The Secretary of the Air Force may establish or develop classified military installations and facilities by acquiring, constructing, converting, rehabilitating, or installing permanent or temporary public works, including land acquisition, site preparation, appurtenances, utilities, and equipment as follows: (a) Ballistic missiles, $165,900,000. (b) Strategic missiles, $29,600,000. (c) Defense missiles, $122,000,000. SEC. 303. The Secretary of the Air Force may establish or develop Air Force installations and facilities by proceeding with construction made necessary by changes in Air Force missions, new weapons developments, new and unforeseen research and development requirements, or improved production schedules, if the Secretary of Defense determines that deferral of such construction for inclusion in the next military construction authorization Act would be inconsistent with interests of national security, and in connection therewith to acquire, construct, convert, rehabilitate, or install permanent or temporary public works, including land acquisition, site preparation, appurtenances, utilities, and equipment, in the total amount of $25,000,000: Provided, That the Secretary of the Air Force, or his designee, shall notify the Committees on Armed Services of the Senate and House of Representatives immediately upon reaching a final decision to implement, of the cost of construction of any public work undertaken under this section, including those real estate actions pertaining thereto. TITLE IV SEC. 401. The Secretary of Defense may establish or develop installations and facilities required for advanced research projects and in connection therewith may acquire, construct, convert, rehabilitate, or install permanent or temporary public works, including land acquisition, site preparation, appurtenances, utilities and equipment, in the total amount of $50,000,000. TITLE V GENERAL PROVISIONS SEC. 501. The Secretary of Defense and the Secretary of each military department may proceed to establish or develop installations and facilities under this Act without regard to sections 3648 and 3734 of the Revised Statutes, as amended (31 U. S. C. 529, 40 U. S. C. 259, 267), and sections 4774 (d) and 9774 (d) of title 10, United States Code. The authority to place permanent or temporary improvements on land includes authority for surveys, administration, overhead, planning, and supervision incident to construction. That authority may be exercised before title to the land is approved under section 355 of the Revised Statutes, as amended (40 U. S. C. 255), and even though the land is held temporarily. The authority to acquire real estate or land includes authority to make surveys and to acquire land, and interests in land (including temporary use), by gift, purchase, exchange of Government-owned land, or otherwise. SEC. 502. There are authorized to be appropriated such sums as may be necessary for the purposes of this Act, but appropriations, for public works projects authorized by titles I, II, III, and IV shall not exceed― (1) for title I: Inside the United States, $111,491,000; outside the United States, $9,416,000; section 102, $201,121,000; section 103, $25,000,000; or a total of $347,028,000. (2) for title II: Inside the United States, $194,677,000; outside the United States, $16,384,000; section 202, $65,001,000; section 203, $25,000,000; or a total of $301,062,000. (3) for title III: Inside the United States, $525,101,000; outside the United States, $118,670,000; section 302, $317,500,000; section 303, $25,000,000; or a total of $986,271,000. (4) for title IV: $50,000,000. SEC. 503. Any of the amounts named in titles I, II and III of this Act may, in the discretion of the Secretary concerned, be increased by 5 per centum for projects inside the United States and by 10 per centum for projects outside the United States. However, the total cost of all projects in each such title may not be more than the total amount authorized to be appropriated for projects in that title. SEC. 504. Any outstanding authority heretofore provided by the Act of September 1, 1954 (68 Stat. 1119), the Act of July 15, 1955 (69 Stat. 324), and the Act of August 3, 1956 (70 Stat. 991), for the provision of family housing shall be available for the construction of family housing at any installations for which appropriated fund family housing is authorized to be constructed under titles I and III of this Act. SEC. 505. Whenever (1) the President determines that compliance with section 2313 (b) of title 10, United States Code, for contracts made under this Act for the establishment or development of military installations and facilities in foreign countries would interfere with the carrying out of this Act; and (2) the Secretary of Defense and the Comptroller General have agreed upon alternative methods of adequately auditing those contracts; the President may exempt those contracts from the requirements of that section. SEC. 506. Contracts made by the United States under this Act shall be awarded, insofar as practicable, on a competitive basis to the lowest responsible bidder, if the national security will not be impaired and the award is consistent with chapter 137 of title 10, United States Code, and section 15 of the Act of August 9, 1955 (69 Stat. 547, 551). The Secretaries of the military departments shall report semiannually to the President of the Senate and the Speaker of the House of Representatives with respect to all contracts awarded on other than a competitive basis to the lowest responsible bidder. |
