§ 1001.801-2 Area trends in employment and unemployment.

"Area Trends in Employment and Unemployment," which establishes the boundaries of each labor market area and lists communities included in each area, is distributed by the Department of Labor directly to AF purchasing activities. Hq AFLC (MCP-5) and HQ AFSC (SCK-4) will periodically assure that distribution is adequate and that the contents of the publication are fully understood and correctly used by cognizant personnel.

§ 1001.803 Application of policy.

A copy of each PR with an estimated value of $300,000 or more will be forwarded by the director of procurement and production at AFLC AMAS, the chief, procurement and production office at AFSC divisions or the deputy for procurement at AFSC centers direct to SAF-IL (Special Assistant for Economic Utilization Policy) Room 4D-865, Pentagon, Washington, D.C., 20330, with a cover letter describing the kind of procurement action contemplated (i.e., competitive, sole source follow-on, etc.); and a statement as to whether a partial setaside for labor surplus area concerns will be applied (§ 1.804 of this title) and if not, why not. Covering letter are not required for R&D procurements, but a copy of the PR will be marked "R&D" in large red print and forwarded to SAF-IL. If procurement action is to be taken by an activity other than the one which forwards the PR to SAF-IL, that fact should be indicated in the covering letter, and the procuring activity identified. The activity that will take the procure

ment action is then responsible for furnishing the foregoing information to SAF-IL. The PRS and the covering letter will be forwarded to SAF-IL at least 10 work days prior to any Source Selection Board or other action leading to source selection to permit SAF-IL sufficient time to make any labor surplus area recommendations deemed necessary. § 1001.804-1 General.

§ 1001.1002 Dissemination of information relating to invitations for bids and requests for proposals.

In addition to the requirements of §§ 1.1002 and 2.203 of this title:

(a) AFLC/AFSC central procurement activities will mail or otherwise provide one copy of each unclassified synopsized (§ 1.1003 of this title) Invitation for Bids and Request for Proposals to each Small Business office of the following activities for use in furnishing information to potential bidders, to firms interested in subcontracting opportunities and for public display or other management uses. (b) Central procurement activities other than AFLC and AFSC, and Base Procurement Activities (Air Force-wide) will distribute one copy of each unclassified synopsized Invitation for Bids and Request for Proposals to the DCASR office listed in paragraph (a) of this section which is located in, or closest to, that trade area which the procurement activity conducts the majority of its business.

(c) Upon request, or if required by other directives, additional distribution may be made, on an individual or recurring basis, to any Small Business Administration Regional Office or any other Government office including AFSC divisions, AFLC AMAs, or a DCASD office.

§ 1001.1002-6 Paid advertisements in newspapers and trade journals.

(a) through (b) No implementation. (c) General. Paid advertisements in newspapers, in connection with the disposition of disposable property by sale, will be used according to paragraph 4, Chapter II, Volume VI, AFM 67-1 (USAF Supply Manual).

(d) No implementation.

(e) Authority and delegation. Authority to approve the publication of paid advertisements for proposed procurements or surplus sales has been delegated by the Secretary to:

The above authority will not be redelegated. Use of paid advertisements will be according to paragraph 7, section 3131, AFM 40-1 (Air Force Civilian Personnel Manual).

(f) (1) Not implemented.

(2) Requests for authority to place advertisements for the purpose of recruiting civilian employees will be submitted to the official named in paragraph (e) (2) of this section for approval.

§ 1001.1003-9 Preparation and transmittal.

§ 1001.1005–1 Synopsis of contract awards.

§ 1001.1007-2 Application.

Responsibility for approval of public releases is assigned as follows:

(a) Deputy Chief of Staff and Assistant Deputy Chief of Staff, Procurement and Production, HQ AFSC.

(b) Commanders of AFSC divisions, centers or ranges, with authority for redelegation no lower than the chief, procurement and production.

(c) Director and Deputy Director of Procurement and Production, HQ AFLC.

(d) Commanders of AFLC AMAS with authority for redelegation to the director of procurement and production. The responsibility is limited to estimates of supplies and services for which the AMA has been assigned procurement responsibility.

(e) Commanders of major commands other than AFSC/AFLC with authority for redelegation.

§ 1001.1007-3 Conditions.

(a) through (h) No implementation. (i) Responsibility for the determination of the need for, and the preparation of, public announcements is the same As the assignments in § 1001.1007-2.

Subpart K-Qualified Products

§ 1001.1103

Justification for inclusion of qualification requirements. The Directorate of Maintenance Engineering (MCMC), AFLC, and the Directorate of Systems Policy (SCSV), Hq AFSC, are the control points for coordination within their respective commands of the justification for inclusion of qualification requirement in specifications. Command approval of the justification will be forwarded to Hq USAF (AFSPPE) for final approval. The conditions of § 1.1103 (a) of this title, concerning time required for testing will not be a basis for justification unless the time required to perform any one test exceeds 45 calendar days. Any series of two or more tests that must be performed in sequence will be considered as one test for the purpose of this condition. § 1001.1105 Opportunity for qualification.

A copy of the notice will be forwarded to Hq USAF (AFSPPE).

(a) Specifications and purchase descriptions will be prepared with the presumption that the method of procurement will be advertising. The question whether specifications or purchase descriptions are unduly restrictive of competition goes to the essence of the contract and in the event of protest is subject to review by the General Accounting Office. (See § 1002.407-9 of this chapter.) However, in stating the actual minimum needs of the Government, specifications or purchase descriptions used for advertised procurements will not be unduly restrictive of competition if the product or equipment of one or more manufacturer does not meet these minimum requirements.

(b) Specifications must be carefully reviewed by contracting officer to assure that they are sufficiently specific to state positively the requirements of the IFB or RFP. If options exist as to types or grades of material, method of inspection, number or types of samples, test requirements, etc., the IFB or RFP must state specifically the basis upon which bids are to be submitted. Where approval requirements (preproduction sample approval, process or manufacturing specification approval, etc.) are contained in the specifications, the IFB or RFP will contain a delivery schedule reflecting such requirements.

Mandatory specifications. Specifications or purchase descriptions are not required for spare parts, components, or materials required for existing stocks of material or for maintenance and operation of established installations, provided the item description used includes the sources' part number or drawing number and refers to the model designation and manufacturer's name and address of the equipment with which the item is to be used. The above items will be considered for formal advertising under the conditions described herein only when the items to be procured are predominantly commercial type items and two or more sources of supply are available for competition. If these latter conditions prevail, and it is necessary to describe the item to be procured in terms of a particular manu

facturer's product, the description in IFB or RFP must also include the words "or equal."

§ 1001.1206 Purchase descriptions. [28 F.R. 2272, Mar. 8, 1963]

§ 1001.1206-1 General.

(a) When a purchase description is authorized in lieu of a specification (see § 1.1202(b) of this title) it should be written in such a manner as to clearly describe the essential physical and functional characteristics of the item being procured. As many of the following characteristics as are necessary to express the minimum requirements of the Government should be utilized in setting forth the purchase description: (1) Kind of material.

(2) Electrical data, if any.
(3) Dimensions.

(4) Principles of operation.

(5) Restrictive or significant environmental conditions.

(6) If part of an assembly, the loca

tion within the assembly.

(7) Essential operating conditions. (8) Special features, if any.

(9) Intended use.

(10) Operation to be performed.

(11) Equipment with which the item is to be used.

(12) Other requirements, as appropriate.

§ 1001.1206-2 Brand name or equal purchase descriptions.

(a) No implementation.

(b) Unless the identification of a requirement by use of a brand name (identifiable by a part number or model number) followed by the words "or equal" is so well known to the trade or industry, that there is no doubt that all bidders will recognize the item(s) desired, then brand name or equal purchase descriptions should also include those characteristics referenced in § 1001.1206-1(a) (1) through (12) as considered necessary to clearly identify the needs of the Government.

§ 1001.1206-3

Invitation for bids— "Brand Name or Equal" purchase descriptions.

(a) No implementation.

(1) If the shipment does not qualify for a GBL, the following will be included in the written solicitation or discussed in the oral solicitation:

Shipping instructions will be contained in the order issued by the Government. Please furnish the following:

Shipment may be made by U.S. Postal Service. Request U.S. Government mailing indicia be furnished with the order.

Shipment cannot be made by parcel post. Request order authorize shipment by prepaid freight with charges billed as a separate item on the invoice.

The information requested may be changed to meet the needs of specific purchase actions such as pick up by Government vehicle or prepaid parcel post with charges to be shown as a separate item on invoice.

(2) The order or contract will contain one of the following provisions:

(i) When shipment will be by postal service.

Ship by U.S. Postal Service. U.S. Government mailing indicia is attached which requires no postage.

(ii) For shipments other than postal service.

Ship by prepaid freight and bill charges as a separate item on invoice. Copy of paid freight bill or commercial bill of lading marked Prepaid will be attached to invoice. Ship via -1/---------- most eco

nomical method.

(b) Other purchases. The clauses in §§ 1007.4004 and 1007.4050 of this subchapter will be used according to the instructions contained therein. If base procurement activities do not desire to use these clauses, an appropriate provision will be included in the contract schedule. When a purchase in excess of $2,500 does not justify the issuance of a GBL, the procedures in paragraph (a) of this section may be used. The contracting officer will obtain the advice of a transportation officer if necessary. When the clause in § 1007.4004 of this subchapter is used, the following will appear in the schedule:

1(Use appropriate statement.) The statement may be amended to cover specific purchases such as furnishing addresses of destinations subsequent to issuance of order, or pick up by government vehicle.

§ 1001.1306 Consignment and marking instructions.

(a) All information on shipping addresses (except on GFAE and GFAE-type items) that is supplied with a purchase request (PR), a military interdepartmental purchase request (MIPR), or other document serving as an authorization for procurement, will be incorporated verbatim into the original or amended shipping instruction provisions of the resulting contract.

(b) Shipping instructions for GFAE and GFAE-type items will not be incorporated in the contract, but all information on shipping addresses will be incorporated in the shipping instruction verbatim from the AFPI Form 44, Request for Issuance of Shipping Instructions, that is processed according to §§ 1054.1503 and 1054.1505 of this subchapter.

(c) The contract, purchase order, or delivery order number will be made a part of each shipping address as shown in the example below. This will expedite identification of shipments received by a consignee:
