(b) The table of sections of chapter 15, title 38, United States Code, is amended by adding at the end thereof the following:

SEC. 3. The amendments made by this Act shall take effect on the first day of the first month which begins more than thirty days after the date of enactment of this Act.

PENSION INCREASES FOR VETERANS OF WORLD WAR I, WORLD WAR II, AND THE KOREAN CONFLICT

SEC. 2. (a) The table in subsection (b) of section 521 of title 38, United States Code, is amended to appear as follows:

(c) Subsection (e) of such section 521 is amended by striking out "$35" and inserting in lieu thereof "$40".

SEC. 3. Sections 531, 532(a)(2), 534(a)(2), and 536 (a) of title 38, United States Code, are each amended by striking out "$65" and inserting in lieu thereof in each such section "69".

SEC. 4. (a) The table in subsection (b) of section 541 of title 38, United States Code, is amended to appear as follows:

(c) Subsection (d) of such section 541 is amended by striking out “$15” and inserting in lieu thereof "$16".

PENSION INCREASES FOR CHILDREN OF DECEASED VETERANS OF WORLD WAR I, WORLD WAR II, AND THE KOREAN CONFLICT

SEC. 5. Subsection (a) of section 542 of title 38, United States Code, is amended by striking out "$38" and "$15" and inserting in lieu thereof "$40” and “$16”, respectively.

WAIVER OF FEDERAL RETIREMENT BENEFIT INCREASES FOR PENSION PURPOSES

SEC. 6. (a) Section 503 of title 38, United States Code, is amended by substituting a semicolon for the period at the end of paragraph (13) and adding the following new paragraph:

"(14) all or any portion of any future increase in benefits under any Federal retirement program as may be waived by any person entitled to such a retirement benefit and pension under this chapter for the month (or any portion thereof) in which any such increase is enacted. The department or agency administering the retirement program concerned shall, for the purpose of this provision, give due recognition and effect to any request for such a waiver."

(b) In computing the income of persons whose pension eligibility is subject to the first sentence of section 9 (b) of the Veterans' Pension Act of 1959, there shall be excluded all or any portion of any future increase in benefits under any Federal retirement program as may be waived by any person entitled to such a retirement benefit and pension under this chapter for the month (or any portion thereof) in which any such increase is enacted. The department or agency administering the retirement program concerned shall, for the purpose of this provision, give due recognition and effect to any request for such a waiver.

EFFECTIVE DATE

SEC. 7. This Act shall become effective on July 1, 1967.

A BILL To amend title 38 of the United States Code so as to provide that monthly social security benefit payments shall not be included as income for the purpose of determining eligibility for a pension under that title

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That paragraph (5) of section 503 of title 38, United States Code, is amended to read as follows:

"(5) lump-sum death payments and monthly benefit payments under subchapter II of chapter 7 of title 42;".

SEC. 2. In computing the income of any person for the purpose of determining his eligibility for pension pursuant to the provisions of the first sentence of section 9(b) of the Veterans' Pension Act of 1959, there shall be excluded any monthly benefit payments payable to such person under title II of the Social Security Act.

SEC. 3. This Act and the amendment made by it shall be effective for years beginning after December 31, 1966.

A BILL To amend the veterans' educational assistance program of title 38 of the United States Code so as to increase the amount of educational assistance allowances payable to veterans to include flight training such program, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That (a) the table in section 1682(a)(1) of title 38, United States Code, is amended to appear as follows:

(b) Section 1682(b) (2) (B) of such title is amended by striking out "$100" and inserting in lieu thereof "$130".

(c) The amendments made by this section shall take effect on the first day of the second calendar month which begins after the date of the enactment of this Act.

SEC. 2. (a) Section 1682 of title 38, United States Code, is amended by adding at the end thereof the following new subsection:

"(d) Each eligible veteran who is pursuing an approved course of flight training shall be paid an educational assistance alowance to be computed at the rate of 75 per centum of the established charge which similarly circumstanced nonveterans enrolled in the same flight course are required to pay for tuition for the course. If such veteran's program of education consists exclusively of flight training, he shall not be paid an educational asistance allowance under one of the preceding subsections of this section; if his program of education consists of flight training and other education, the allowance payable under this subsection shall be in addition to any educational assistance allowance payable to him under one of the preceding subsections of this section for eduaction other than flight training. Such allowance shall be paid monthly upon receipt of certification from the eligible veteran and the institution as to the actual flight training received by the veteran. In each such case the eligible veteran's period of entitlement shall be charged (in addition to any charge made against his entitlement by reason of educaiton other than flight training) with one day for each $1.25 which is paid to the veteran as an education and training allowance for such course.” (b) Section 1673 of title 38, United States Code, is amended by repealing subsection (b) thereof, and by redesignating subsection (c) and subsection (d) as subsection (b) and subsection (c), respectively.

(c) Subsection (c) of section 1662 of title 38, United States Code, is amended by adding at the end thereof the following new sentence: "In the case of any eligible veteran who was discharged or released from active duty before the date of enactment of this sentence and who pursues a course of flight training within the provisions of section 1682 (d) of this chapter, the eight-year delimiting period shall run from such date of enactment, if it is later than the date which would otherwise be applicable."

SEC. 3. (a) Subchapter III of chapter 34 of title 38 United States Code, is amended by adding at the end thereof the following new section:

"§ 1677. Reports by institutions

"(a) Educational institutions shall, without delay, report to the Administrator in the form prescribed by him, the enrollment, interruption, and termination of the education of each eligible veteran enrolled therein under this chapter. "(b) The Administrator shall pay to each educational institution which is required to submit reports and certifications to the Administrator under this chapter an allowance at the rate of $1 per month for each eligible veteran enrolled in and attending such institution under the provisions of this chapter to assist the educational institution in defraying the expenses of preparing and submitting such reports and certifications. Such allowances shall be paid in such manner and at such times as may be prescribed by the Administrator, except that if any institution fails to submit reports or certifications to the Administrator as required by this chapter, no allowance shall be paid to such institution for the month or months during which such reports or certifications were not submitted as required by the Administrator.

(b) The analysis of such chapter 34 is amended by inserting immediately below

"1676. Education outside the United States."

the following:

"1677. Reports by institutions."

(c) Section 1784 of title 38, United States Code, is amended by striking out "34 or".

A BILL To amend title 38 of the United States Code in order to increase the rates of pension payable to certain veterans and their widows, to provide additional readjustment assistance for veterans of service after January 31, 1955, and for other purposes

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SHORT TITLE

SECTION 1. This Act may be cited as the "Veterans' Pension and Readjustment Assistance Act of 1967".

TITLE I-PENSION BENEFITS

ENLARGING WIDOWS' ELIGIBILITY FOR BENEFITS

SEC. 101. (a) Paragraphs (2) and (3) of sections 302(a), 404, 532 (d), 534 (c), 536 (c), and 541 (e), title 38, United States Code, are amended to read as follows: "(2) for one year or more; or

'(3) for any period of time if a child was born of the marriage, or was born to them before the marriage.".

(b) Subsection 103 (a), title 38, United States Code, is amended by striking out "cohabitated with him for five or more years immediately before his death," and inserting in lieu thereof "cohabitated with him for one year or more immediately before his death, or for any period of time if a child was born of the purported marriage or was born to them before such marriage,”.

PERMANENT AND TOTAL DISABILITY AT AGE SIXTY-FIVE; AID AND ATTENDANCE ALLOWANCE FOR PERSONS IN NURSING HOMES

SEC. 102. (a) Subsection (a) of section 502 of title 38, United States Code, is amended by inserting immediately after "disabled if he is" the following: "sixty-five years of age or older on".

(b) Subsection (b) of such section 502 is amended by inserting "(1) a patient in a nursing home or (2)" immediately after "if he is".

EXCLUSION FROM ACTUAL INCOME

SEC. 103. (a) Paragraph (7) of section 503 of title 38, United States Code, is amended by inserting immediately after "amounts paid by" the following: "a wife of a veteran for the expenses of his last illness, and by".

(b) Paragraph (9) of such section 503 is amended by inserting “(A)” immediately after "amounts paid" and by inserting the following immediately before the semicolon at the end thereof: "or (B) by a widow or a wife of a deceased veteran for the last illness and burial of a child of such veteran."
