals and objectives of overseas dependents schools.

(2) Develop appropriate curricula and lists of approved instructional materials for use within the Overseas Dependents School System.

(3) Provide for the procurement and distribution of school-unique items.

(4) Establish professional standards for all School Professional Personnel.

(5) Provide for the common recruitment, selection, assignment, and transfer of all School Professional Personnel to and between overseas school areas.

(6) Develop standards for the effective operation and administration of the academic program, including staffing criteria.

(7) Develop functional requirements for school facilities, and establish priorities for school construction, worldwide.

(8) Develop policy and guidelines for the establishment and disestablishment of Department of Defense Overseas Dependents Schools, including dormitory facilities; and serve as liaison with the State Department when political considerations are involved.

(b) The Secretaries of the Military Departments:

(1) Are assigned responsibility for the operation and administration of all dependents schools, and for the provisions of tuition-fee schooling in the following geographical areas:

(i) Countries in Europe, Africa, and Asia to 90° E. longitude-Secretary of the Army.

(ii) Atlantic Area, including North, Central, and South America-Secretary of the Navy.

(iii) Pacific Area, including all countries in the Far East to 90° E. longitude, Australia, and New Zealand-Secretary of the Air Force.

(2) Will program, budget and fund all the appropriated costs of the Overseas Dependents Education System in their respective areas with the exception of military construction and military personnel requirements, including those identified in DoD Instruction 1342.5 "Elements of Cost for Education of Dependents Overseas and Computation Chargeable to Per Pupil Limitation," June 2, 1965,1 and any other costs incurred in support of this program. Each Department will program, budget and fund for the facilities requirements related to its respective installations, in accordance with applicable Instructions, and to provide for the program prescribed by the Department having geographic responsibility. All logistic support funded from appropriations available for operation and maintenance will be provided by each Department for those schools located on its respective installations subject to reimbursement by the Department having geographic responsibility. Investment items, other than under the military construction account, will be budgeted and funded by the Department having geographic responsibility. Reimbursable agreements between the geographical manager and appropriate officials of the supporting services, indicating the level of support to be provided and the related costs, should be effected each year within sixty (60) days after the opening of school. This agreement should include the cost of military support to be provided; however, no reimbursement will be provided for military personnel costs.

(3) Will approve enrollments in tuiion-fee schools in their respective areas. (Exceptions to be approved by ASD (M&RA).)

(4) With concurrence from the ASD (M&RA) will select and appoint a school area superintendent, and provide for the appointment of subordinate district superintendents as appropriate for the operation and administration of the schools in the assigned area. The school area superintendents will:

(i) Organize, administer, and supervise the total educational program of all dependents schools in his assigned school

area.

(ii) Provide consultant services to school professional personnel and other school personnel on the educational program.

(iii) Develop an effective program for in-service training of school professional personnel.

(iv) Review the logistical support provided dependents schools by base and installation commanders as it affects the educational program.

I (v) Review and establish an order of priority for school construction, renovation, rehabilitation and alteration required, in his assigned school area.

(vi) In coordination with appropriate overseas commanders, and in compliance with policy established by ASD (M&RA), establish and disestablish Department of Defense Overseas Dependents Schools, including dormitory facilities.

(vii) Establish committees and advisory groups as appropriate.

(5) Will program, budget and fund for construction of school facilities costing in excess of $25,000 at their respective installations.
