The following cases, decided during the period embraced by this volume, are omitted on account of their length, in order to make room for others of more general usefulness: St. Paul & Chicago Ry. Co. v. Brown, which holds that the title of the railway company to a large quantity of swamp lands is superior to that of the trustees of the hospital for the insane; and Dutcher v. Culver, which holds that prior to Laws 1877, c. 140, the landlord's commonlaw right of distress for rent existed in this state. They will appear in volume 24.
