$2. And be it further enacted, That after the organization as county is or- aforesaid, and appointing and commissioning the civil officers for said county, there shall be held in and for said county, a court of common pleas and general sessions of the peace, and that there shall be three terms of the said court of common pleas, and two terms of the said court of general sessions of the peace in said county, in every year; the terms of said court of common pleas to begin on the third Tuesday of February, and the fourth Tuesday of June and November in every year; and the terms of the said court of general sessions of the peace to begin on the fourth Tuesdays of June and November, in every year, and may continue to be held until the several Saturdays next following, inclusive; and that the said court shall have the like power and jurisdiction as the like courts in the other counties in the state have: Provided always, That nothing in this act contained shall be construed to affect any action or prosecution already commenced, before the holding of the first term of the said courts in the said county of Hamilton, so as to work a wrong or prejudice to any of the parties therein, or to affect any criminal or other proceedings on the part of the people of the state; but all such civil or criminal proceedings may be prosecuted to trial, judgment and execution, as if this act had not been passed.

$ 3. And be it further enacted, That the said court of common place of hold-pleas and general sessions of the peace, in and for said county, shall be held at the court-house, to be erected at such place in said county as shall hereafter be appointed by law; and that until then, the said courts, if any, shall be held at such place in the said county as the supervi sors thereof, or a majority of them, shall appoint, in writing under their hands, which appointment shall be filed with the clerk of said county, at least thirty days before the time of holding said court, and who shall, immediately thereafter, cause three copies thereof to be made, and put up at three of the most public places in said county.

S4. And be it further enacted, That the prisoners of said county shall be confined in the jail of the county of Montgomery, until the jail to be erected in the manner herein before provided, in said county of Hamilton, shall be finished, in such manner as, in the opinion of the sheriff of said last mentioned county, for the time being, will confine the prisoners of the same; when it shall be lawful for said sheriff to remove and commit them to the jail of said county of Hamilton.'

From and after the first day of March next, all those parts of the towns of Allen and Almond, in the county of Allegany, comprised in township number five, in the first range of Morris's reserve, shall be and remain a separate town by the name of Birdsall.

§2. The remaining parts of the said towns of Allen and Almond, Allen and Alshall remain separate towns by the names of Allen and Almond.

$ 2. The residue of the town of Clymer shall be and remain a separate town, by the name of Clymer.

An act to erect the town of Arkwright, in the county of Chautau que. Passed April 30, 1829.

S1. From and after the last day of February next, that part of the towns of Pomfret and Villenova, known as the fifth township in the eleventh range of the Holland Company's land, with the exception of lot number sixty-four in said township, being the northwest corner thereof, shall constitute a new town, by the name of Arkwright.

$ 2. All the remaining parts of the towns of Pomfret and Villenova, shall, after the said last day of February next, be and remain separate towns, by the names of Pomfret and Villenova.

From and after the first day of February next, the territory included within the limits of the town of Homer, in the county of Cortland, shall be divided into two towns, by a line commencing at the northwest corner of lot fifty-one, and running east along the tier of lots as originally surveyed, to the northeast corner of lot number sixty.

$ 2. That part of the present town of Homer lying north of the said line, shall be known by the name of Homer.

$ 3. That part of the present town of Homer lying south of the said division line, shall be known by the name of Cortlandville.

FRANKLIN An act to divide the town of Constable. Passed April 25, 1829. $1. From and after the passing of this act, all that part of the town of Constable which lies west of a line commencing at a point in

From and after the first Monday in March next, all those Town of Litparts of the towns of Herkimer, Fairfield and Germanflatts, in the county of Herkimer, comprehended within the following boundaries, viz: beginning on the middle or base line of Glen's purchase, at a point where the line between lots number five and six in said purchase unites with said base or middle line, and running thence south along said line to its southern termination; thence on the same course continued to the south bounds of the town of Germanflatts; thence along the south bounds of said town, to the southeast corner thereof; thence along the eastern bounds of the towns of Germanflatts and Herkimer, to the southeast corner of the town of Fairfield; and from thence by a straight line to the place of beginning, shall be a separate and distinct town, and shall be known by the name of the town of Little-Falls.

All that part of the said town included within the following bounds: beginning at the southeast corner of lot number forty-three; thence west along the south line of said lot to the east line of lot number forty-two; thence south along the east line of said lot number forty-two to the southeast corner thereof; thence west along the south lines of lots number forty-two, forty-one, forty, thirty-nine, thirty-eight and thirty-seven, to the southwest corner of said lot number thirty-seven; thence north to the north-east corner of lot number thirty-six; thence west to the northwest corner of said lot number thirty-six; thence north along the east line of lot number thirty-five to the Seneca river; thence along the said river to the northeast corner of lot number fifteen, and thence to the place of beginning, shall be and the same is hereby erected into a separate town by the name of Van Buren.

$3. All the remaining part of the town of Camillus shall be and remain a separate town by the name of Camillus.
