Brandon R. Bridge CHAPTER 32. AN ACT to revive the Jackson and Brandon Rail SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the first section of an act entitled "an act to Jackson & amend the charter of the Mississippi and Road and Alabama Rail Road Company, approved Company February 5th, 1838," be, and the same is hereby repealed; and the act entitled "an act to incorporate the Jackson and Brandon Rail Road and Bridge Company," approved February 5th, 1836, be, and the same is hereby revived, except such provisions of said act as are inconsistent with this act. revived. Sec. 2. Be it further enacted, That John W. King, William Yerger, William C. HarDirectors of per, Stephen C. Farrar and Wright Fore, company. be, and they are hereby appointed directors of the Jackson and Brandon Rail Road and Bridge Company by the state of Mississippi, who shall continue in office until the next regular meeting of the legislature, and until their successors are elected and qualified. nominate directors, Sec. 3. Be it further enacted, That at the next regular session of the legislature, and Governor to biennially thereafter, the governor of the state shall nominate to the senate for their confirmation five persons as successors to the directors hereby appointed, and all vacancies in the said directory during the recess of the legislature shall be filled by the appointment of the governor. of Sec. 4. Be it further enacted, That the said company are hereby authorized to complete the rail road and bridge contemplated Pow in the original act hereby revived, and they contract. shall have power to enforce and cause to be fulfilled any contracts heretofore made, either by the Jackson and Brandon Rail Road and Bridge Company, or the Mississippi and Alabama Rail Road Company, for the purpose of completing said rail road and bridge, or to make a new contract for that purpose at their discretion, or both if they deem the same expedient. Company to negotiate Sec. 5. Be it further enacted, That said company be, and they are hereby authorized to make a loan of money and contract for materials which may be necessary for the au'horized completion of said road, for which they are a loan. authorized to give the obligations of the company, not bearing a greater rate of interest than ten per cent. per annum, and the said road shall stand pledged for the redemption of the same. applied to Sec. 6. Be it further enacted, That the profits arising from said road and bridge, af-Profits of ter defraying the expenses and repairs, shall road to he be applied first to the re-payment of any payment of loans or debts which may be contracted for debe due the its completion, after which, the profits shall be applied to the payment of the debt due to the state of Mississippi by the Mississippi and Alabama Rail Road Company. Sec. 7. Be it further enacted, That the assumption by said company of the debt due to the state from the Mississippi and state. Alabama Rail Road Company, shall be in full payment for all work and labor done on said road, and materials furnished for the same, by the said Mississippi and Alabama Rail Road Company - and rights which have accrued in any manner to the Mississippi and Alabama Rail Road Company in relation to said rail road, are hereby fully vested in the Jackson and Brandon Rail Road and Bridge Company. Sec. 8. Be it further enacted, That said company may contract with the President and Directors and Company of the Commercial and Rail Road Bank of Vicksburg, or their assignees, for the connection of the rail road of the two companies, and for the joint use of locomotives and cars on said roads, upon such terms as they shall deem advantageous. Sec. 9. Be it further enacted, That said company, if they deem it expedient, be, and they are hereby empowered, with the consent of the governor of the state, to sell the rail road and bridge authorised to be constructed by this act, to any other incorporated company, individual or individuals, provided, the purchaser shall first give security, to be approved by the governor of the state, for compliance with the provisions of this act, and in case of such sale the power of the state to appoint directors, as provided for in this act, shall cease, Sec. 10. Be it further enacted, That the Directors to directors of said company shall, at each sesvernorsion of the legislature, or whenever required so to do, report to the governor of the state fully the condition of said road. Sec. 11. Be it further enacted, That said company shall commence the construction of said rail road within ninety days, and complete the same within two years from and after the passage of this act. Sec. 12. Be it further enacted, That this act shall not release the lien of the state upon any property owned by the Mississippi and Alabama Rail Road and Banking Company, or of any other judgment creditor or creditors. Sec. 13. Be it further enacted, That nothing contained in this act shall be so construed as to make, in any case whatsoever, the state of Mississippi responsible for any debts heretofore contracted, or which may hereafter be contracted for the purpose of completing the said rail road, or to release any claim which the state may now have or may hereafter have against the corporation heretofore known as the Mississippi and Alabama Rail Road and Banking Company, or against the individual members thereof. Sec. 14. And be it further enacted, That nothing in this act shall be construed so as to confer upon said company any banking privileges, and that this act shall take effect from and after its passage. Approved February 5th, 1841. Regiments divided. designated. CHAPTER 33. AN ACT to divide the militia of Itawamba, Ponola and Yallobusha counties into two regiments, each. SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the thirty-sixth, forty-sixth and fifty-fourth regiments of the Mississippi militia, shall hereafter be divided into and constitute two regiments each, and the dividing lines between said regiments shall be the Tombigby river, up to the junction of Twenty Mile and Chiwappa creeks, thence up Twenty Mile creek to the northern boundary in the county of Itawamba, the Tallahatchie river in the county of Ponola, and the township line between township twenty-three and twenty-four, in the county of Yallobusha. Sec. 2. Be it further enacted, That the regiments formed in consequence of the ineed, division contemplated in the above section, shall be known and designated as follows, viz: in the county of Itawamba, that on the east side of the Tombigby river and Twenty Mile creek, the forty-sixth regiment, that on the west side of said river the fifty-ninth regiment in the county of Ponola, that on the north side of Tallahatchie river the fifty-fourth regiment, that on the south side of said river, the sixty-first regiment in the county of Yallobusha, that on the north side of the township line dividing townships twenty-three and twenty-four, the thirtysixth regiment, that on the south side of said township line, the sixtieth regiment, and the brigadier general to whose respective |
