CHAPTER 40.

HOUSE BILL No. 355.

AN ACT to appropriate from the pension fund refunded to the treasury money to pay pensions to those whose applications were received after distribution had been made to the counties by the auditor, or whose names were omitted from the pension list through mistake, and in the event of the death of any pensioner before receiving his pension, providing how such pension shall be distributed.

To pay pension applications received after distribution was made.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That all persons whose applications for pension during the year 1911, 1912, 1913 and 1914 have been legally allowed by the proper examining board and who failed to receive their pensions for either of said years by reason of the fact that their applications reached the auditor after the expiration of the time such applications, or by their names having been omitted from the pension list through mistake of the auditor, or any chancery clerk, shall be placed upon the pension list and the auditor is hereby instructed and empowered to issue a warrant on the treasury to pay the such pension or pensions. If a pensioner has died, or shall die at any time before the pension allowed has been received, then the chancery clerk of the county where the pensioner resides shall receipt to the county treasurer for such pension, and out of the same first, pay the burial expenses; second, the expenses of the last illness, and if there be any residue, pay same to the children of the deceased pensioner, if any, and if not, to his heirs at law. If the pensioner, in his lifetime, has made an assignment of the pension, or any part thereof, the same may be paid to assignee, and the balance, if any, shall be distributed as provided in section 1 of this act. And for this purpose the sum of fifteen hundred dollars ($1,500.00) or so much thereof as may be necessary, to pay such claim, or claims, be, and is hereby, appropriated for the payment. of any such pension, or pensions, for the years 1911, 1912,

1913 and 1914.

SEC. 2. That this act take effect and be in force from and after its passage.

CHAPTER 41.

SENATE BILL No. 408.

AN ACT to appropriate the sum of five thousand seven hundred and ninety-five dollars and thirty-six cents to reimburse the Morrill-Nelson funds contributed by the federal government in aid of the agricultural and mechanical colleges of the State, which amount was improperly expended out of said Morrill-Nelson fund.

Morrill-Nelson fund reimbursed.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of five thousand seven hundred and ninety-five dollars and thirty-six cents ($5,795.36) be appropriated out of any money in the State treasury not otherwise appropriated for the purpose of reimbursing the Morrill-Nelson fund, contributed by the federal government in aid of the Alcorn Agricultural and Mechanical College, and the auditor of public accounts is hereby required to issue his warrant for said amount.

State treasurer to transfer fund.

SEC. 2. That the State treasurer be, and he is hereby, directed to transfer to the credit of the Morrill-Nelson fund contributed to the said Alcorn College the sum of five thousand seven hundred and ninety-five dollars and thirtysix cents ($5,795.36).

SEC. 3. That this act take effect and be in force from and after its pass ge.

CHAPTER 42.

SENATE BILL No. 49.

AN ACT making an appropriation for the refund of registration fees collected on automobiles during the years 1912 and 1913 under chapter 108, laws 1912.

Automobile tax refunded.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of twenty-eight thousand and forty dollars ($28,040.00), or so much thereof as may be necessary, be and the same is hereby appropriated out of any money in the State treasury not otherwise appropriated for the purpose of refunding to automobile owners the amount of registration fees paid into the State treasury under and by virtue of the provisions of chapter 108, laws of 1912, which has been declared unconstitutional by the supreme

court.

Auditor to issue warrants.

SEC. 2. The auditor of public accounts is hereby authorized to issue his warrant in favor of the automobile owners who paid said registration fees, as shown by the register kept in his office.

SEC. 3.

That this act take effect and be in force from

and after its passage.

CHAPTER 43.

SENATE BILL No. 585.

Whereas, In the building and erection of the monument in the Vicksburg National Military Park, under the supervision of the commission created for that purpose there was extra work done by the architect, Prof. F. E. Triebel, amounting to $930.20, which is certified to by Mr. W. L. Polk, the superintendent of construction, and,

Whereas, This account is approved by the Mississippi Vicksburg Park Commission and they believe that it is a just and proper account and should be paid:

Appropriation to F. E. Triebel.

Now therefore, Be it enacted by the Legislature of the State of Mississippi,

SECTION 1. That there is hereby appropriated out of the State treasury from any funds not otherwise appropriated the sum of nine hundred and thirty dollars and twenty cents to be paid to Prof. F. E. Triebel, said sum to be paid on the certificate of the Mississippi Vicksburg Park Commission, approved by the governor.

SEC. 2. That this act be in force from and after its passage.

CHAPTER 44.

HOUSE BILL No. 876.

AN ACT appropriating the sum of $200.00 to be used as an additional amount to be placed to the credit of the governor's contingent fund for the year 1914, being the amount he has expended from the contingent fund of that year to pay accrued interest on various loans obtained by him.

Supplement governor's contingent fund.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That there is hereby appropriated, out of any funds in the State treasury, not otherwise appropriated, the sum of $200.00 as an addition to the contingent fund

of the governor for the year 1914, to repay to said fund the amount of accrued interest on various loans obtained by him in 1912 and 1913.

SEC. 2. That this act take effect and be in force from and after its passage.

CHAPTER 45.

SENATE BILL No. 233.

AN ACT entitled an act to appropriate three thousand dollars for the repair of the executive mansion for the years 1914 and 1915 and to provide for such expenditures.

Repairs to executive mansion.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That there is hereby appropriated out of any sum not otherwise appropriated, the sum of three thousand dollars as a "mansion repair fund" to be used during the years 1914 and 1915.

SEC. 2. That sixteen hundred dollars of this amount is appropriated for the purpose of placing a new roof on the executive mansion, or so much thereof as is necessary, and the sum of fourteen hundred dollars is to be used in repairs and the purchase of necessary articles at the mansion, such as furniture, kitchen utensils, etc., during the years 1914 and 1915.

Capitol commission to expend appropriation.

SEC. 3. That this amount shall be expended under the direction of the capitol commission and warrants drawn by the capitol commission shall be recognized by the State auditor of public accounts and warrant on the State treasury issued thereon.

SEC. 4. That this act shall take effect and be in force from and after its passage.

CHAPTER 46.

SENATE BILL No. 300.

AN ACT to make an appropriation for the payment of stenographers fees in the taking of depositions in the anti-trust cases brought by the attorney general, and now pending.

Contingent fund for attorney general.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of three thousand dollars is hereby appropriated for the payment of stenographers fees incurred and to be incurred in the several anti-trust causes brought by the attorney general for the enforcement of the anti-trust laws of the State, and now pending in the courts, said sum to be paid by the State treasurer on the warrants of the auditor to be issued by the auditor on the statements of said fees approved by the attorney general.

Sec. 2. That this act take effect and be in force from and after its passage.

CHAPTER 47.

HOUSE BILL No. 593.

AN ACT appropriating $1,920.49 to cover deficiency in appropriation for water furnished by the city of Jackson to the insane hospital.

Deficit in water appropriation.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That there be and is hereby appropriated the sum of $1,920.49 to be paid to the city of Jackson to cover deficiency in appropriation made for furnishing water to the State nsane hospital.

SEC. 2. That this act shall take effect and be in force from and after its passage.

HOUSE BILL No. 15.

AN ACT to provide for the maintenance of the geographical, economic, topographical and soil survey of the State of Mississippi, and to provide for cooperation of the geological and soil surveys of the United States.
