AN ACT to incorporate the male and female Pinckney Academy.

SECTION 1. Be it enacted by the Legislature of the state Corpora- of Mississippi, That Michael Thomas, G. W. Boyd, P. L. Redwine, J. D. Windham, James Hutson, W. A. Lane, and A. J. Windham, be, and they are hereby constituted a body corporate and politic, by the name and style of the President and Trustees of the Pinckney male and female Academy; and by that name, they and their successors, shall be capable of sueing and being sued, pleading and being impleaded, in all actions, suits, plaints, matters, and causes, whatsoever; and they and their successors, may have a common seal, and alter the same at their pleasure; and shall be capable of receiving and acquiring real and personal estate, by donation or purchase, for the benefit of said institution; and they and their successors, may make such by-laws, as they may deem expedient, for the election of their officers; for the election and admission of new members of said corporation; for the government and management of the affairs of said institution; and for promoting of morality, virtue, and learning among the students; and finally, may do and perform all other acts for the benefit of said institution, which are incident to bodies corporate, not repugnant to the constitution and laws of the United States, or of this state.

SEC. 2. Be it further enacted, That said trustees shall annually elect out of their own members, a president, secretary, and treasurer, who shall severally perform the duties to be prescribed by the said president and trustees.

SEC. 3. Be it further enacted, That the first meeting of said board of trustees, shall be at the town of Pinckney, on meeting of the first Monday in July next; and if a majority of said trustees fail to meet at that time, any three of said trustees may call a meeting by advertisement, one week previous to the time of said meeting.

Quorum.

SEC. 4. Be it further enacted, That said board of trustees shall hold regular meetings twice in each year; but the president and two trustees, shall have power to call a meeting of the trustees whenever they may deem it expedient. A majority of said board shall constitute a quorum

AN ACT to incorporate the Trustees of the Mount Carmel Male and Female Academy.

SECTION 1. Be it enacted by the Legislature of the state Corpora- of Mississippi, That Samuel Hemphill, Duncan Wilkinson, Major Newton, William Loftin, Francis A. Martin, Needham Blount, John Gartman, Samuel Evans, John P. Jones, Frederick Pope, Duncan McLaran, and E. S. Ragan, be, and they are hereby created a body corporate, to be known by the name and style of the board of trustees of Mount Carmel Male and Female Academy; and made capable by this name, of receiving by donation, purchase, mortgage, or otherwise, real estate to any amount, not exceeding five thousand dollars, and personal estate to any amount, not exceeding three thousand dollars, for the benefit of said institution; of sueing and being sued, of pleading and being impleaded, in all manner of actions, in any court of law or equity; and of doing all other acts incident to bodies corporate; and shall have power to appoint a president and other officers, and assign to each their respective duties; to fill all vacancies that may occur in their body, by death, resignation, or otherwise; to employ such professors and teachers as may be necessary for conducting the literary concerns of said academy, and promotion of learning and morality among the students, and other purposes. They shall have power to make all by-laws and rules for the good government of the academy; for the regulation and government of their officers and members; and may enact all such by-laws as may conduce to the benefit of said institution and orderly conducting the same, which are not repugnant to the constitution and laws of this state or of the United States.

SEC. 2. Be it further enacted, That the first meeting of said board, shall be held at Mount Carmel, in Covington county, on the first Monday in July next; and if a majority

of said trustees shall fail to meet at that time, any two of them may call a meeting, by advertising such call, giving at least ten days previous notice, in two or more public places in the county, of the time and place of such meeting; and may renew such call, until a quorum thereof shall meet, and at such other times as the said board may direct. The president shall have power to call a meeting at any time, by giving at least five days notice thereof. In case of the absence of the president at any meeting of said board, any member may be called to the chair, as president, pro tempore; and said board shall have power to remove any of its officers, for mal-conduct in office.

shall be allowed the sum of two dollars for each and every day he shall attend in any of the said courts, and each grand juror shall be allowed the same compensation as is allowed petit jurors; the compensation of each to be paid in the manner now prescribed by law.

SEC. 2. Be it further enacted, That each witness summoned to attend any court within this state, shall be allowed the sum of two dollars for each and every day he shall attend in any of said courts, and the same rate of mileage now allowed, as a witness, to be taxed, and paid in the manner now prescribed by law.

SEC. 3. Be it further enacted, That all acts and parts of acts inconsistent with the provisions of this act, are hereby repealed.

SEC. 4. Be it further enacted, That this act shall be in force from and after its passage.

SEC. 5. Be it further enacted, That the provisions of this act shall not apply to witnesses and jurors attending before justices of the peace, but such witnesses and jurors shall be allowed the sum of one dollar and fifty cents per diem. Approved, May 13, 1837.

AN ACT to amend an act to provide for the erection of Levees in the county of Washington, approved, March 2, 1833.

SECTION 1. Be it enacted by the Legislature of the state Provisions of Mississippi, That the provisions of the act entitled an act to provide for the erection of levees in the county of Washington, approved March 2, 1833, be, and they are hereby extended to the counties of Bolivar, Coahoma, Tunica, and De Soto: Provided, however, that the boards of police of said counties be, and they are hereby authorized to lay off their respective counties into not less than two, nor more than five districts, as they may deem best calculated to effect the object of this act.

SEC. 2. Be it further enacted, That this act shall be in force from and after its passage.
