SEC. 6. Sections 531, 532(a)(2), 534(a)(2), and 536(a) of title 38, United States Code, are each amended by striking out "$65" and inserting in lieu thereof in each such section "$70”.

PENSION INCREASES FOR CHILDREN OF DECEASED VETERANS OF WORLD WAR I, WORLD WAR II, AND THE KOREAN CONFLICT

SEC. 8. Subsection (a) of section 542 of title 38, United States Code, is amended by striking out "$38" and "$15" and inserting in lieu thereof "$40" and "$16", respectively

AID AND ATTENDANCE ALLOWANCE FOR WIDOWS OF VETERANS OF ALL PERIODS OF WAR:

SEC. 9. (a) Subchapter III of chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following new section:

"WIDOWS OF VETERANS OF ALL PERIODS OF WAR

"S 544. Aid and attendance allowance

"If any widow who is entitled to pension under this subchapter is in need of regular aid and attendance, the monthly rate of pension payable to her under this subchapter or such provisions, as the case may be, shall be increased by $50.” (b) The analysis of such subchapter III, after the heading of such chapter, is amended by adding at the end thereof the following:

"WIDOWS OF VETERANS OF ALL PERIODS OF WAR

"544. Aid and attendance allowance."

THERAPEUTIC AND REHABILITATIVE DEVICES FOR CERTAIN VETERANS

SEC. 10. Subsection (b) of section 617 of title 38, United States Code, is amended by striking out "to any veteran" and all that follows through the end thereof and inserting in lieu thereof the following: "to any veteran in receipt of pension under chapter 15 of this title based on need of regular aid and attendance."

EFFECTIVE DATE

SEC. 11. This Act shall take effect on January 1, 1967.

A BILL To amend title 38 of the United States Code to provide a special pension for veterans of World War I and their widows

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following new subchapter: "Subchapter V.-Special Pensions for World War I Veterans and Their Widows "8 571. Definitions

"For the purposes of this subchapter

"(1) The term 'World War I' means the period beginning on April 6, 1917, and ending on September 1, 1919.

"(2) The term 'eligible veteran of World War I' means a veteran who served for a period of ninety or more days during World War I, was honorably discharged or released from such service, and is not entitled to retired pay, retainer pay, or disability retired pay arising from service in the Armed Forces.

"572. Special pensions for eligible veterans of World War I

"(a) The Administrator shall pay to each eligible veteran of World War I a special pension at a monthly rate not exceeding $150 which shall be determined by multiplying $5 by the number of months such veteran served within the continental limits of the United States and adding to such product the product of $10 and the number of months such veteran served outside the continental limits of the United States.

"(b) For the purposes of this section

"(1) if service was performed outside of the continental limits of the United States in any month, all service performed during such month shall be deemed to have been performed outside the United States; and

"(2) any fraction of a month of service shall be deemed to be a full month of service.

"573. Special pensions for widows of eligible veterans of World War I

"The administrator shall pay to the widow of each eligible veteran of World War I who was married for five years or more before the death of a veteran

a special pension equal to one-half the monthly rate of pension to which such veteran would have been entitled under section 572."

Sec. 2. (a) Section 501 of title 38, United States Code, is amended by striking out "For the purposes of this chapter" and inserting in lieu thereof "For the purposes of subchapter I through IV of this chapter".

(b) The table of sections of chapter 15, title 38, United States Code, is amended by adding at the end thereof the following:

"SUBCHAPTER V-SPECIAL PENSIONS FOR WORLD WAR I VETERANS AND THEIR WIDOWS "571. Definitions.

"572. Special pensions for eligible veterans of World War I.

"573. Special pensions for widows of eligible veterans of World War I."

SEC. 3. The amendments made by this Act shall take effect on the first day of the first month which begins more than thirty days after the date of enactment of this Act.

A BILL To amend title 38 of the United States Code to authorize the Administrator of Veterans' Affairs to bring certain pensioners under the provisions of chapter 15 of that title (as now in effect) if it would be in their interest to do so

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) subchapter I of chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following new section:

"§ 508. Applicable pension law

"(a) (1) The Administrator shall from time to time review the case of each person who is receiving pension under the provisions of this chapter, as in effect on June 30, 1960 (hereafter in this section referred to as the 'old pension law'), pursuant to the provisions of section 9 of the Veterans' Pension Act of 1959 (Public Law 86-211). If the Administrator determines on the basis of such a review that (1) any person would be entitled to a greater pension under the provisions of this chapter (as now in effect) than he is receiving under the old pension law, and (2) that to bring such person under the provisions of this chapter (as now in effect) would not adversely affect such person in any way, the Administrator shall notify such person that he will be brought under the provisions of this chapter (as now in effect) unless such person notifies the Administrator in writing that he does not wish to be brought under the provisions of this chapter (as now in effect).

"(2) Unless the Administrator is notified in writing that such person does not wish to be brought under the provisions of this chapter (as now in effect) by any such person within thirty days after the date on which notice provided for in paragraph (1) of this subsection is sent to him by the Administrator, the Administrator shall treat such person as being subject to the provisions of this chapter beginning with the first day of the first calendar month which begins ninety days or more after the date on which such notice was sent to him under this section by the Administrator.

"(b) If at any time any person brought under the provisions of this chapter (as now in effect) as provided in this section becomes ineligible for a pension under this chapter (as now in effect) or is only eligible for a smaller pension under this chapter (as now in effect) than that to which he would have been entitled to under the old pension law, such person shall from such time be eligible to receive pension under the old pension law, if he would have continued to be, and is, eligible to receive pension under the old pension law, but for having been brought under the provisions of this chapter (as now in effect) under the provisions of this section."

(b) The analysis of subchapter I of chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following:

"508. Applicable pension law."

SEC. 2. The second sentence of section 9(b) of the Veterans' Pension Act of 1959 (Public Law 86-211) is amended by striking out "This subsection" and inserting in lieu thereof "Except as provided in section 508 of title 38, United States Code, this subsection".

A BILL To amend section 3203 of title 38, United States Code, to provide that veterans entitled to pension who are being maintained in State homes shall receive pension at the rate of $30 per month

Be at enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 3203(d) (1) of title 38, United States Code, is amended (1) by inserting immediately after "Veterans' Administration" the following: "or in a State home (including the United States Soldiers' Home in the District of Columbia and the Naval Home in Philadelphia, Pennsylvania)"; and (2) by adding at the end thereof the following: "The provisions of the preceding sentence which provide for reduction of pension payable to veterans who are in a State home shall apply with respect to pension payable by reason of section 9 of the Veterans' Pension Act of 1959."

A BILL To amend title 38 of the United States Code to increase the rates of pension payable to widows of veterans of the Spanish-American War

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That subsection (a) of section 536 of title 38, United States Code, is amended to read as follows:

"(a) The Administrator shall pay to the widow of each Spanish-American War veteran who met the service requirements of section 512(a) of this title a pension at the monthly rate of $85."

SEC. 2. The amendments made by this Act shall take effect on the first day of the calendar month which begins more than thirty days after the date of enactment of this Act.

A BILL To amend title 38 of the United States Code to provide a paraplegia rehabilitation allowance of $100 per month for veterans of World War I, World War II, or the Korean conflict

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That subsection (d) of section 521 of title 38, United States Code, is amended by inserting "(1)" immediately after "(d)” and by adding at the end thereof the following new paragraph:

"(2) If the veteran is a paraplegic, the Administrator shall pay to such veteran a paraplegia rehabilitation allowance at the rate of $100 per month which shall be in addition to amounts otherwise payable to such veteran under this section."

SEC. 2. The amendments made by this Act shall take effect on the first day of the first calendar month which begins more than thirty days after the date of enactment of this Act.

A BILL To amend title 38 of the United States Code so as to increase the rates of pension payable to certain veterans and their widows, to provide readjustment assistance for veterans of the Vietnam era, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SHORT TITLE

SECTION 1. This Act may be cited as the "Veterans' Pension and Vietnam Era Veterans Readjustment Assistance Act of 1967".

TITLE I-PENSION BENEFITS

ENLARGING WIDOWS' ELIGIBILITY FOR BENEFITS

SEC. 101. (a) Paragraphs (2) and (3) of sections 302 (a), 404, 532(d), 534 (c), 536 (c), and 541(e), title 38, United States Code, are amended to read as follows:

"(2) for one year or more; or

"(3) for any period of time if a child was born of the marriage, or was born to them before the marriage.".

(b) Subsection 103(a), title 38, United States Code, is amended by striking out "cohabitated with him for five or more years immediately before his death," and inserting in lieu thereof "cohabitated with him for one year or more immediately before his death, or for any period of time if a child was born of the purported marriage or was born to them before such marriage,”.

PERMANENT AND TOTAL DISABILITY AT AGE SIXTY-FIVE; AID AND ATTENDANCE ALLOWANCE FOR PERSONS IN NURSING HOMES

SEC. 102. (a) Subsection (a) of section 502 of title 38, United States Code, is amended by inserting immediately after "disabled if he is" the following: "sixty-five years of age or older or".

(b) Subsection (b) of such section 502 is amended by inserting "(1) a patient in a nursing home or (2)" immediately after "if he is".

EXCLUSION FROM ANNUAL INCOME

SEC. 103. (a) Paragraph (7) of section 503 of title 38, United States Code, is amended by inserting immediately after "amounts paid by" the following: "a wife of a veteran for the expenses of his last illness, and by".

(b) Paragraph (9) of such section 503 is amended by inserting "(A)" immediately after "amounts paid” and by inserting the following immediately before the semicolon at the end thereof: "or (B) by a widow or a wife of a deceased veteran for the last illness and burial of a child of such veteran".

SEC. 104. (a) (1) Effective on the first day of the second calendar month which begins after the date of enactment of this Act, the table in subsection (b) of section 521 of title 38, United States Code, is amended to appear as follows:
