§ 701.32 Locations at which Department of the Navy records are available for public inspection.

Type of Material

An index system by subject matter to materials held. For example:

(1) Department of the Navy directives issuance system consolidated subject index of unclassified instructions (an index of administrative unclassified instructions issued by Washington headquarters organizations and distributed to addressees outside the originating office); and the Marine Corps directives system quarterly checklist of directives distributed outside Headquarters, Marine Corps. These indexes assist in identifying instructions issued on any desired subject.

(2) An index to the armed services procurement regulation and to

Navy procurement directives. (3) Any other indexes prepared pursuant to this instruction and a master list of available indexes. Published and unpublished decisions of Boards of Review and Military Courts of Review created under the Uniform Code of Military Justice. (Published decisions are available also at naval bases, as indicated below.)

Certain technical manuals, and indexes thereto, as made available under clearance procedures prescribed by sponsoring naval systems commands or as specified in contract documents.

Marine

Corps indexes, directives (orders and bulletins), and publications of general Marine Corps applicability.

To the extent the material described above is received by Navy and Marine Corps field activities ashore, for the regular conduct of their business, it will be made available locally to members of the public, for inspection and copying, under procedures prescribed by this instruction, during regular working hours. Current files of Department of the Navy directives of general applicability, and related indexes; also, directives of less than general applicability pertinent to their operations, and related indexes.

Technical manuals and data at field activities will be available as indicated in procurement documents. In some instances they will be made available under clearance procedures prescribed by the sponsoring naval systems command. Published decisions of the Boards of Review and Military Courts of Review created under the Uniform Code of Military Justice can be found in "Courts-Martial Reports" maintained by these bases.

Computer service charges will be based on actual computer configuration used and be based on direct costs only of the central processing unit plus input/output devices plus memory capacity.

(c) Fxceptions. (1) In general, charges may be waived when:

(a) the recipient of the benefits is engaged in a nonprofit activity designed for public safety, health or welfare;

(b) payment of the full costs or fee by a state, local government or nonprofit group would not be in the interest of the program;

(c) the incremental cost of collecting the fees would be an unduly large part of the receipts from the activity.

(2) A refusal to waive charges by the official responsible for the initial decision on the request for the record may be appealed to the head of the DoD

Component or his designee for purposes of final approval.

(d) Collections. (1) Normally, collection of charges and fees will be made in advance of rendering the service. In some instances, it may be more practical to collect charges and fees at the time of conveying the service or property to the recipient, but only in those instances where the request specifically states that whatever cost involved will be acceptable or acceptable up to a specified limit that covers anticipated costs. Absent such an agreement to pay required anticipated costs, the time for responding to a request begins to run upon receipt of payment. (2) Collection of scheduled fees and charges will normally be deposited to Miscellaneous Receipts of the Trea

sury.

(3) Search fees are assessable even when no records responsive to the request, or no records not exempt from disclosure are found, provided the requestor is advised of the requirement at the time the estimated charges are presented to the requestor for approval.

Subpart E-Indexing, Public Inspection, and Federal Register Publication of Department of the Navy Directives and Other Documents Affecting the Public

§ 701.51 Purpose.

This subpart implements 5 U.S.C. 552 (a) (1) and (2) and provisions of Department of Defense Directive 5400.7, February 14, 1975, (32 CFR Part 286, 40 FR 8190), Department of Defense Directive 5400.9, December 23, 1974, (32 CFR Part 296, 40 FR 4911), and Regulations of the Administrative Committee of the FEDERAL REGISTER (1 CFR chs. I and II) by delineating responsibilities and prescribing requirements, policies, criteria, and procedures applicable to:

(a) Publishing the following Department of the Navy documents in the FEDERAL REGISTER:

(1) Certain classes of regulatory, organizational, policy, substantive, and procedural documents required to be

so published for the guidance of the public;

(2) Certain classes of proposed regulatory documents required to be so published for public comment prior to issuance; and

(3) Certain public notices required by laws or regulations to be so published;

(b) Making available, for public inspection and copying, certain other classes of documents having precedential effect for decisions concerning members of the public;

(c) Maintaining current indexes of documents having precedential effect for decisions concerning members of the public, and publishing such indexes or making them available by other means; and

(d) Receiving and considering petitions of members of the public for the issuance, revision, or cancellation of regulatory documents of some classes.

§ 701.52 Scope and applicability.

This subpart prescribes actions to be executed by, or at the direction of, components of the Navy Department [as defined in § 700.104(c) of this chapter] and specified headquarters activities for apprising members of the public of the existence and terms of Department of the Navy regulations, policies, and substantive and procedural rules and decisions which may affect them, and for enabling members of the public to participate in Department of the Navy rulemaking processes in matters of substantial and direct concern to the public. The fact that a document may be published or indexed and made available for public inspection and copying under this subpart does not affect the possible requirement under Subpart A for producing it for examination, or furnishing a copy, in response to a request made under that subpart.

§ 701.53 [Reserved]

§ 701.54 Policy.

In accordance with the spirit and intent of 5 U.S.C. 552, it is the right of the public to have the maximum information concerning the organization and functions of the Department of the Navy and the policies and substan

tive and procedural rules by which those functions are performed in relation to the public. In accordance with Department of Defense Directive 5400.9 (32 CFR Part 296, 40 FR 4911), moreover, the public is encouraged to participate to the maximum practicable extent in Department of the Navy rulemaking which has a substantial and direct impact upon the public. § 701.55 Responsibilities.

(a) All "Navy Department" components. The head of each Navy Department component [as defined in §700.104(c)], the commander of each naval systems command, and the Commander, Military Sealift Command, are primarily responsible for ensuring:

(1) The prompt publication of those directives and other documents under their cognizance (and revisions and cancellations thereof) of the classes required under $701.56, to be published in the FEDERAL REGISTER for the guidance of the public; evaluating proposed directives of those classes (including proposed revisions of adopted directives of those classes) for possible publication in the FEDERAL REGISTER for public comment prior to issuance, in accordance with § 701.57, and for receiving and considering public comment prior to preparing such documents in final form for issuance;

(2) The timely publication of such notices or other documents pertaining to matters under their cognizance as may be required to be published in the FEDERAL REGISTER under other applicable laws or regulations;

(3) The continual availability, for public inspection and copying, of those documents under their cognizance having precedential effect with regard to decisions affecting the public, as prescribed in § 701.59; and, subject to § 701.55(b), the maintenance, availability, and publication of current indexes of such documents; and

(4) The full and prompt consideration of petitions of interested persons for the issuance, revision, or cancellation of directives under their cognizance, in accordance with § 701.58.

(b) Chief of Naval Operations and Commandant of the Marine Corps. In addition to such responsibilities as may be applicable under §701.55(a),
