R. 10194] The Committee on Claims, to whom was referred the bill (H. R. 10194) for the relief of the late John L. Summers, former disbursing clerk, Treasury Department, having considered the same, report favorably thereon without amendment and recommend that the bill do pass. The purpose of the proposed legislation is to authorize and direct the Comptroller General of the United States to credit in the accounts of the late John L. Summers, former disbursing clerk, Treasury Department, the sum of $12,023.75, together with the amounts of any additional payments which may be or may have been suspended or disallowed in his accounts more than 3 years after such payments were made. The facts will be found fully set forth in the Treasury Department report, which is appended hereto. TREASURY DEPARTMENT, The honorable The SPEAKER OF THE HOUSE OF REPRESENTATIVES, Washington, D. C. SIR: There is transmitted herewith a draft of a bill for the relief of John L. Summers, former disbursing clerk, deceased, for certain payments made by him and disallowed by the General Accounting Office in his accounts. Mr. Summers ceased disbursing June 30, 1934, was retired September 30, 1935, and has been dead since October 1, 1937. General Accounting Office certificate of settlement G-98954-T, dated January 19, 1940, showed a balance due the United States of $12,023.75, representing disallowances in the accounts of Mr. Summers resulting from payments made during the period December 16, 1933, to June 30, 1934. Since the issuance of that certificate, suspensions totaling $1,341.90 have been received, making a total of $13,365.65 disallowed and suspended to date. The statement of differences attached to the certificate (a copy of which is furnished herewith), lists 55 disallowances, mostly in small amounts, against vouchers paid for the following agencies: Civil Aeronautics Authority: (formerly Bureau of Air Commerce, Department of National Recovery Administration: (now being handled by the Department of Federal Works Agency: Public Works Administration (formerly Federal Emergency Administration of Public Works).. During the period covered by the above-mentioned certificate of settlement, John L. Summers made payments aggregating over $344,000,000 and the amount of disallowances and suspensions, $13,365.65, is very small in comparison. All of the payments were made by Mr. Summers in good faith and upon vouchers bearing certificates of responsible certifying officers that the services had been performed or the goods delivered. There is no evidence in this Department indicating that the Government has not received value for these disbursements. Neither is there any evidence of fraud or negligence on the part of the disbursing officer. It is recommended that favorable consideration be given to this proposed legislation at the present session of Congress, since payment to the persons entitled to moneys to the credit of the former disbursing clerk in the civil service retirement and disability fund, is being withheld pending adjustment of his accounts.
