CHAPTER 421.

SENATE BILL No. 243.

AN ACT authorizing the town of Purvis, Mississippi, to borrow a sum of money not exceeding four thousand ($4,000.00) dollars, for the purpose of paying a deficit incurred in installing its electric light plant and to issue its certificates of indebtedness for the same.

Purvis may borrow money to pay deficit in lighting plant.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the board of mayor and aldermen of the town of Purvis, Mississippi, be and are hereby authorized and empowered to borrow a sum of money not exceeding four thousand dollars ($4,000.00) for the purpose of paying a deficit incurred in installing its electric light plant, and to issue certificates of indebtedness signed by the mayor and clerk, evidencing such loan.

How certificates to be issued.

Sec. 2. That said certificates of indebtedness shall be issued in the denomination of $500.00 and shall be payable as follows: $1,000.00 on the first day of March, 1925, and $1,000.00 on the first day of March of each succeeding year until the entire loan is paid, interest payable annually on the first day of March. Not to be effective until ratified by qualified electors.

Sec. 3. The benefits and powers conferred by this act shall not be exercised and become effective until ratified by a majority of the qualified electors of the town of Purvis voting in said election called for that purpose by the mayor and board of aldermen of the town of Purvis, Mississippi, said election shall be held in the manner provided by law for the holding of such municipal elections.

Tax to be levied annually.

Sec. 4. That there shall be levied annually on all taxable property in said town, a tax sufficient to pay the interest on said certificates of indebtedness and to redeem them as they shall become due.

Additional authority to borrow money.

Sec. 5. That the rights herein conferred shall be in addition to any other powers to borrow money given the mayor and board of aldermen of Purvis, Mississippi, to borrow money, either under special or general acts of the legislature.

Sec. 6. That this act take effect and be in force from and after its passage and approval.

CHAPTER 422.

HOUSE BILL No. 393.

AN ACT to validate the serial liquidation of existing debts bonds in the sum of twelve thousand dollars ($12,000.00) of the city of Starkville, Mississippi, proposed to be issued by an ordinance passed by the board of mayor and aldermen of said city of Starkville on the 5th day of June, 1923.

Validating certain bond issues by city of Starkville.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the serial liquidation of existing debts bonds in the sum of twelve thousand dollars ($12,000.00) of the city of Starkville, in the county of Oktibbeha, state of Mississippi, proposed to be issued by an ordinance passed by the board of mayor and aldermen of said city of Starkville on the 5th day of June 1923 be and are hereby in all things made valid and legal and shall be when issued a binding obligation on the said city of Starkville regardless of defects or informalities in their issuance or of failure of chapter 209 of the printed laws of Mississippi of 1918 and amendments thereto to authorize the issuance of bonds by said city of Starkville for the purpose for which said bonds are proposed to be issued or of the failure in an election held in said city of Starkville on the 2nd day of July 1923 to properly submit to the qualified electors of the said city of Starkville the question. of whether or not they would vote to authorize the board of mayor and aldermen of said city of Starkville to issue said bonds or of the failure of said city of Starkville to comply with any law or part of law providing for their issuance or of the failure of any law to authorize the issuance of said bonds.

Sec. 2. That this act shall take effect and be in force from and after its passage.

CHAPTER 423.

SENATE BILL No. 188.

AN ACT authorizing and empowering the mayor and board of aldermen of the town of Sumner, Tallahatchie County, Mississippi, to transfer funds from the water and light fund to interest on bond funds and to sinking fund bond funds, or either of them, in their discretion.

Mayor and aldermen of Sumner authorized to transfer certain funds.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the mayor and board of aldermen of the town of Sumner, Tallahatchie county, Mississippi, be, and they are hereby

authorized, in their discretion, from time to time, as they may deem it proper and necessary to transfer the net income of the I water and light fund to the various interest bond funds and to the various sinking bond funds, or any or either of them of the said town of Sumner, Tallahatchie county, Mississippi. That it is the purpose of this act to authorize the said mayor and board of aldermen to appropriate the income from its water and light plant from time to time in their discretion as they may deem proper and necessary to paying interest on various bonds of the said municipality and to providing sinking funds for the retiring of bonds of the said municipality and liquidating the bonded indebtedness of the said municipality by the transfer of funds herein authorized.

Sec. 2. That this act take effect and be in force from and after its passage.

CHAPTER 424.

HOUSE BILL No. 1031.

AN ACT to authorize and empower the town of Tutwiler, Mississippi, through its mayor and board of aldermen, to supply electricity, electric lights and power to persons or corporations being within ten miles of the corporate limits of said town.

Tutwiler may supply electricity outside corporate limits.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the town of Tutwiler, Mississippi, through its mayor and board of aldermen, be and it is hereby authorized and empowered, in its discretion, to furnish electricity, electric lights and power to persons or corporations, within a distance of ten Provided, however, miles of the corporate limits of said town.

that said town shall not charge for said service a rate greater than 25% more than the rate charged in said town for such service.

Tutwiler may own property outside corporate limits for operation of electric plant.

Sec. 2. That for the purpose of this act the said town of Tutwiler may acquire by gift, grant or purchase, real or personal property outside of the corporate limits of said town and may own said property and may erect thereon poles, wires or conduits either above or below the surface of the earth and which may be necessary for the operation of such plant and equipment.

Sec. 3. That this act take effect and be in force from and after its passage.

CHAPTER 425.

SENATE BILL NO. 402.

AN ACT to authorize and empower the mayor and board of aldermen of the town of Union, Mississippi, to issue bonds for the purpose of erecting and equipping a school building in and for Union Municipal Separate School District, and to levy and collect taxes on taxable property of said district to pay said bonds.

Union may issue bonds for erection of school building.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the mayor and board of aldermen of the town of Union, Mississippi, be and they are hereby authorized and empowered to issue bonds either in the name of said town or in the name of the Union Municipal Separate School District in a sum not to exceed ten thousand dollars ($10,000.00) exclusive of all bonds heretofore issued and authorized by law, which sum shall be used to erect and equip a school building in and for said separate school district, and to levy taxes on the taxable property of said district to pay said bonds and interest.

How bonds shall be issued.

Sec. 2. Said bonds shall be issued in accordance and in full compliance with the law governing the issuance of municipal bonds by mayors and boards of aldermen, as provided by chapter 206, laws of Mississippi, 1920, and acts amendatory and supplementary thereto.

Sec. 3. That this act take effect and be in force from and after its passage.

CHAPTER 426.

HOUSE BILL No. 143.

AN ACT authorizing the town of Waveland, Hancock county, Mississippi, to issue public improvement bonds in the sum of two hundred twentyfive thousand dollars ($225,000.00) or so much thereof as may be necessary for the purpose of constructing sea walls or other necessary beach protection and to levy taxes to pay said bonds and interest.

Waveland may issue bonds for sea wall construction.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the town of Waveland, Hancock county, Mississippi, be, and is hereby authorized and empowered to issue and sell public improvement bonds in the sum of two hundred twenty five thousand dollars ($225,000.00) or so much thereof as may

be necessary, at a rate of interest not exceeding six per cent per annum, for the purpose of constructing sea walls or other beach protection, and may issue said bonds even though the amount thereof including outstanding bonds may exceed the limitation fixed by general laws of the state or town.

Betterment tax to be levied to pay principal and interest on bonds.

Sec. 2. That the said town of Waveland be, and is hereby authorized and empowered to fix a betterment assessment and levy a betterment tax against all property benefited as provided by the charter of said town and its amendments. The proceeds of said betterment tax shall be placed in a sinking fund and used to pay the principal and interest on said bonds.

Advalorem tax may be levied.

Sec. 3. That said town of Waveland be, and is hereby authorized and empowered to levy and collect an advalorem tax on all of the taxable property in said town not exceeding six mills on the dollar, to pay the town's pro rata share or betterment assessment made against said town for the cost or betterment of the beach protection at the head or intersection of its streets on the beach, and for and including the additional purpose, in the discretion of the board of mayor and aldermen, of making up and paying any deficiency in the funds necessary to pay the principal and interest of said bonds, if any.

Issuance of bonds to be submitted to qualified electors.

Sec. 4. The issuance of said bonds shall first be submitted to an election and approved by a majority of the qualified electors of said town' voting in an election held for that purpose, in the manner provided for by the general election laws of the town and state.

Sec. 5. That this act take effect and be in force from and after its passage.

CHAPTER 427.

HOUSE BILL No. 122.

AN ACT authorizing the town of Waveland, Hancock county, Mississippi, to issue public improvement bonds in the sum of thirty five thousand dollars ($35,000.00), or so much thereof as may be necessary for the purpose of surfacing and draining the front of beach road and to levy a tax to pay said bonds and interest.

Waveland may issue public improvement bonds.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the town of Waveland, Hancock county, Mississippi, be, and is hereby authorized and empowered to issue and
