that said capital stock of one million and fifty thousand dollars at said branches may be reduced by receiving it in discharge of such debts and upon such terms as the said board of directors of said bank may deem best for the interest of said bank. To keep Sec. 3. Be it further enacted, That the said Commercial Bank of Natchez, shall ap- agencies. point and keep an agent at each of the places from which the branches are withdrawn by this act, with full power and authority under instructions of the board of directors of said bank, to make renewals, and to do and perform all other business in settling up and liquidating the affairs of the said several branches. AN ACT entitled "an act for the relief of certain SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the tax collectors of the counties of Hinds and Pike, be allowed until the first day of June next to make their returns to the auditor of public accounts, for the state tax of their respective counties, due the first day of March next. Sec. 2. And be it further enacted, That this act shall be in force from and after its passage. Approved, February 1st, 1841. 1 CHAPTER 94. AN ACT for the relief of McLin Evans, and for other purposes. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the board of police in the county of Washington be, and the same is hereby authorized and instructed to grant to McLin Evans of said county, a full and complete release from all obligations on account of the purchase by said Evans of lots No. one and two, of the school lands belonging to township No. fourteen, range No. eight west, in the county aforesaid. Sec. 2. Be it further enacted, That the said board of police are hereby authorized to make and require of said McLin Evans such condition for said release as they may deem just and equitable. Sec. 3. Be it further enacted, That full power and authority is hereby given to the board of trustees of school lands for section sixteen, township eleven, range thirteen east in Neshoba county, to rescind the sale of the same made by said board of trustees to William C. Wilkerson, by and with the consent of the said Wilkerson and the citizens of the township. Sec. 4. And be it further enacted, That this act shall take effect and be in force from and after its passage. Approved February 6th, 1841. CHAPTER 95. AN ACT to amend the sixteenth section of an act approved the 16th of February, : 838, entitled "an Act to amend an act to provide for the collection of levies in the county of Washington," passed March 2, 1833. of SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That when the certificate of the inspectors received according to the provisions of the sixteenth section of said act shall be presented to the section police court of said county and proved be-act of 18:36 fore some officer authorized to administer oaths to be just and correct, said certificate with the affidavit, &c. thereon, after being approved by said court, shall be entered on the records of the probate court of Washington county, and at any time within two years thereafter, the person receiving said certificate or his assigns, may place the same in the hands of the collectors of taxes of said county, whose duty it shall be to collect the same by the sale of the land or sufficient thereof, to pay the amount of said certificate ! and all costs and interests thereon be levied and executed in the manner now prescribed by law in relation to non-residents, &c., and subject to be redeemed within twelve months after said sale, upon the payment of fifty per cent. damages, and the deed when made, according to the provisions of said law, shall convey the right, title, and interest both in law and equity of all persons whatsoever, to the purchaser. March, Hugh A. Burr, David C. Richards, George R. McDaniel, Hardy Stephens, Moses Clime, R. C. Warne, B. J. Garvin, John Garvin, J. D. Montgomery, R. Profit, J. Newland, J. W. Foster, A. Thatcher, J. Blackwood, R. Blakely, E. Gregory and James Taylor and their associates and successors be and they are hereby incorporated under the name of the Columbus Fire Company, number one, that they and their successors shall have perpetual succession, may have a common seal and shall have power to purchase and hold property real and personal, to the amount of twenty thousand dohars, to sue and be sued, plead and be impleaded in their corporate name, and they shall have power to make all needful by-laws for their good government, so that the same be not contrary to the constitution of the United States, or of this state, and generally to do all such acts and things as pertain to such a body corporate. i Sec. 2.. Be it further enacted, That said company, as often as vacancies happen therein may fill the same by election to be made by their own body, and may elect additional members so that the whole number shall not exceed fifty at any one time. Sec. 3. Be it further enacted, And it is hereby declared as a condition of this charter, that the said company shall procure and keep a fire engine for the use of said company, hose for the conveyance of water, and, all necessary and useful apparatus for the extinguishment of fire. : Sec. 4. Be it further enacted, That the members of said company shall be and they are hereby exempted from working on the roads, from military and patrol duty except in time of war, insurrection, invasion, or public danger.
