AN ACT to authorize the board of supervisors of Bolivar county, to issue the bonds of separate road districts No. 3, in said county. Bolivar county authorized to issue bonds of Separate Road District No. 3. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the board of supervisors of Bolivar county are hereby authorized to issue the bonds of Separate Road District No. 3, in said county, to an amount not in excess of fifteen per cent (15%) of the assessed valuation of the real and personal property in said district, as shown by the assessment rolls of said county. How bonds to be issued. Sec. 2. Said bonds shall be issued under all of the conditions and requirements of, and shall be made in all respects to conform with the provisions of Chapter 207 of the Acts of 1920, and amendments thereto, except as modified by this act. Sec. 3. That this act shall take effect and be in force from and after its passage. Approved March 20, 1924. CHAPTER 448. HOUSE BILL No. 995. AN ACT authorizing the board of supervisors of Bolivar county to levy for each of the years 1924 and 1925 on all of the taxable property in Bolivar county, in addition to all other taxes, an ad valorem tax of one mill on the dollar for the purpose of raising funds with which to equip, conduct and maintain during said years the Delta State College for Teachers, in the event said Delta State College for Teachers shall be located in Bolivar county under the provisions of Senate Bill No. 263. Bolivar county authorized to levy special tax to equip and maintain Delta State College for Teachers. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the board of supervisors of Bolivar county, Mississippi, be and it is hereby authorized to levy for each of the years. 1924 and 1925 on all of the taxable property in Bolivar county, in addition to all other taxes, an ad valorem tax of one mill on the dollar for the purpose of raising funds with which to equip, conduct and maintain during said years the Delta State College for Teachers, in the event said Delta State College for Teachers shall be located in Bolivar county, under the provisions of Senate Bill No. 263. Sec. 2. The tax levy provided for in Section 1 of this act may be levied by said board of supervisors even though it may exceed any limitation now authorized by law. Sec. 3. That this act take effect and be in force from and after its passage. 42 LOCAL AND PRIVATE LAWS CHAPTER 449. HOUSE BILL No. 996. AN ACT authorizing the trustees of the Bolivar County Agricultural High School, at Cleveland, Mississippi, to transfer, donate convey and deliver unto the Delta State College for Teachers all funds and real and personal property belonging to said agricultural high school in the event said Delta State College for Teachers shall be located in Bolivar county under the provisions of Senate Bill No. 263; prescribing the consideration therefor and authorizing such trustees to execute necessary or proper deeds or other instruments to effect such transfer and conveyance. Agricultural High School Trustees may transfer all funds and real and personal property to Delta State College for Teachers. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the trustees of the Bolivar County Agricultural High School, at Cleveland, Mississippi, be and they are hereby authorized to donate, transfer, convey and deliver unto the Delta State College for Teachers all funds and real and personal property belonging to said Agricultural High School in the event said Delta State College for Teachers shall be located in Bolivar county, under the provisions of Senate Bill No. 263. Sec. 2. That the trustees of said Agricultural High School are hereby authorized to transfer and convey said funds, and real and personal property, as provided in Section 1 of this act, without any other consideration therefor than that the said Delta State College for Teachers shall have been located in Bolivar county and to effect such transfer and conveyance the Trustees of said Agricultural High School are hereby authorized to execute such deeds or other instruments of writing as may be proper or necessary. Sec. 3. That this act take effect and be in force from and after its passage. Approved April 9, 1924. CHAPTER 450. HOUSE BILL NO. 969. AN ACT to authorize the county of Bolivar, Mississippi, to issue bonds for the purpose of procuring the Delta State Teachers' College. Bolivar county may issue bonds to secure Delta State Teachers College. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the county of Bolivar be, and it is hereby authorized and empowered to issue bonds of the said county in the sum of not exceeding one hundred and fifty thousand dollars to aid in STATE OF MISSISSIPPI 43 the establishment and location of the Delta Teachers' College. Said bonds shall be isued under and in conformity with the law governing the issuance of all general bonds, as provided by law, and shall not be included in computing any limit which is now placed by law on the amount of bonds to be issued by said county. The proceeds of the sale of said bonds shall be used for the purchase of land or erecting a building, or buildings, or in any other way to aid in the location of the said Delta Teachers' College. Sec. 2. That this act take effect and be in force from and after its passage. Approved April 8, 1924. CHAPTER 451. SENATE BILL No. 439. AN ACT to authorize the board of trustees of Calhoun County Agricultural High School with the consent of the board of supervisors of said county to borrow money and to secure payment thereof for the erection and equipping of certain buildings for said school, and providing for the payment of the debt. Trustees of Calhoun County Agricultural High School may borrow money to equip buildings, etc. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the trustees of the Calhoun County Agricultural High School, with the consent of the board of supervisors of Calhoun county, Mississippi, be and they are hereby authorized to borrow, at a rate of interest not to exceed six per centum per annum, money in sufficient amount or amounts for the purpose of building and equipping an academic building for said school; and for providing necessary equipment for said building, provided that the indebtedness hereby authorized shall not at any one time exceed $35,000.00. Derma High School to assign and deed certain property. Sec. 2. Provided that Derma School District heretofore established and now in existence, shall assign and deed to the trustees of the Calhoun County Agricultural High School the property they now own, and shall donate thereto a sufficient amount in cash to equal in value $10,000.00; said value shall be determined by the board of trustees of said school and the board of supervisors of said county. How payment of debt shall be secured. Sec. 3. That said trustees may secure the payment of said debt or debts by a mortgage or mortgages covering all on any part of 44 LOCAL AND PRIVATE LAWS the said property of said agricultural high school now in existence, or which may be added hereafter, and the maturity of said debt or debts may be fixed at such time or times as may be deemed by said trustees most advantageous to the people; provided, however, that no indebtedness shall be incurred under the provisions of this act until notice thereof be published in a newspaper in said county for twenty one days prior to the date of the proposed creation of said indebtedness, and if in the meantime a petition of protest is filed with the clerk of the board of supervisors signed by twenty per cent of the qualified electors of said county, then no such indebtedness shall be incurred until the same has been ratified by a majority of the qualified electors of said county voting in an election held in the manner prescribed by law in such cases. Debt to be retired by tax levy or levies. Sec. 4. Such debt or debts shall be retired by tax levy or levies in the manner provided by law for such levies or by any other means provided by law for the discharge of such obligations and the board of supervisors of Calhoun county, Mississippi, may extend said tax levy or levies over a period of years as may be deemed by said board of supervisors most advantageous to the people. Sec. 5. That this act take effect and be in force from and after its passage. Approved March 27, 1924. CHAPTER 452. HOUSE BILL No. 333. AN ACT to authorize and empower and direct the chancery clerk of Calhoun county to record certain deeds and records at stated prices for recording fees. Certain deeds and records to be recorded by chancery clerk of Calhoun county. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the chancery clerk of Calhoun county, Mississippi, be and he is hereby authorized and empowered and directed to accept for record and record upon the books of said county furnished for said purpose, any land deed or land abstract which said deed or abstract had formerly been of record in said county and which record was destroyed by fire, in the burning of the courthouse in said county in December, 1921, and as compensation for such service in so recording such deed or abstract which had formerly been of record, the said chancery clerk shall receive not more than 50 per cent of the fee now allowed by law for such 45 STATE OF MISSISSIPPI Advertisement to be made in county paper. Sec. 2. That immediately upon the passage of this act, the said chancery clerk of the said county, shall give notice of its provisions by advertising in the county paper located in said county for a period of thirty days, inviting parties of interest to file their deeds and abstracts with him for such recording. Act to be in effect January 1st, 1926. Sec. 3. That this act shall take effect and be in force from the date of its passage up to and including the 1st day of January, 1926, and no deed or abstract offered for record after such date shall be accepted at the reduced rate mentioned herein. Approved April 9, 1924. CHAPTER 453. HOUSE BILL No. 958. AN ACT authorizing the board of supervisors of Calhoun county to levy a special assessment of five mills on the Calhoun City public school district to pay for furniture and equipment replacing that destroyed by fire. Special assessment to pay for furniture and equipment for Calhoun City public school. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the board of supervisors of Calhoun county be and are hereby authorized to levy a special assessment of five mills on property located in the Calhoun City Public School District, for the current year, all monies derived therefrom to be used exclusively in paying for furniture and equipment for the public school or schools of said district. Notice of intent to make levy shall be given for three weeks. Sec. 2. Before making such special assessment or levy, the said board of supervisors shall publish notice of their intention to make said levy for two weeks in a newspaper published in said county, and in the event 20% of the qualified electors of said school district should file a written petition objecting to said levy within twenty one days after the completion of said publication, the board of supervisors shall thereupon call a special election to determine whether or not said levy shall be made. A majority of those voting at such election shall determine the result. Sec. 3. That this act take effect and be in force from and after its passage. |
