The subcommittee met, pursuant to notice, at 10 a.m., in room 2203, Rayburn House Office Building, Hon. Chet Holifield (chairman of the subcommittee) presiding.

Present: Representatives Chet Holifield, Benjamin S. Rosenthal, Frank Horton, John W. Wydler, Clarence J. Brown, and Richard W. Mallary.

Also present: Elmer Henderson, general counsel; Douglas Dahlin, counsel for military operations; Paul Ridgely, investigator; and Warren Buhler, minority staff member, Committee on Government Operations.

Chairman HOLIFIELD. The committee will be in order.

These hearings have been called by the Subcommittee on Legislation and Military Operations of the House Committee on Government Operations to consider Reorganization Plan No. 2 of 1973, submitted to Congress by the President on March 28, 1973. The plan will consolidate certain drug law enforcement activities in the Department of Justice and the Bureau of Customs of the Treasury Department.

Under the Reorganization Act of 1949, the Congress has 60 days, not counting periods of adjournment over 3 days, to disapprove the plan. Thus far, no disapproval resolution has been filed.

The plan is intended to bring together the activities of related agencies and to develop a more appropriate division of labor between the Department of Justice and the Treasury Department in the enforcement of our drug laws. The President indicated in his message that, although some progress had been made in the suppression of the drug traffic, the present scattering of Federal programs has complicated our efforts in this important field.

The plan will create a Drug Enforcement Administration within the Department of Justice which will absorb the functions of the Bureau of Narcotics and Dangerous Drugs, the Office for Drug Abuse Law Enforcement, and the Office of National Narcotics Intelligence, all presently in the Department of Justice.

The new administration would also receive functions transferred from the narcotics unit of the Bureau of Customs and, thus, will be charged with all domestic and foreign law enforcement operations (1)
