Supply, a schedule of blind-made products (hereinafter referred to as the "schedule"), setting forth descriptions of blind-made commodities to be purchased, the fair market prices thereof determined by the Committee, applicable Federal specification numbers, etc. The schedule will be revised from time to time and the effective dates of changes will be indiIcated in the revisions.

§ 301.5 Products made by Federal Prison Industries, Inc. Section 7 of the act of May 27, 1930, as amended (18 U. S. C., Sup., 4124), requires ordering offices to purchase those products made available by industries operated in Federal prisons. Where similar products are made by agencies for the blind, an agreement has been effected with Federal Prison Industries, Inc., that, when it receives an order for any such product which it is not in a position to supply, the original copy of the order, with a Federal Prison Industries, Inc. clearance, will be returned to the ordering office with the advice that the product is listed in the Schedule of Blind-made Products and that the duplicate copy of the order has been forwarded to the Committee on Purchases of Blind-made Products. This duplicate will be treated as a request for allocation and processed in the manner prescribed in § 301.6. [11 F. R. 1438]

§ 301.6 Allocation procedure. (a) Any ordering office requiring any commodity listed in the schedule and which is not available from Federal Prison Industries, Inc. shall transmit a request for allocation specifying item numbers, quantities required, delivery points, and time within which delivery is needed. Requests for allocation shall be submitted in duplicate addressed in letter form to the Committee on Purchases of Blind-made Products, Bureau of Federal Supply, Treasury Department, Seventh and D Streets SW., Washington 25, D. C.

(b) The Bureau of Federal Supply will forward requests for allocation to National Industries or, in the discretion of the Director, Bureau of Federal Supply, may furnish any schedule item from Bureau of Federal Supply stock, at the schedule price plus any applicable Bureau of Federal Supply surcharge. The Bureau of Federal Supply will place a stamp of approval on each request for allocation, showing that it has taken the required action with respect thereto, and

any request for allocation received by National Industries without such stamp shall be forwarded to the Bureau of Federal Supply for approval.

(c) National Industries shall determine, immediately upon receipt of each request for allocation, whether any agency for the blind is in a position to furnish the requirement, and if not, shall promptly return the request to the Bureau of Federal Supply. As soon as National Industries determines which agency for the blind is to furnish the requirement, it shall notify the ordering office of the name and address of said agency for the blind. Where National Industries finds that costs have substantially changed, it shall hold requests for allocation and recommend that the Committee revise prices, and such requests for allocation shall be held until the Committee has had an opportunity to act. § 301.7 Clearances. (a) The Bureau of Federal Supply may grant clearance to any ordering office to purchase from commercial sources any item listed in the schedule (1) when necessary to meet emergency requirements, or (2) no agency for the blind is in a position to furnish the requirement.

(b) Any ordering office may purchase from commercial sources any item listed in the schedule to meet requirements (1) that do not exceed a single unit or (2) that are for use outside continental United States.

§ 301.8 Purchase procedure. ordering office will issue a purchase order to the agency for the blind designated by National Industries to furnish the requirement. A copy of the purchase order shall also be forwarded to National Industries.

(b) Invoices covering orders filled for blind-made commodities will be transmitted by the agency for the blind, as directed by the ordering office, and if the regulations of an ordering office require the use of vouchers, such vouchers will be transmitted by the ordering office directly to said agency for the blind for completion and return to the ordering office. Invoices shall be submitted in triplicate, and the original copy shall be duly certified by an authorized representative of the agency for the blind.

§ 301.9 Agencies for the blind; restrictions. (a) No commodity listed in the schedule shall be delivered to any order

ing office by an agency for the blind, unless (1) at least 75 percent of the direct labor of production of such commodity, including preparation of materials, processing and packing, shall have been performed by the blind in producing the commodity for delivery to ordering offices and elsewhere, and (2) such commodity shall have been produced and sold by the particular agency for the blind for at least 6 months prior to delivery of such commodity to any ordering office.

(b) Each agency for the blind shall keep on file an eye record card containing information that will establish whether a person employed in the production of commodities listed in the schedule is blind as defined in section § 301.1 (a). Copies of these cards shall also be filed with National Industries.

(c) As a prerequisite to participation in such Government orders, each agency for the blind shall file with National Industries copies of its certificate of incorporation, constitution and bylaws, or other instruments of similar import showing its authority and permitted activities.

(d) Each agency for the blind participating in such Government orders shall maintain an accounting system and, not less often than once each year, shall prepare a financial report and operating statement that accurately reflects its operations. Operating statements shall show as a separate item the amount of wages paid to blind employees. Books and records shall be made available for inspection at any time to representatives of National Industries or the Committee.

(e) No allocation of requirements shall be made by National Industries to any agency for the blind not operating in accordance with this part.

§ 301.10 Reports. National Industries shall furnish to the Bureau of Federal Supply quarterly reports of purchases made by ordering offices, through allocation, of commodities listed in the schedule. These reports shall include a list of all purchase orders filled, with the quantity, shipping and delivery points, and the amount received for each commodity under each order. The Bureau of Fed

eral Supply shall then submit a summary of these reports to the Committee with any recommendations it may deem appropriate.

§ 302.1 Basic procedures. The basic procedures prescribed by the Committee for performing operations under the Wagner-O'Day Act are published in Part 301 of this chapter.

§ 302.2 Schedule of blind-made products. The Committee issues from time to time through the Bureau of Federal Supply a schedule of blind-made products, and amendment thereto, describing blind-made products available, fair prices, specifications, etc. and including the text of the Wagner-O'Day Act and the regulations prescribed by the Committee.

§ 302.3 Violations. Where an alleged violation of the regulations has occurred, the blind agency concerned is notified by the secretary of the Committee and afforded an opportunity to submit a statement of facts and evidence on the subject. Such statement is generally considered satisfactorily authorized when signed by the manager of the blind agency workshop and attested by an officer of the private organization controling it or, in case of governmental workshops, when signed by an official of the controlling department. In appropriate cases oral testimony may also be taken, particularly when the workshop requests a hearing. The secretary of the Committee with the concurrence of the chairman may ordinarily determine whether a violation has or has not occurred. Where a violation is found, the secretary notifies the National Industries for the Blind to discontinue allocation of orders to the blind agency concerned until the Committee is satisfied its operation is in accord with the regulations.
