These 10 new members of the National Petroleum Council are entirely from the oil industry and many of them are from the largest companies in the oil industry. The total membership would indicate a very strong imbalance and direction toward the big oil companies rather than having a balanced point of view that is referred to in the act. My only point is, did Mr. Hawley know about these appointments and this imbalance? This is an example, does he know every day those agencies which are putting new members on, or creating new committees? I see Mr. Hawley is shaking his head no. I suggest that the record so indicate. Mr. MALEK. Let me amplify on that. I think it would be inadvisable for us to require a clearance of everyone appointed to a committee so that we could audit it for proper balance. I think that really is a function of the head of the agency. We lay down the guidelines. We say to the agency head, these are the guidelines, this is the policy, you are expected to follow this. We would like on a periodic basis to look at what you have done to determine if the policy is adequately being followed. We would hope that you would take the steps to insure that it is. I think that is really the appropriate role of the Executive Office of the President. We can't in every case prevent departures from the thrust of the act. We can lay down the guidelines. We can check periodically and when those checks indicate that the act isn't being followed appropriately, then we can work with the agency to take the steps that will lead to compliance in the future. Mr. TURNER. But you really have no mechanism for being able to find out in any day what agency is in fact violating the act with respect to membership, with respect to meetings, with respect to notices, or any other requirement. There is no way you can do that with 112 people in OMB. I don't see with the amount of people you have working, and I doubt if those that you submit to us will give us any guidance in this regard, any way in which your office can know on any day what agencies are violating the act and what agencies are following the act to the letter. Mr. MALEK. That is correct. But I will submit that it is not appropriate for the Executive Office of the President to monitor agency activities on a day to day basis. We should lay down the policies, we should lay down the guidelines and we should have some means of periodic and systematic followup to insure that the guidelines are being followed. But I don't think it is practical in this instance or in many other instances to follow on a daily basis to the detail that you suggest all of the activities of these agencies. Mr. TURNER. We have 90 pages of a draft OMB circular, A-63. In my 23 years of Government experience, I don't believe I have ever seen 90 pages of an OMB circular, although there may have been one along the line that I missed. But it is a pretty big circular. My first question is do you intend to issue this draft in such large volume of pages and rhetoric as an OMB circular or do you intend to cut it down to a more meaningful set of guidelines for the use of the agency? Mr. MALEK. We would hope to reduce its size somewhat before it is submitted to the agencies. Would you like to elaborate on that? Mr. HAWLEY. We are going to reduce the document substantially, Mr. Turner. You will recall an earlier discussion we had principally concerning not the words themselves so much, or the content, as in |
