protection than is otherwise required by this document, as ERDA determines to be commensurate with the difficulty of removing the material.

6. DOCUMENT CONTROL

(a) Preparation of Classified Documents

(1) Classification Marking. Each document containing "Restricted Data" shall be marked Secret or Confidential to indicate the classification

of the contents (see subparagraph (6) below for details).

(2) Restricted Data.

"RESTRICTED DATA"

This document contains Restricted Data as that term is

used in the ERDA/JNAI Classification and Security Agreement.

Its dissemination or disclosure to any unauthorized
person is prohibited.

(3) Identity of Classifying Official. If the originator of a document is responsible for the classification, no additional identification of the classifying official is required. If the originator is not the classifying official, the words "CLASSIFIED BY" and the name, title of position, and organization by which employed shall be placed on the face of a document in final form. Drafts or worksheets need not contain this notation. JNAI shall appoint a "JNAI Classification Officer" whose duties shall include the providing of classification guidance to employees of JNAI and of its contractors, subcontractors, vendors, and consultants. (4) Classification. "Restricted Data" originated by any person subject to the procedures set out in this Supplement must be appropriately classified in accordance with the JNAI Classification Guide (Appendix A to the Agreement). In the event JNAI originates

information within the definition of "Restricted Data" which it is not positive is not within that definition and the JNAI Classification Guide does not provide positive classification guidance for such information, the originator shall request the JNAI Classification Officer to provide classification guidance. If the JNAI Classification Officer requires further guidance, he shall designate the information as "Confidential Restricted Data" and request classification guidance from ERDA through the Director, Division of Classification, U.S. Energy Research and Development Administration, Washington, D.C. 20545.

(5) Changes in Classification. Documents containing "Restricted Data" shall not be downgraded to a lower classification or declassified except as authorized by ERDA. Requests for downgrading or declassification shall be submitted to the Director, Division of Classification. If ERDA approves a change of classification or declassification, the previous classification marking shall be cancelled and the following statement, properly completed, shall be placed on the first page of the document.

Any person making a change in classification or receiving notice of such a change shall forward notice of the change in classification to holders

of all copies as shown in the records. Note that the information may remain "Proprietary" and notice of this fact may be required (see

Article I, Section 2 (C) of the Agreement).

(6) Method of Marking. The classification marking assigned

to a document shall be placed in letters not less than 1/4" in height at the top and bottom of the outside of the front covers and title pages, if any, and first and last pages on which text appears, on both bound and unbound documents, and on the outside of back covers of bound documents. The balance of the pages shall be marked at the top and

(b) To the extent practicable, each page of a document shall be marked according to its own content.

(1) Documentation. All Secret documents shall bear on the first page a properly completed documentation stamp such as the following:

The series designation shall be a capital letter beginning with the

letter "A" designating the original set of copies prepared. Each

subsequent set of copies of the same document shall be identified by the succeeding letter of the alphabet.

(2) Letter of Transmittal.

Documents Containing Information of Lower Classifica

tion. A document used to transmit a document or documents of a higher classification should be marked as follows:

(3) Document Which Custodian Improperly Classified or Lacking Appropriate Classification Markings. If a person receives a document which in his opinion is not properly classified, or omits the appropriate classification marking, he shall communicate with the sender and suggest the classification which he believes to be appropriate. Pending final determination of proper classification, such documents shall be safeguarded with the highest classification in question.

*Note: "Proprietary information" must still be respected.

(4) Files, Folders, or Group of Documents. Files, folders

binders, or groups of physically connected documents shall be marked at least as high as the most highly classified document which they con

tain.

Documents removed from the file, folder, binder, or group shall

be handled in accordance with their classification.

(5) Attachment of Security Markings. Documents which do

not lend themselves to marking or stamping shall have securely affixed or attached a tag, sticker, or similar device bearing the appropriate security marking.

7. EXTERNAL TRANSMISSION OF DOCUMENTS AND MATERIAL

(a)

Restrictions

(1) Documents and material containing "Restricted Data" shall be transmitted only to persons who possess appropriate security clearances and are otherwise eligible for access.

(2) In addition, such documents and material shall be transmitted only to persons who possess ERDA-approved facilities for their physical security consistent with this Supplement. Any person subject to this Supplement, who has written certification from ERDA, or a copy thereof, that the prospective recipient possesses ERDA-approved facilities for physical security thereof consistent with this Supplement, shall be deemed to have fulfilled his obligations under this subparagraph. Documents and material containing "Restricted Data" shall not be exported from the United States without prior authorization of ERDA.
