AN ACT to exempt Trustees of the Poor from serving on juries.

SECTION 1. Be it enacted by the Legislature of the state Trustees of Mississippi, That the trustees of the poor of each and exempt every county of this state, be and they are hereby exempted from jury from serving on juries.

AN ACT to change the name of the Commercial Bank of Natchez, and for other purposes.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That so much of the first section of the act Repeal. entitled an act to establish the Commercial Bank of Natchez, passed on the twenty-fifth day of February, eighteen hun dred and thirty-six, as requires that all of the stock in said bank subscribed for on the first opening of the books, shall be called for and paid in within fifteen months from the time said bank commences business, and for such subscription as may be made subsequent to the commencement of business shall be all paid in within fifteen months from the time of subscription, be and the same is hereby repealed; and that the directors of said bank be authorized to call for the balance due on the stock subscribed for, in such instalments and at such times as they may deem expedient.

SEC. 2. Be it further enacted, That from and after the first day of November next, the style and corporate name of Name said institution shall be, and the same is hereby changed, changed.

SEC. 3. And be it further enacted, That all power, rights and privileges conferred on the said Commercial Bank of Natchez, by the charter thereof, shall be held, used and enjoyed by the said Bank of Natchez, to all intents and purposes as though the name had not been changed.

SEC. 4. Be it further enacted, That so soon as the presiDirectors of dent, directors and company shall accept of this act, as an amendment to the act to establish the Commercial Bank of Natchez, they shall appoint seven directors for the bank, at Canton, Madison county, a majority of them shall be planters, which board of directors shall have exclusive control of that part of the capital stock allotted said bank.

AN ACT to incorporate the Liberty Rail Road Company.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That for the purpose of running a rail road from the town of Liberty, in Amite county, in a southeastern direction to some point on the Louisiana state line, or to any other point upon the New Orleans and Nashville Rail Road, to be selected by the company, that V. T. Crawford, David Lea, E. Carroll, C. W. Caulfield, E. Smith, Jehu Wall, and E. M. Davis be, and they are hereby appointed commissioners under the direction of whom subscriptions may be received to the capital stock of the Liberty rail road company hereby incorporated, and they or a majority of them may cause books of subscription to be opened, as is provided for by the charter incorporating the Mississippi rail road company, approved February twenty-sixth, one thousand eight hundred and

thirty-six, and the said charter above referred to be, and the same is hereby adopted as the charter of the Liberty rail road company, in all respects not herein otherwise provided for, so far as the same may be applicable; and the said Liberty rail road company shall have, exercise, and enjoy all the rights, privileges and immunities, which the said Mississippi rail road company are entitled to by the aforesaid act: Provided, that banking privileges shall not be conferred on said company by this act.

SEC. 2. Be it further enacted, That the capital stock of the said Liberty rail road company shall not exceed five Capital hundred thousand dollars, and as soon as the sum of two hundred thousand dollars shall have been subscribed for, the said company may commence operations.

AN ACT to authorize the assessor and collector of taxes of Jones county, to perform certain duties therein named, and for other

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That the present assessor and collector of May collect taxes for the county of Jones be, and he is hereby autho- former rized and required to collect so much of the taxes due from the citizens of said county, as remain unpaid for the year eighteen hundred and thirty-five, and to assess and collect the taxes for the year eighteen hundred and thirtysix, in said county, and make return thereof in like manner, and at the same time that he is required to make his annual return for the year eighteen hundred and thirty

SEC. 4. Be it further enacted, That in the event of the In case of death, resignation or removal from office of the present assessor and collector of taxes, for the said county of Jones, before the performance of the duties herein enjoined upon him, it shall be the duty of his successor to do and perform the duties imposed by the several sections of this act.

SEC. 5. Be it further enacted, That the said assessor and collector, before he enters upon the duties prescribed by this act, shall make and execute to the board of police of Jones county, a bond with such security and with such provisions as in the judgment of said board will secure the faithful performance of said duties.

SEC. 6. Be it further enacted, That this act shall take effect and be in force from the date of its passage. Approved, May 13, 1837.

AN ACT amendatory of an act, entitled an act to reduce into one, the several acts and parts of acts, concerning the establishment, jurisdiction and powers of the superior courts of law, passed June 28th, A. D. 1822.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That so much of the one hundred and sixteenth section of the act aforesaid, as relates to the manner of taking depositions, which requires the parties to serve a copy of the interrogations, filed with a notice of the day upon which such commission, as provided in said act, shall issue, be, and the same are hereby repealed.

SEC. 2. Be it further enacted, That it shall hereafter be the duty of the sheriff, coroner, and constables of each and

every county in this state, whenever required by either certain party, their agent or attorney, or the clerks of the several officers. courts of law, to serve a copy of the interrogations or notice, or both, upon either party or their attorney; or by leaving a copy thereof at the usual place of abode of such party, in any cause which is now pending, or which may hereafter be depending in the several courts of law and chancery of this state, to execute and return the same, as other duties appertaining to their respective offices; for which service, they shall be entitled to demand and receive the fees now allowed by law for the service, and return of a writ of capias ad respondendum, and the same shall be charged to the bill of costs, as in cases of original process.

SEC. 3. Be it further enacted, That by the authority aforesaid, that all returns made by the several sheriffs, Returns coroners, or constables of the several counties of this state, evidence. pursuant to the foregoing provisions of this act, shall be prima facie evidence of the fact.

SEC. 4. Be it further enacted, That this act shall be in To take force and take effect, from and after its passage; and that effect. all acts and parts of acts, contravening the provisions of this act, be, and the same are hereby repealed.

AN ACT supplemental to an act, entitled an act to establish the
Agricultural Bank of Mississippi.

SECTION 1. Be it enacted by the Legislature of the state of Mississippi, That the Agricultural bank in said state, Branch at may, if it deem it expedient, establish a branch of said Franklin. bank in the town of Franklin, in the county of Holmes, with a capital of five hundred thousand dollars; which branch bank, shall be subject to the same rules and regulations, as are provided for other branches of said bank. SEC. 2. Be it further enacted, That for this purpose, the capital stock of said bank may be increased five hundred Capital thousand dollars; for the taking of which capital stock, increased. books shall be opened in the city of Natchez, and at such
