There are many classes of agreements with foreign countries which are not required to be formulated as treaties.

Section 802 of the Civil Aeronautics Act of 1938 (52 Stat. 973) clearly anticipates the making of agreements with foreign countries concerning civil aviation.

The jurisdiction of the Civil Aeronatutics Board in connection with the granting of permits is not affected by any of the civil aviation agreements which have been concluded, and the Board must still pass upon the qualifications of applicants. However, the Board must act within the broad policy declared in the agreements. 40:451
