AN ACT to authorize and direct the state treasurer to pay the board of oyster commissioners thirty thousand five hundred ($30,500.00) dollars out of the oyster fund for each of the years 1926 and 1927, being the amount authorized to be expended under section 3499 and 3506 of the code of 1906, and amendments thereto.

For support of oyster commission.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the state treasurer be, and the same is hereby authorized and directed to pay to the board of oyster commissioners the sum of ten thousand ($10,000.00) dollars out of the oyster fund in the state treasury for each of the years 1926 and 1927 for expenses of enforcing chapter 102 of the Mississippi code of 1906, and amendments thereto, and the sum of twenty thousand five hundred ($20,500.00) dollars, or so much as there may be available, or necessary, out of the oyster fund for each of the years 1926 and 1927 for the purpose of improving oyster reefs, spreading of shells and making new bottoms as provided in section 2499 of the Mississippi code of 1906 and amendments thereto; provided, however, that the board of oyster commissioners shall not expend more than the amount of revenue paid into the oyster fund if the said amount does not equal the amounts appropriated and all sums of money received by them in excess of the sums herein appropriated shall be turned into the general fund of the state.

Detailed report to Legislature.

Sec. 2. That this appropriation is made upon the condition that all funds herein provided for shall be accounted for in a detailed statement showing when, to whom, and for what purpose applied, and the said statement is to be submitted to the legislature at its next regular session and within ten days after the convening of the

same.

Police boat provided for.

Sec. 3. That the board of oyster commissioners may, in their discretion, purchase a police boat out of the funds herein appropriated, not to exceed in cost four thousand ($4,000.00) dollars.

Sec. 4. That this act take effect and be in force from and after its passage.

CHAPTER 59.

HOUSE BILL No. 398.

AN ACT to make an appropriation to carry out the provisions of sections 2927, 2947, 2948, 2949, 4346, 4347, 4348, 4349 of the code of Mississippi of 1906, providing for the relief in repayment of money erroneously paid in privilege and state taxes and lands purchased.

To provide for refund of erroneous payment of taxes.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of twenty-five thousand dollars ($25,000.00) or so much thereof as may be necessary for the years 1926 and 1927, is hereby appropriated to carry out the provisions of sections 2927, 2947, 2948, 2949, 4346, 4347, 4348, 4349 of the code of the laws of the state of Mississippi of 1906 providing for the relief in payment of erroneously paid privileges and state taxes and in land purchased, and saving the state cost in passing bills for relief by local and private legislation in certain cases, provided, no portion of said amounts shall be paid on account of land obtained in claims for money paid under any patent or certificate heretofore issued by any secretary of the state of Mississippi. For refunding privilege and state taxes.

Sec. 2. That twelve thousand five hundred dollars ($12,500.00) of the above amount shall be used to refund privileges and state taxes erroneously paid into the state treasury on account of lands purchased as provided in section 1 of this act.

Sec. 3. That this act take effect and be in force from and after its passage.

CHAPTER 60.

HOUSE BILL No. 20.

AN ACT to appropriate money to pay the mileage and per diem of the presidential electors for one meeting held in the city of Jackson, on the 12th day of January, 1925, as directed by section 4209 of the Mississippi code of 1906.

Presidential electors-appropriation for expenses of.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of $399.20, be and the same is hereby appropriated, out of any money in the state treasury not otherwise appropriated, to pay the mileage and per diem of the presidential electors for one meeting held in the city of Jackson, on the 2nd Monday in January, 1925.

CHAPTER 61.

HOUSE BILL No. 159.

AN ACT authorizing the trustees of the state library to purchase for and equip the state library with additional furniture, bookcases and fixtures and making an appropriation of fifteen thousand dollars ($15,000.00) therefor.

State library-additional equipment provided for.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the trustees of the state library are hereby authorized to purchase for and equip the state library with such additional furniture, bookcases, and fixtures as in their judgment may be necessary to meet the requirements of the state library, if necessary, in order to increase the capacity of the library, to construct a mezzanine floor in the main room thereof, and to move, store and care for the books, furniture and fixtures of the said library while the work herein contemplated is being done, and to expend therefor the sum of fifteen thousand dollars.

How funds to be drawn.

Sec. 2. That the sum of fifteen thousand dollars ($15,000.00) or so much thereof as may be necessary, is hereby appropriated out of any money in the state treasury not otherwise appropriated for the purpose set forth in section 1 of this act. The auditor of public accounts shall issue warrants on the state treasurer for all expenditures made under the provisions of this act on itemized statements thereof approved by a majority of the trustees of the state library. Sec. 3. That this act take effect and be in force from and after its passage.

HOUSE BILL No. 479.

AN ACT appropriating the sum of four hundred and forty-nine dollars and fourteen cents ($449.14) for the biennial period of 1926 and 1927 to supplement the reference fund of the Mississippi state library.

State library-additional reference fund provided.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of four hundred and forty-nine dollars and fourteen cents ($449.14) be and the same is hereby appropriated out of any money in the state treasury not otherwise appropriated to supplement such other funds as may be appropriated for the reference fund for the years 1926 and 1927, for the Mississippi state library.

Sec. 2. That this act take effect and be in force from and after its passage.

CHAPTER 63.

SENATE BILL No. 310,

AN ACT to appropriate the sum of twenty-five

thousand dollars ($25,000.00) or so much thereof as may be necessary for the biennium of 1926 and 1927, to be used in freight and express litigation and investigation and to be expended under the supervision of the attorney general.

Freight and express rate litigation-attorney general.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of twenty-five thousand dollars ($25,000.00) or so much thereof as may be necessary, be, and the same is hereby appropriated out of any monies in the state treasury not otherwise appropriated, to be used in freight and express rate litigation and investigation for the biennial period of 1926 and 1927.

How funds expended.

Sec. 2. That said fund shall be expended under the direction, supervision and approval of the attorney general, and that a detailed report of such expenditures shall be made to the regular session of the legislature.

Sec. 3. That this act take effect and be in force from and after its passage.

AN ACT appropriating funds to defray the expenses of a litigation pending between the state of Louisiana and the state of Mississippi over the boundary line between Louisiana and Mississippi.

Mississippi-Louisiana boundary litigation.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of ten thousand dollars ($10,000.00) or so much thereof as may be necessary is hereby appropriated out of any funds in the state treasury not otherwise appropriated, to be expended by the attorney general in defraying all necessary expenses incurred and to be incurred in defending the litigation now pending in the supreme court of the United States, wherein the state of Louisiana has instituted proceedings against the state of Mississippi.

Additional counsel-compensation.

Sec. 2. The attorney general be, and he is hereby authorized and empowered to employ such associate counsel and he deems necessary to assist in the defense of said suit. Said associate counsel to receive such compensation as may be determined by the next legislature, upon the recommendation of the attorney general.

Sec. 3. That this act take effect and be in force from and after its passage.

CHAPTER 65.

SENATE BILL No. 331.

AN ACT appropriating fifteen thousand dollars, or so much thereof as may be necessary, to be expended for the purpose of securing the data necessary to protect and validate the bonds heretofore issued by the various road districts, of the several counties of the state, and for defraying any and all expenses necessary or incident to the carrying out of the purposes of this act, and providing how said funds shall be drawn from the treasury.

Road district bonds-protection of.

SECTION 1. Be it enacted by the Legislature of the State of Mississippi, That the sum of fifteen thousand dollars ($15,000.00), or so much thereof as may be necessary, be and the same is hereby appropriated out of any funds now in the treasury not otherwise appropriated, to be expended for the purpose of securing the data necessary for the protection of the credit of the state validating the bonds heretofore issued by the various road districts, of the several counties of the state, and to pay all expenses necessary or incident thereto.
