A BILL To amend title 38, United States Code, to provide for the payment of pensions to veterans of World War I

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That this Act may be cited as the "World War I Pension Act of 1960".

SEC. 2. Chapter 15 of title 38, United States Code, is amended by inserting immediately below section 512 thereof the following new section:

"§ 513. Veterans of World War I

"(a) The Administrator shall pay to each veteran of World War I who meets the service requirements of this section a pension at the monthly rate of $100. "(b) For the purposes of this section

"(1) The term 'veteran' means an individual who served in the active military, naval, or air service and who was discharged or released therefrom under conditions other than dishonorable.

"(2) The term 'World War I' (A) means the period beginning on April 6, 1917, and ending on November 11, 1918, (B) in the case of any veteran who served with the United States military forces in Russia, means the period beginning on April 6, 1917, and ending on April 1, 1920, and (C) includes, in the case of anyveteran, any period of service performed by him after November 11, 1918, and before July 2, 1921, if such veteran served in the active military, naval, or air service after April 5, 1917, and before November 12, 1918.

"(c) Pension shall be paid to a veteran under this section without regard to his annual income, whether derived from payments of social security benefits, railroad retirement benefits, pensions, annuities, or otherwise.

(d) A veteran meets the service requirements of this section if he served in the active military, naval, or air service

"(1) for ninety days or more during World War I ;

"(2) during World War I and was discharged or released from such service for a service-connected disability; or

"(3) for a period of ninety consecutive days or more and such period ended during World War I."

SEC. 3. The analysis of chapter 15 of title 38, United States Code, is amended by inserting immediately below

512. Spanish-American War veterans."

A BILL To amend title 38 of the United States Code so as to provide that public or private retirement, annuity, or endowment payments (including monthly social security insurance benefits) shall not be included in computing annual income for the purpose of determining eligibility for a pension under chapter 15 of that title

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 503 of title 38, United States Code, is amended by striking out ", retirement or annuity payments, or similar income," and inserting in lieu thereof "or similar income", and by striking out, in paragraph (6) thereof, "10 per centum of the amount of".

SEC. 2. The amendments made by this Act shall be effective for calendar years beginning after December 31, 1966.

A BILL To amend title 38 of the United States Code to provide for a pension of $75 per month for widows of veterans of World War I

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That subchapter III of chapter 15 of title 38, United States Code, is amended by inserting immediately after section 537 the following:

"WORLD WAR I

"§ 539. Widows of World War I veterans

"(a) Subject to the provisions of subsection (b), the Administrator shall pay to the widow of each veteran of World War I a pension at the monthly rate of $75.

"(b) No pension shall be paid to a widow of a veteran of World War I under this section unless she was married to him

"(1) before December 14, 1944;

"(2) for five or more years; or

"(3) for any period of time if a child was born of the marriage."

SEC. 2. (a) The heading of section 541 of title 38, United States Code, is amended by striking out "World War I, World War II," and inserting in lieu thereof "World War II".

(b) Subsection (a) of such section 541 is amended by striking out "World War I, World War II," and inserting in lieu thereof "World War II".

(c) Clause (1) of subsection (e) of such section 541 is amended to read as follows:

"(1) before (A) January 1, 1957, in the case of a widow of a World War II veteran or (B) February 1, 1965, in the case of a widow of a Korean conflict veteran; or".

SEC. 3. (a) The table of sections of chapter 15 of title 38, United States Code, is amended by inserting immediately below

"537. Children of Spanish-American War veterans."

(b) Such table is further amended by striking out "541. Widows of World War I, World War II," and inserting in lieu thereof "541. Widows of World War II”. SEC. 4. (a) The amendments made by this Act shall take effect on the first day of the first calendar month which begins more than sixty days after the date of enactment of this Act.

(b) Nothing in this Act shall affect the eligibility of any widow receiving pension under title 38, United States Code, or under section 9 of the Veterans Pension Act of 1959, on the effective date of this Act for pension under all applicable provisions of that title or section (as the case may be) in effect on that date, for such period or periods thereafter with respect to which she can qualify under such provisions. This subsection shall not apply in any case for any period after pension is granted under section 539 of title 38, United States Code, as added by this Act.

A BILL To amend title 38 of the United States Code so as to provide that monthly social security benefit payments shall not be included as income for the purpose of determining eligibility for a pension under title 38

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That paragraph (5) of section 503 of title 38, United States Code, is amended by inserting “and monthly benefit payments" immediately after "lump sum death payments".

SEC. 2. The amendment made by the first section of this Act shall be effective for years beginning after December 31, 1966.

A BILL To provide that where the entitlement of a veteran, widow, or child to a pension from the Veterans' Administration is based upon the veteran's having served in World War I, the beneficiary shall if otherwise eligible have the right to elect payment of pension under either the provisions of title 38 as in effect on June 30, 1960, or as amended by the Veterans' Pension Act of 1959, whichever provides the greater benefit

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 9 of the Veterans' Pension Act of 1959 is amended

(1) by striking out the first word of the last sentence of subsection (b) and inserting in lieu thereof "Except as provided for in subsection (d) of this section, this"; and

(2) by adding at the end thereof the following new subsection:

"(d) Notwithstanding the provision of subsections (a), (b), and (c) of this section, a person whose claim for pension is based on service in World War I shall, upon application filed either before or after the effective date of this Act, be entitled to be paid pension under either the provisions of title 38 in effect on June 30, 1960, or as amended by this Act, whichever provides the greater benefit. An election on the part of such a person to receive payment under the provisions of one such law shall not prejudice his right to thereafter elect payment under the other."

SEC. 2. The provisions of this Act shall be effective as of July 1, 1960.

A BILL To amend title 38 of the United States Code to exclude from income pension and annuity payments under the Railroad Retirement Act of 1937 for the purpose of determining eligibility for a veteran's pension under chapter 15 of that title

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 503 of title 38, United States Code, is amended (1) by inserting "(other than payments referred to in paragraph (14))” immediately after "amount of payment"; (2) by striking out the period at the end of paragraph (13) and inserting in lieu thereof “; and"; and (3) by adding at the end thereof the following:

"(14) pension or annuity payments to an individual under the Railroad Retirement Act of 1937."

SEC. 2. The amendments made by the first section of this Act shall take effect on January 1, 1967.

A BILL To amend title 38 of the United States Code to provide that veterans of any period of war and their widows on attaining age sixty-five shall be entitled to pensions at the monthly rate of $101.59; and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) sections 506, 522, and 543 of chapter 15 of title 38, United States Code, are repealed.

(b) The analysis of such chapter 15 is amended by striking out

"506. Resource reports and overpayment adjustment."; and

"522. Net worth limitation."; and

"543. Net worth limitation."

SEC. 2. (a) Subchapter II of chapter 15 of title 38, United States Code, is amended by adding at the end thereof the following:

"PENSION AT AGE SIXTY-FIVE

"§ 524. Veterans of World War I, World War II, or the Korean conflict

"The Administrator shall pay to each veteran of World War I, World War II, or the Korean conflict who meets the service requirements of section 521 (g) and who is sixty-five years of age or older, a pension at the monthly rate of $101.59. If a veteran is entitled to a pension under this section and section 521 or to compensation for a service-connected disability, the Administrator shall pay to such veteran the greater benefit."

(b) The analysis of such chapter 15 is amended by inserting immediately below

"523. Combination of ratings."

"524. Veterans of World War I, World War II, or the Korean conflict."

SEC. 3. (a) Section 532(a) of title 38, United States Code, is amended by striking out "(1)" and all that follows, and inserting in lieu thereof the following:

"(1) $75, if she is below sixty-five years of age; or
"(2) $101.59, if she is sixty-five years of age or older."

(b) Section 534 (a) of such title 38 is amended by striking out "(1)" and all that follows, and inserting in lieu thereof the following:

"(1) $75, if she is below sixty-five years of age; or
"(2) $101.59, if she is sixty-five years of age or older."

(c) Section 536(a) of such title 38 is amended by striking out "(1)” and all that follows, and inserting in lieu thereof the following:

"(1) $75, if she is below sixty-five years of age; or

“(2) $101.59, if she is sixty-five years of age or older."

SEC. 4. The amendments made by this Act shall take effect on the first day of the first calendar month which begins after the date of enactment of this Act.

A BILL To amend section 503 of title 38 of the United States Code to exclude from consideration as income, for the purpose of determining eligibility for pension, all amounts paid to an individual under public or private retirement, annuity, endowment, or similar type plans or programs

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 503 (6) of title 38, United States Code, is amended to read as follows:

"(6) the amount of all payments to an individual under public or private retirement, annuity, endowment, or similar plans or programs;".

SEC. 2. In computing the income of persons whose pension eligibility is subject to the first sentence of section 9(b) of the Veterans' Pension Act of 1959, there shall be excluded the amount of all payments received under public or private retirement, annuity, endowment, or similar plans or programs.

A BILL To amend section 501 of title 38, United States Code, to provide that active military service on the Mexican border before World War I by persons who performed active service during World War I shall be included in determining eligibility of World War I veterans, their widows, and children for pension

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That section 501(2) of title 38, United States Code, is amended by inserting "(A)" immediately before "includes", and by inserting immediately before the period at the end thereof the following: “; and (B) in the case of any veteran who served in the active military or naval service on the Mexican border in 1916 or 1917 pursuant to the calls of the President of May 9, 1916, and June 18, 1916, and who served in the active military or naval service after April 5, 1917, and before November 12, 1918, includes the period of such service on the Mexican border".

A BILL To amend title 38 of the United States Code in order to increase the amount of the spouse's income which may be excluded in determining a veteran's annual income for determining his eligibility for pension

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That effective for years beginning after December 31, 1966, section 521(f) (1) of title 38, United States Code, is amended by striking out "$1,200" and inserting in lieu thereof "$3,600".

A BILL To amend title 38 of the United States Code to increase by 10 per centum the amount of retirement, annuity, and endowment payments excluded from income for the purpose of determining the eligibility of an individual for pension under that title, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) paragraph (6) of section 503 of title 38, United States Code, is amended by striking out "10" and inserting in lieu thereof "20".

(b) The amendment made by subsection (a) shall not apply to any person receiving pension on December 31, 1964, under chapter 15 of title 38, United States Code, or subsequently determined to be entitled to such pension for such date, until his contributions have been recouped under the provisions of paragraph (6) of section 503 of such title as in effect on such date.

SEC. 2. In computing the income of persons whose pension eligibility is subject to the first sentence of section 9(b) of the Veterans' Pension Act of 1959, there shall be excluded 20 per centum of the amount of payments received under public or private retirement, annuity, endowment, or similar plans or programs. SEC. 3. This Act and the amendments made by it shall, when enacted, become effective as of January 1, 1967.

A BILL To amend title 38 of the United States Code so as to increase the rates of pension payable to certain veterans and their widows, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SHORT TITLE

SECTION 1. This Act may be cited as the "Veterans' Pension Act of 1967."

ENLARGING WIDOWS' ELIGIBILITY FOR BENEFITS

SEC. 2. (a) Paragraphs (2) and (3) of sections 302(a), 404, 532(d), 534(c), 536 (c), and 541(e), title 38, United States Code, are amended to read as follows:

"(2) for one year or more; or

"(3) for any period of time if a child was born of the marriage, or was born to them before the marriage.".

(b) Subsection 103 (a), title 38, United States Code, is amended by striking out "cohabitated with him for five or more years immediately before his death," and inserting in lieu thereof "cohabited with him for one year or more immediately before his death, or for any period of time if a child was born of the purported marriage or was born to them before such marriage,”.

PERMANENT AND TOTAL DISABILITY AT AGE SIXTY-FIVE; AID AND ATTENDANCE ALLOWANCE FOR PERSONS IN NURSING HOMES

SEC. 3. (a) Subsection (a) of section 502 of title 38, United States Code, is amended by inserting immediately after "disabled if he is" the following: "sixtyfive years of age or older or".

(b) Subsection (b) of such section 502 is amended by inserting “(1) a patient in a nursing home or (2)" immediately after "if he is".

EXCLUSIONS FROM ANNUAL INCOME

SEC. 4. (a) Paragraph (7) of section 503 of title 38, United States Code, is amended by inserting immediately after "amounts paid by" the following: "a wife of a veteran for the expenses of his last illness, and by".

(b) Paragraph (9) of such section 503 is amended by inserting “(A)" immediately after "amounts paid" and by inserting the following immediately before the semicolon at the end thereof: "or (B) by a widow or a wife of a deceased veteran for the last illness and burial of a child of such veteran".

SEC. 5. (a) The table in subsection (b) of section 521 of title 38, United States Code, is amended to appear as follows:
