Amendments:

1967. Act Sept. 11, 1967, P.L. 90-83, § 1(45)(A), 81 Stat. 208, in the
subchapter heading, substituted "Foreign Gifts and Decorations" for
"Foreign Decorations".

§ 7341. [Repealed]

HISTORY; ANCILLARY LAWS AND DIRECTIVES

This section (Act Sept. 6, 1966, P. L. 89-554, § 1, 80 Stat. 526 was
repealed by Act Sept. 11, 1967, P. L. 90-83, § 1(45)(B), 81 Stat. 208. It
provided for receipt and display of foreign decorations, and is now
covered by 5 USCS § 7342.

§ 7342. Receipt and disposition of foreign gifts and decorations (a) For the purpose of this section

(1) "employee" means

(A) an employee as defined by section 2105 of this title [5 USCS § 2105] and an officer or employee of the United States Postal Service or of the Postal Rate Commission;

(B) an expert or consultant who is under contract under section 3109 of this title [5 USCS § 3109] with the United States or any agency, department, or establishment thereof, including, in the case of an organization performing services under such section, any individual involved in the performance of such services;

(C) an individual employed by, or occupying an office or position in, the government of a territory or possession of the United States or the government of the District of Columbia;

(D) a member of a uniformed service;

§ 7325. Penalties

An employee or individual who violates section 7324 of this title [5 USCS § 7324] shall be removed from his position, and funds appropriate for the position from which removed thereafter may not be used to pay the employee or individual. However, if the Merit System Protection Board finds by unanimous vote that the violation does not warrant removal, a penalty of not less than 30 days' suspension without pay shall be imposed by direction of the Board.

Other provisions:

Prospective amendment of section. Act Jan. 14, 1983, P. L. 97-468, Title VI,
§ 615(b)(1)(E), 96 Stat. 2578, provides that this section shall be amended on the date of
transfer of the Alaska Railroad to the State of Alaska pursuant to 45 USCS § 1203 or
other disposition pursuant to 45 USCS § 1210, whichever occurs first. Such prospective
amendment shall delete subsec. (a), and delete “(b)" preceding "The".

§ 7328. General Accounting Office employees

The preceding provisions of this subchapter [5 USCS §§ 7321 et seq.] shall not apply to employees of the General Accounting Office.

Effective date of section:

Act Feb. 15, 1980, P. L. 96-191, § 10(a), 94 Stat. 34, provided that this section shall take
effect on-

"(1) October 1, 1980; or

"(2) if later, one hundred and twenty days after the date of the enactment of this Act
[enacted Feb. 15, 1980].”
