(1) Send his request to the 1350 Motion Picture Sq (USAF Motion Picture Film Depository), Wright-Patterson AFB, OH 45433.

(2) Include in the request a statement of intended use.

(3) State the type of film preferred and the approximate number of screen feet required.

NOTE: An Air Force contractor requiring unclassified stockfootage to meet film production requirements specified in an Air Force contract will forward his request through the Air Force contracting officer having jurisdiction over the contract. If stockfootage is for a film production intended for public release, he must submit his request according to paragraph (b) of this section.

(d) Classified stockfootage requested by Air Force contractor. An Air Force contractor requiring classified stockfootage will forward his request for review and approval through the Air Force contracting office having jurisdiction over the contract involved.

(e) Other classified stockfootage requests. The person outside the Air Force requesting classified stockfootage will: (1) Send his request to Hq USAF (AFXOPXB), Washington, D.C. 20330. (2) Include in the request a statement of intended use. When notified by Hq USAF that his request is favorably considered, the requester may communicate direct with the USAF Motion Picture Film Depository to arrange for selecting the stockfootage.

(3) Provide assurance that the classified information will be handled according to Part 850, Subchapter E of this chapter (if he is not in the Executive Branch of the Government) and explain the measures he will take to safeguard the information.

To the extent that funds are available, the requests received from sources and for services indicated in this section are exempt from the payment of fees, provided the service will not hamper the mission of the furnishing agency, is consistent with this part, and is accomplished during normal work schedules.

(a) Sources. (1) DOD agencies and other departments of the Federal Government requesting stockfootage for use in approved departmental activities.

(2) Members of Congress requesting stockfootage for use in official Government activities.

(3) Federal, State, territorial, county, or municipal government, or an agency thereof, carrying on a function related to, or furthering, an Air Force or other DOD objective.

(4) Nonprofit organizations carrying on a function related to, or in the interest of, public health and welfare.

(5) Members of the Armed Forces in a casualty status, or their next of kin or authorized representative, when requested stockfootage relates to the source of the casualty.

(b) Services. (1) Service that is occasional and incidental (including requests from residents of foreign countries), when it is determined that fees would be inappropriate.

(2) Service determined by SAFOI to be in the best interest of the Air Force. (3) Service that is furnished free according to statutes or Executive orders. (4) Service for which the Federal Government will ultimately pay.

§ 810.8 Collection of fees.

Payments will be made by Government check, certified check, or money order, drawn payable to the Treasurer of the United States. When appropriate, fees I will be collected whether or not stock

This part controls the sale of unclassified Air Force documentary still photographs, explains when photographic material may be sold or released without charge, includes a schedule of fees, and tells how fees are collected and controlled. § 811.2

Exclusion of aerial photography.

This part does not apply to the sale of aerial photography. Requests for aerial photography of foreign areas should be referred to the Office of the Assistant Secretary for Public Affairs, Department of Defense; requests for aerial photography of domestic areas should be referred to the Map Information Office, U.S. Geological Survey, Department of the Interior, Washington, D.C. 20242. § 811.3 Policy on release of photographs.

(a) Sale of photographs. Reproductions (prints and duplicate negatives) made from existing black and white negatives, duplicate color negatives and transparencies from existing counterpart color material, and ektacolor prints from existing ektacolor negatives may be sold, within the restrictions listed in this paragraph. The commander of the selling activity will insure that the purchaser understands the pertinent restrictions before photographs are released to him.

(1) The sale of photographs is discouraged. When they are sold, the number of prints sold from each negative will be limited to the minimum necessary.

(2) The following types of sales are prohibited:

(i) Prints and related photographic services that compete with commercial organizations.

(ii) Photographs not related to Air Force activities, even though they are made by Air Force photographers.

(iii) Photographs for any use which implies Air Force indorsement of a service or product, unless the buyer has obtained approval in writing from the Office of Information, Office of the Secretary of the Air Force.

(3) Each print sold will bear the official Air Force credit line as follows: "U.S. AIR FORCE PHOTO. Released by Air Force Base."

(4) Sale of prints does not include waiver of proprietary or privacy rights, unless these rights and the right of transfer belong to the Air Force.

(5) No person or persons may claim exclusive rights to official Air Force photographs.

(b) Photographs furnished without charge. Photographs required to conduct official Department of Defense business will be furnished without charge. To the extent that workload and funds permit, prints requested by the following, for use as indicated, will be furnished without charge:

(1) The general public, to further the Armed Forces' Recruiting Program or public understanding of the Armed Forces.

(2) Members of Congress, for use in official governmental activities.

(3) Nonprofit organizations carrying on functions related to, or in the interest of, public health and welfare.

(4) Members of the Armed Forces in a casualty status, or their next of kin or authorized representatives, when the photographs requested relate to the casualty source.

(5) Prints required under statutes or executive orders.

(6) All Federal agencies carrying on functions related to Air Force objectives.

(7) Occasional or infrequent incidental requests (including those from residents in foreign countries) for which fees are determined to be inappropriate. § 811.4 Who may sell photographs.

Any Air Force activity with custody of still documentary negatives and trans

parencies may sell copies as outlined in this part.

§ 811.5 Who may purchase photographs.

The following may purchase unclassified Air Force photographs:

(a) Members and agencies of the Federal Government.

(b) The public; i.e., any person or group of persons, such as associations, organizations, partnerships, corporations, businesses, municipalities, counties, States, and territorial governments. § 811.6 Schedule of fees.

Fees are established by Department of Defense as follows:

(a) Still pictorial or documentary photographic prints, black and white. Not more than three prints may be sold from any individual negative on each order. Unlisted standard sizes of black and white prints may be furnished, if available, at proportionate fees.

Air Force activities should not compete with available commercial facilities in providing special benefits or in the sale or lease of property to recipients outside the Federal Government. However, when authorized benefits are provided, the recipient of such benefits or lease or sale pays a reasonable charge as determined from instructions in §§ 812.3 and 812.4. § 812.3 Determining costs and fees for special services.

(a) Determining costs. Determine or estimate costs from the best available records in the activity; do not establish cost accounting systems solely for this purpose. The cost computation covers the direct and indirect costs incurred by the activity performing the service. This includes but is not limited to: (1) Gross civilian salaries (also including holiday, annual, sick leave entitlements), and Air Force share of retirement, medical expenses, insurance, etc.; (2) military pay and allowances at standard rates; (3) travel expense; (4) cost of fee collection

and postage; (5) material and supplies used; (6) maintenance and operation of buildings and equipment (including depreciation); (7) a prorata share of the management and supervisory costs of the activity performing the service; (8) the costs of research, establishing standards, enforcement and regulation to the extent they are properly chargeable to the services performed; (9) cost of communications, utilities, equipment, and property rental.

(b) Establishing fees to recover costs. Unless otherwise prescribed by Air Force directives, fees are established in advance when feasible under the policies and procedures of this part, unless the exceptions listed in § 812.4 apply. Establish the fee for a special service as the total cost or fair market value, whichever is higher. Review fees and rates at least once a year or whenever significant changes in costs occur, and adjust the fees to insure recovery of full costs. Charges may be waived or reduced when: (1) The recipient of the benefits is engaged in a nonprofit activity for the public safety, health, or welfare; (2) payment of the full costs or fee by the State, local government, or nonprofit group would not be in the interest of the program; (3) furnishing of the service without charge is an appropriate courtesy to a foreign country or international organization, or comparable fees are set on a reciprocal basis with a foreign country; (4) the incremental cost of collecting the fees would be an unduly large part of the receipts from the activity. § 812.4 Determining charges for lease or sale.

(a) Where federally owned resources or properties are leased or sold obtain a fair market value. Determine charges, so far as practicable and feasible in accordance with comparable commercial practices. Charges need not be limited to the recovery of costs-they may produce net revenues to the Government. The exceptions listed in this section also apply to lease or sale. In the absence of a known market value, determine a fair value for sale of material based on the inventory standard price, plus accessorial and administrative costs, provided in AFR 1725 (Reimbursement for Accessorial and Administrative Costs)...

(b) In general, charges may be waived or received when: (1) The recipient of the benefits is engaged in a nonprofit activity for the public safety, health, or welfare. (2) Payment of the full costs or fee by a State, local government, or nonprofit group would not be in the interest of the program. (3) Furnishing of the service without charge is an appropriate courtesy to a foreign country or international organization, or comparable fees are set on a reciprocal basis with a foreign country. (4) The incremental cost of collecting the fees would be unduly large part of the receipts from the activity.

This part establishes the schedule of fees to be collected by the Air Force for copying, certifying, and searching records and other documentary material. § 813.2 Policy on fees.

The Air Force collects fees for copying, certifying, and searching records and other documentary materials to make these services as self-sustaining as possible. (Services and fees are listed in § 813.10.) Requests for information and copies of records are subject to AFR 1130 (Disclosure of Unclassified Records and Use of the Term "For Official Use Only"). When the fee can be determined in advance, the activity concerned will collect it before performing the service. However, exceptions may be made for unusual requests.

§ 813.6 Services provided without charge.

Fees are not collected when requests for the following types of services are received from the sources specified: (The term "Armed Forces" includes the Air Force, Army, Navy, Marine Corps, and their civilian components.)

(a) Any service requested by members of the Armed Forces who require the document or information in their capacity as members of the Armed Forces of the United States.

(b) Any service requested by members of the Armed Forces who are in a casualty status, or by their next of kin or legal representatives; and requests for information from any source relating to a casualty.

(c) Any service requested by members (or retired members) of the Armed Forces for copies of or information from their own medical or dental records.

(d) Information from or copies of medical and dental records and/or X-ray films of patients or former patients of military medical or dental facilities. The information must be required for further medical or dental care and be requested by an accredited medical facility, physician, or dentists, or by the patient, his next of kin, or legal representative.

(e) Any service requested by members (or retired members) of the Armed Forces or their dependents for copies of or information from the dependents' medical or dental records.

(f) The address of record of an active duty member or former member of the Armed Forces of the United States when it can be furnished informally through local directory (locator) reference and is requested by:

(1) A member (or retired member) of the Armed Forces of the United States,

or

(2) A relative or legal representative of a member of the Armed Forces of the United States, or

(3) Any source when the address is required to pay money or forward

property to a member or former member of the Armed Forces of the United States,

or

(4) A custodian or manager of property owned by the member or former member who seeks to communicate with the member regarding the property.

(g) Any service requested by or on behalf of a member or former member of the Armed Forces, or, if deceased, his next of kin or legal representative, pertaining to requests for:

(1) Information required to obtain financial benefits.

(2) Document showing membership and military record in the Armed Forces, if discharge or release was under honorable conditions.

(3) Information relating to a decoration or award or information required for memorial purposes.

(4) Review or change in type of discharge or correction of records.

(5) Personal documents, e.g., birth certificates, when such documents are required to be furnished by the individual.

(h) Those services furnished free in accordance with statutes or Executive orders.

(i) Any service that relates to or furthers the Armed Forces recruiting programs and any service furnished representatives of public information media or the general public in the interest of public understanding of the Armed Forces.

(j) Any service involving confirmation of employment or salaries of active or separated civilian or military personnel when requested by prospective employers or recognized sources of inquiry for credit or financial purposes.

(k) Any service requested by and furnished to a Member of Congress for official use.

(1) Any service requested by a State, U.S. possession, county, or municipal government, or an agency thereof, which is carrying on a function that is related to or furthers the public safety, health or welfare.

(m) Any service requested by a court that will serve as a substitute for the personal court appearance of a military or civilian employee of the Department of Defense.

(n) Any service requested by a nonprofit organization which is carrying on a function that is related to or furthers
