and in the month of January of each and every year afterwards, divide the yearly profits arising from said section No. 16, into two parts, in proportion to the number of children or students allowed to each division, for the use of a school in each division, under the direction of said trustees: provided, that the sum allowed for the use of a school at any other place than on said section, shall be applied exclusively to the payment of tuition, and not to the erection of a school-house, or any other purpose, except as aforesaid: provided, also, that nothing but the yearly interest, rents, or profits of said section No. 16, shall be so divided and applied.

Sec. 3. And be it further enacted, That this act shall be in force and take effect from and after its passage.

CHAPTER 70.

AN ACT for the benefit of the Tax Collector of Warren county.

Whereas, It hath appeared to the satisfaction of the Legislature of the state of Mississippi, that Henry Fernandez, tax collector of the county of Warren, died in the commencement of the fall of 1840, and Mark H. Mayfield, his successor, was not elected until the 25th day of December, of the

same year, and that the said Mayfield did not receive the books of assessment until the 10th instant, Therefore

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the said Mark H. Mayfield, tax collector of the county of Warren, be allowed until the first day of June next, to make his return and settlement with the auditor of public accounts; and the said collector shall have until the first day of August next, to make return of the sale of property of non-residents.

Sec. 2. And be it further enacted, That this act shall be in force from and after its passage.

CHAPTER 71.

AN ACT to revive and further extend certain provisions of an act to authorize the stockholders of the Bank of the State of Mississippi, to close their affairs, with as much advantage to the public, and as little inconvenience to the individual stockholders as possible, approved December 19th, 1831.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That so much of an act entitled, "an act to authorize the stockholders of the bank of the state of Mississippi, to close their affairs with as much advantage to the public, and as little inconvenience to the individual stockholders as possi

ble, approved December 19th, 1831," as constituted and appointed the president, directors, and company of said bank, a body politic and corporate, for the purpose of collecting the debts due to it, be, and the same is hereby revived and continued in force, until the first day of January, 1844.

Sec. 2. Be it further enacted, That until the said first day of January, 1844, the said corporation shall have full power to prosecute to final judgment, all suits and actions, necessary for the recovery of debts due to it, prior to the 31st day of December, 1837, and to sue out and continue, all necessary legal process to enforce the payment of judgments, heretofore rendered in its favor.

Sec. 3. Be it further enacted, That the second, third and fourth sections of said recited act, be, and the same are hereby revived and continued in force until the said first day of January, 1844, but only for the objects specified in the two first sections of this act.

Sec. 4. And be it further enacted, That this act shall be in force and take effect from and after its passage.

CHAPTER 72.

AN ACT in reference to the Board of Police of the county of Smith.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That it shall not be lawful for the board of police of the county of Smith to hold more than one spe

cial term of its board in any one year, the ne special year to take date from the first day of January, 1841, unless a majority of the electors in any one police district shall petition the president of said board, to convene the same, in which event, it shall be lawful for said president to convene said board, to act upon the special matter called for by the petition of the electors.

Sec. 2. And be it further enacted, That this act shall be in force from and after its passage.

CHAPTER 73.

AN ACT to authorize Trustees of School Section Sixteen of Township No. 9, Range 6 East, in Copiah county, to rescind the sale thereof.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the trustees of the before recited school section,

are hereby empowered to cancel and rescind the sale of the same, or any part thereof, for sale under the restrictions provided by law.

Sec. 2. And be it further enacted, That this act shall be in force from and after its passage.

CHAPTER 74.

AN ACT for the benefit of the President, Directors and Company of the Commercial and Rail Road Bank of Vicksburg.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That upon the location of the depot of the rail road commercia of the president, directors and company of Road Banke the Commercial and Rail Road Bank of authorized Vicksburg upon any part of those lots which Depot on are designated on the plat of the city of public lote. Jackson as Court Green and Court Squares No. 1, and No. 2, by the assignees of the Commercial and Rail Road Bank of Vicksburg, there be, and is hereby granted to the said president, directors and company of the Commercial and Rail Road Bank of Vicksburg for the use of the rail road, such part of said lots as may be designated and selected by said assignees, not exceeding two acres, provided said grant shall only continue so long as said road is kept up and said land
