typed reports of growers' cooperative associations showing stocks on hand by warehouse locations and types of peanuts may be submitted in lieu of Form C. E. 6– 18 "B" since such reports contain the required information in an acceptable form.

(b) The forms identified in paragraph (a) of this section will be furnished by the Agricultural Estimates Division, Agricultural Marketing Service, United States Department of Agriculture, Washington 25, D.C.

§ 1300.4 Time when reports are due.

Each report required by § 1300.3 shall be addressed to the Agricultural Estimates Division at the address given in § 1300.3 (b) and placed in the mail within six days after the end of the month to which such report relates.

NOTE: The reporting requirements contained herein have been approved by the Bureau of the Budget in accordance with the Federal Reports Act of 1942.

§ 1402.101 General.

Notice is hereby given of the policy of the Commodity Credit Corporation to facilitate sales in private trade channels of commodities acquired under the Corporation's price support programs by the issuance of monthly lists announcing various quantities of such commodities available for sale and containing information as to the price thereof. Those commodities available for export at reduced prices will be set forth in an export price list. Commodities not so listed, but listed on a domestic price list for unrestricted use, may be obtained for export at the domestic price. The lists may vary from month to month as additional commodities become available and as other commodities formerly available are dropped, and such lists may not necessarily be inclusive of all commodities

which the Corporation may have available at any time. The lists are to be issued for the purpose of public information and shall not be deemed to constitute an offer to sell by Commodity Credit Corporation.

§ 1402.102 Submission of offers, terms and conditions.

The Commodity Credit Corporation will entertain offers from prospective buyers for the purchase of any commodities on the current lists. Offers accepted by Commodity Credit Corporation will be subject to terms and conditions prescribed by the Corporation. These terms include, among others, payment by cash or irrevocable letter of credit before delivery of the commodity, removal of the commodity from Commodity Credit Corporation storage within a reasonable period of time, and, in sales for export, proof of exportation.

PART 1405-LOANS, PURCHASES AND OTHER OPERATIONS

§ 1405.1 Loans to and purchases by

trustees.

Language in Commodity Credit Corporation price support bulletins or other price support announcements to the effect that the beneficial interest in the commodity must be in the producer tendering the commodity for loan or purchase shall not be interpreted as excluding from any price support program a trustee who is otherwise eligible to participate.

Arrest and conviction.

The Commodity Credit Corporation hereby announces that, subject to the following conditions, rewards will be paid for information leading to the arrest and conviction of any person or persons found to be guilty of malicious damage to property of the Commodity Credit Corporation or the theft of commodities and equipment owned by the Commodity Credit Corporation.

§ 1406.2 Amount of rewards.

(a) A reward in the amount of $50 will be paid for information leading to the arrest and conviction of any person or persons found to be responsible for mali

cious damage to CCC-owned property at the site of any storage structures owned or leased by Commodity Credit Corporation: Provided, That such reward shall not exceed $50 for information leading to the arrest and conviction of any person or persons involved in the same act or series of acts of malicious damage perpetrated prior to conviction of those guilty.

(b) A reward in the amount of $500 will be paid for information leading to the arrest and conviction of any person or persons found to be guilty of the theft of CCC-owned commodities from any storage structures owned or leased by Commodity Credit Corporation: Provided, That the total amount paid shall not exceed $500 for information leading to the arrest and conviction of any person or persons involved in the same theft, or series of thefts perpetrated prior to conviction of those guilty.

(c) A reward in the amount of $50 will be paid for information leading to the arrest and conviction of any person or persons found to be responsible for the theft of CCC-owned equipment valued at $50 or more at the site of any storage structures owned or leased by Commodity Credit Corporation: Provided, That such reward shall not exceed $50 for information leading to the arrest and conviction of any person or persons involved in the same theft or series of thefts perpetrated prior to conviction of those guilty.

§ 1406.3 Eligibility for rewards.

(a) Any person or persons will be eligible for rewards mentioned above except (1) Agricultural Stabilization and Conservation County Committeemen, (2) Agricultural Stabilization and Conservation County Office Managers, (3) Personnel of Agricultural Stabilization and Conservation Service State Offices, and (4) United States Department of Agriculture employees.

(b) State and local law enforcement officers, community committeemen and Agricultural Stabilization and Conservation Service County Office employees other than those specifically excluded herein, will be eligible for reward.

§ 1406.4 Filing of applications.

All applications for reward will be filed with the State ASC Chairman who shall transmit such applications to the Director, Grain Division, Agricultural Stabilization and Conservation Service,

§ 1407.1 Purpose.

This part prescribes the terms and conditions under which persons may be suspended and debarred from contracting with Commodity Credit Corporation and from otherwise participating in programs administered or financed by Commodity Credit Corporation. § 1407.2 Definitions.

(a) The term "Department" means the U.S. Department of Agriculture.

(b) The term "CCC" means Commodity Credit Corporation.

(c) The term "Executive Vice President" means the Executive Vice President of CCC.

(d) The term "Vice President" means a Vice President of CCC.

(e) The term "person" means an individual or any form of business entity, e.g., a proprietorship, partnership, corporation, association, or cooperative.

(f) The term "authorized official" means the Executive Vice President of Commodity Credit Corporation, a Vice President of Commodity Credit Corporation or any official of the Department authorized, as provided in this part, to suspend and debar persons.

(g) The term "suspend" or "suspension" means the withholding from a per

(a) The provisions of this part shall apply to all suspensions and debarments: Provided, That the provisions of this part shall not apply to or otherwise affect the conditions under which:

(1) Price support or other benefits may be made available by CCC to a person in his capacity as a producer in accordance with applicable statutes and regulations.

(2) CCC may require persons to establish and maintain financial responsibility and other qualifications as conditions precedent to contracting with CCC or otherwise participating in programs administered or financed by CCC.

(3) CCC may cancel or terminate a contract under the provisions thereof or for failure of the contractor to comply therewith or may take administrative action to require a contractor or participant to correct deficiencies in the performance of contract or program provisions.

(4) Persons are debarred under the provisions of the Walsh-Healey Public Contracts Act (41 U.S.C. 37) and DavisBacon Act (40 U.S.C. 276a-2(a)).

(b) All suspensions and debarments under the provisions of this part shall extend to and include any proprietorship, corporation, partnership, association, or other business entity, the policies or business practices of which are decided or materially influenced by the suspended or debarred person if such proprietorship, corporation, partnership, association, or other business entity is specifically named in the notice of suspension or debarment.

(c) The provisions of this part shall not be construed to require the suspension and debarment of any person but shall be deemed a statement of the terms and conditions under which suspension and debarment action may be taken by an authorized official when such action is deemed to be in the best interests of CCC.
