and to maintain liaison with other government agencies and other organizations with respect to personnel matters.

(c) To make or cause to be made under his direction budget estimates, requests for apportionment, and allotments of funds; and to represent the Federal Housing Administration on budget matters with the Bureau of the Budget and other government agencies and organizations.

(d) To execute or cause to be executed under his direction all contracts for goods and services, agreements and leases for office space, and certificates of need in connection with space requirements; to approve or cause to be approved under his direction travel and transportation of household goods and personal effects; to approve or supervise the disposition of personal property, other than that acquired under insurance contracts, the issuance of orders for publication of notices and advertisements in newspapers, magazines and periodicals, and arrangements for the provision of necessary services and relocation sites for field offices in connection with civil defense activities; and to represent the Federal Housing Administration with the General Services Administration and other government agencies on administrative service matters.

(e) To take any action authorized to be taken by any division or office within his jurisdiction.

(f) To act for the Commissioner in approving the settlement of tort claims for and against the Commissioner and the execution of releases or other instruments required in connection therewith.

(g) To act with the Commissioner and under his direction in the determination of basic policy and be a member of the Executive Board.

(h) To develop, review, evaluate, and recommend organizational structure, delegations of authority, and distribution of functions.

(i) To administer FHA's defense planning and emergency housing activities and oversee the discharge of FHA's delegated responsibilities in these matters as outlined by executive order.

nel and under his general supervision to the position of Deputy Director of Personnel there is delegated the following basic authority and functions:

(a) To be responsible for the development, establishment and operation of a comprehensive personnel program, including employment, selection and placement, standards, position classification, employee relations, training and incentive awards.

(b) To make appointments, promotions, demotions, transfers and reassignments of personnel, and to remove or separate personnel; to fix the administrative work week; to approve overtime work, and to prescribe rules and regulations regarding overtime.

(c) To represent the Federal Housing Administration with the Civil Service Commission and with other government agencies and organizations with respect to personnel matters.

§ 200.70 Director of the Budget Division and Deputy.

To the position of Director of the Budget Division and under his general supervision to the position of Deputy Director of the Budget Division there is delegated the following basic authority and functions:

(a) To direct all budget activities of the Federal Housing Administration and to represent the Federal Housing Administration in budget matters with the Bureau of the Budget and with other government agencies and organizations.

(b) To be responsible for the development and execution of the budget program, including the preparation of budget estimates and justification therefor; the preparation of requests for apportionment of funds and justification therefor; and the allotment of funds within the limits of appropriation acts, apportionments and other limitations. § 200.71

Director of the General Services Division and Deputy.

To the position of Director of the General Services Division and under his general supervision to the position of Deputy Director of the General Services Division, and with respect to paragraphs (b) and (h) of this section to the position of Chief of the Procurement and Property Section there is delegated the following basic authority and functions:

(a) To be responsible for a program of general services, including contracting and procurement, rental and assignment

office space, telecommunications, printing and publication, administrative property control, mail and messenger, stenographic pool, travel service and library.

(b) To execute all contracts, incur obligations, and authorize expenditures for services and procurement, including broker contracts, contracts for performance on a fee basis of technical or professional consulting services and contracts for materials, equipment and services for the maintenance and operation of acquired properties.

(c) To execute all agreements for office space and collateral services throughout the United States, to obligate the Federal Housing Administration for the payment of rents and charges in connection therewith, and to negotiate and execute lease agreements for the field office space and services beyond the continental limits of the United States.

(d) To represent the Federal Housing Administration and maintain liaison with the General Services Administration and other Government agencies in all general services matters.

(e) To execute Certificates of Need in connection with space requirements in Federal Lease-Purchase projects.

(f) To issue travel orders and to authorize or approve transportation of household goods and personal effects.

(g) To dispose of personal property of the Federal Housing Administration other than that acquired under insurance contracts.

(h) To issue orders for publication of notices and advertisements in newspapers, magazines and periodicals.

(i) To provide logistic, communications and other necessary services. Issues necessary Civil Defense identification for Headquarters and Field. Approves emergency relocation sites for Field Offices.

(j) To act for the Commissioner in approving the settlement of tort claims for and against the Commissioner and the execution of releases or other instruments required in connection therewith. (a) To direct comprehensive management engineering surveys of Washington and field operations and activities for the purpose of improving the efficiency, economy and effectiveness of operations and to develop specific recommendations for the accomplishment of these purposes.

(b) To assist in the development of the detailed plans and procedures for carrying out approved recommendations.

(c) To assist in, and to coordinate, the installation of approved recom

mendations.

(d) To evaluate the results of approved recommendations.

(e) To direct a comprehensive forms and records management program.

§ 200.73 Director, Audit and Examination.

To the position of Director, Audit and Examination, there is delegated the following basic authority and functions:

(a) To be responsible for the coordination and general supervision of the Audit Division, the Examination Division, and the Mortgagee Approval Section comprising the following functions:

(1) The maintenance of a continuing program, comprehensive fiscal audit both internal and external, including audit of mortgagees, mortgagors, and rental brokers for the purpose of providing the Commissioner with continuing assurance of the soundness and integrity of operations; conformity with applicable laws, regulations, policies, standards, and procedures;

(2) The maintenance of a continuing independent check on operations of the Federal Housing Administration for adherence to statutory and regulatory requirements and established procedures, policies, standards and management practices; the evaluation of attainment of objectives;

(3) The recommendation of investigation and action by responsible authorities in cases of suspected violation of statutes or contract terms.

(4) Review and recommendation to the Assistant Commissioner for Home Mortgages of approval, disapproval, or cancellation of approval of financial institutions as approved mortgagees and of firms or individuals as authorized agents for approved mortgagees.

§ 200.74 Auditor and Deputy.

To the position of Auditor and under his general supervision to the position of Deputy Auditor there is delegated the following basic authority and functions

(a) To be responsible for a continuing audit of the fiscal accounts of the Administration, including the fiscal accounts of the field offices, and the accounts of approved mortgagees not under governmental supervision, to determine compliance with the supervision requirements of the administrative regulations.

(b) To conduct audits of mortgagees and mortgagors participating in the insurance programs of the Administration, including on-site examination of fiscal records and accounts of such mortgagees and mortgagors.

(c) To conduct audits of the accounts and records of rental brokers including on-site audits and examinations of such accounts and records, to effect compliance with the fiscal and administrative requirements of the Administration. $ 200.75 Director of the Examination Division and Deputy.

To the position of Director of the Examination Division and under his general supervision to the position of Deputy Director of the Examination Division there is delegated the following basic authority and functions:

(a) To conduct comprehensive peri odic and special examinations of FHA operations and activities, except those of a fiscal and financial character, for adherence to statutory and regulatory requirements, established procedures, standards, and management practices; and to evaluate and report on compliance with requirements and attainment of objectives.

(b) To develop recommendations for further investigations by appropriate authorities in cases of suspected violations of existing statutes, regulatory requirements, or contract terms.

§ 200.77 Assistant Commissioner-Comptroller and Deputy.

To the position of Assistant Commissioner-Comptroller, and under his general supervision to the position of Deputy Assistant Commissioner-Comptroller, there is delegated the following basic authority and functions:

(a) To be responsible for coordination and general supervision of the Procedures Branch, the Financial Reports Branch, the Accounting Branch, the Data Processing Branch, the Insurance Branch, and the Fiscal Branch.

(b) To act with the Commissioner and under his direction in the determination of basic policy and be a member of the Executive Board.

(c) To devise and establish insurance fiscal servicing, accounting and fiscal procedures and to administer the fiscal policies and activities of FHA; and to provide or cause to be provided under his direction technical advice and guidance to all organizational elements of the FHA in the fields of accounting, electronic data processing, insurance fiscal servicing and fiscal matters.

(d) To be responsible for the establishment and maintenance of appropriate accounting, fiscal and mortgage insurance controls and for the safeguarding of cash, notes, mortgages, negotiable instruments, checks, securities, debentures, contracts and properties.

(e) To develop and recommend policies, rules and procedures governing the settlement of Title I claims.

(f) To exercise the authority of the Commissioner in any instance which is subject to the approval of the Commissioner in connection with the settlement of claims under section 2 of Title I of the National Housing Act.

(g) To direct and supervise periodic portfolio examinations of institutions insured under the provisions of section 2 of Title I of the National Housing Act.

(h) (1) To submit to the Treasury Department authorizations for:

(1) Investment of moneys held in the various insurance funds, not needed for the current operations of the FHA, in bonds or other obligations of the United States, or in bonds or other obligations guaranteed as to principal and interest by the United States, and

(ii) The redemption or sale of investments in bonds or other obligations of the United States, or in bonds or other

obligations guaranteed as to principal and interest by the United States, representing undisbursed mortgage proceeds relating to multifamily mortgages assigned to the Commissioner; and

(2) To recommend liquidation of investments and redemption of debentures, to execute assignments in connection with the redemption of debentures held for the account of the insurance funds of the FHA, and to maintain liaison with the Treasury Department in the execution of fiscal proposals.

(i) To certify financial statements, and to execute and submit or to cause to be executed and submitted under his direction to the Treasury Department and/or to the Bureau of the Budget inter-governmental financial reports required by applicable statutes or regulations of the Treasury Department or Bureau of the Budget.

(j) To designate certifying officers and to revoke such designation, to execute and submit to the Treasury Department necessary statements and schedules with respect thereto, and perform all functions pertaining to the bonding of FHA employees, pursuant to applicable statutes, regulations, and the standards and procedures of the Secretary of the Treasury thereunder.

(k) To submit or cause to be submitted under his direction to the Treasury Department (1) authorizations for (i) purchase of U.S. Government securities, pursuant to agreements between mortgagors or other depositors and FHA and (ii) sale and disposition of U.S. Government securities purchased for mortgagors or other depositors, received as a result of assignment of insured mortgages or as a result of other agreements; (2) for safekeeping, U.S. Government securities deposited in accordance with mortgagor corporate charters, regulatory or special agreements; and (3) requests for withdrawal of U.S. Government securities.

(1) To provide or cause to be provided under his direction an integrated electronic data processing service to all organizational elements of the FHA including consultative and advisory services relating to surveying, programming and cost analysis of proposed conversions to such processing.

(m) To develop and maintain or cause to be developed and maintained under his direction a program for the

fiscal servicing of all Commissioner-held home and project mortgages; to execute or cause to be executed under his direction all vouchers for expenditures from mortgagor's escrow accounts, for payment of taxes on home and project properties where title is vested in the Commissioner and, with respect to home properties acquired by the Commissioner, vouchers for payment of excess proceeds to effect final settlement on certificates of claim; and to execute and receipt or cause to be executed and receipted under his direction applications and receipts for any payments received representing refunds of taxes or other payments made by the Commissioner in connection with property acquired by the Commissioner under the provisions of the National Housing Act.

(n) To keep or cause to be kept under his direction the seal of the Administration and to employ the seal in the execution of Certificates of Claim issued to mortgagees; to certify as to delegations of authority by the Commissioner, and as to the truth or accuracy of copies of original papers or documents in the possession of FHA; to prepare and execute notarized affidavits for the use of U.S. Attorneys in presenting the fiscal status of Commissioner-held mortgages at foreclosure trials; and to maintain the Archives files of FHA.

(0) To recommend (1) the terms and conditions under which FHA offers to sell purchase money mortgages and assigned mortgage notes to approved mortgagees, (2) upon approval of the recommendation makes offers for the sale of such mortgages and assigned notes, and (3) executes in the name of the Commissioner acceptance of such offers.

(p) To endorse or cause to be endorsed under his direction mortgage notes for insurance; to take or cause to be taken under his direction any action necessary to consummate the sale of Commissioner-held mortgages to purchasers of such mortgages; and to execute satisfactions of Commissioner-held mortgages when the mortgage indebtedness has been paid in full.

(q) To endorse checks or other negotiable instruments for deposit or collection and loss drafts relating to insurance coverage on Commissioner-held home and project mortgages.

(r) To approve or cause to be approved under his direction all expendi

tures and to receipt or cause to be receipted under his direction all vouchers necessary to carry out the provisions of the National Housing Act.

(s) To certify or cause to be certified under his direction that all required documents, information and approvals respecting each transaction are present; verify or cause to be verified under his direction the accuracy of the computations, the consistency of the information included in the various documents and determine or cause to be determined under his direction that the transactions are in strict accordance with all applicable regulations, decisions and laws. (t) To approve or disapprove or cause to be approved or disapproved under his direction amounts claimed by mortgagees in their claim for insurance benefits, including amounts claimed for operating, protecting and preserving properties prior to conveyance to the Commissioner; to execute or cause to be executed under his direction Certificates of Claim and certify or cause to be certified under his direction the requisitions to the Treasury Department for the issuance of debentures; to certify or cause to be certified under his direction vouchers for cash settlement of claims; and to approve or disapprove the purchase of debentures submitted by mortgagees in connection with mortgage insurance premiums.

(u) To extend or cause to be extended under his direction the period of time for submission of fiscal data or title evidence supporting a mortgagee's application for debentures.

(v) To maintain or cause to be maintained under his direction liaison with the General Accounting Office, Treasury Department and other agencies of the Government on accounting, insurance fiscal servicing and fiscal matters and to collaborate with such departments and agencies in the formation of accounting and fiscal programs.

(w) To issue duplicate Mortgage Insurance Certificates, to cancel or cause to be cancelled under his direction insurance endorsement or the Mortgage Insurance Certificate on insured mortgages where a joint request for termination is made by the mortgagor and mortgagee, or when the insurance endorsement or the Mortgage Insurance Certificate is otherwise to be cancelled, and to exercise the authority of the Commissioner in any instance which is subject

to the approval of the Commissioner in connection with the prepayment or voluntary termination of insured mortgages.

(x) To take any action authorized to be taken by any branch or office within his jurisdiction.

(y) To exercise the authority of the Commissioner to endorse any preferred stock certificate held by him in any corporation for the purpose of retirement and cancellation.

§ 200.78 Accounts Officer and Deputy.

To the position of Accounts Officer, and under his general supervision to the position of Deputy Accounts Officer, there is delegated the following basic authority and functions:

(a) To direct the activities of the Accounting Branch.

(b) To devise and establish accounting procedures and policies and to maintain official accounting records for all activities of the Administration.

(c) To devise and establish procedures and policies and to maintain official records for all home properties and mortgages held by the Commissioner.

(d) To provide technical advice and guidance to all organizational elements of the Administration in the fields of accounting, including property and mortgage servicing accounting.

(e) To maintain liaison with the General Accounting Office, Treasury Department and other agencies of the Government on accounting matters and to collaborate with such departments and agencies in the formation of accounting programs.

(f) To maintain liaison with the Federal National Mortgage Association, its regional offices and servicers, and other Government agencies on matters pertaining to the sale and insurance of Commissioner-held mortgages.

(g) To endorse mortgage notes for insurance and to take any action necessary to consummate the sale of Commissioner-held mortgages to purchasers of such mortgages.

(h) To develop and maintain a program for the fiscal servicing of Commissioner-held home mortgages includ
