Officer. No amendment to this contract will be required, as provided in (ii) above, if the Contracting Officer determines that an elimination of charge for use of such facilities will of itself result in an adequate decreased cost to the government under this contract.

(2) Justification for the Use of Government Facilities. Justification for the use of Government Facilities shall include the following information:

(a) A detailed explanation of the need for the government furnished facilities. The justification should start with the baseline of the contractor's privately-owned capacity/capability and explain what additional capacity is required through the providing of government facilities.

(b) Identification of each facility item required and its acquisition value.

(c) Period of use for the facilities as relates to the supply contract.

(d) Evidence of technical coordination obtained (program office, contract administration, etc.)

(e) In accordance with DAR 13-301, a determination that no economical, practical and appropriate alternative exists. Documentation must reflect a complete analysis of the alternatives and show the impact if facilities are not authorized.

(f) A contractor's unwillingness statement.

(g) Contractor's progress in achieving planned phase-out government-owned facilities purusant to the DoD facilities phase-out

program.

Ref. Item 10c - USAFINTELS 201-1 and 201-4 provide the necessarv guidance for physical, personnel and information security measures for Sensitive Compartmented Information (SCI) and is part of the SCI security specifications for the contract.

Ref. Item 10d - This contract requires access to Sensitive Compartmented Information (SCI). The Air Force Special Security Office, Foreign Technology Division (AFSS) (FTD) has exclusive security responsibility for all SCI released to or developed under the contract. Defense Contract Administration Services Region (DCASR) is relieved of security inspection responsibility for all SCI, but retains responsibility for all non-SCI classified material released to or developed under the contract.

a. The security classification guidance for this contract is governed by ASD Security Classification Guide F-15 Advanced Tactical Fighter (EAGLE), 31 July 1979.

b. The contractor will require access to classified source information through the TOP SECRET level in support of this work effort. Any extracts or use of such data will require resulting documentation to be classified and marked consistent with the source from which the extracts were made, in accordance with E.0. 12065.

c. All Sensitive Compartmented Information will be handled in accordance with special security requirements which will be furnished by the designated ASSO. following activity is designated as the responsible security office for the Sensitive Compartmented Information: AFSSO TD, WPAFB, Ohio 45433.

d. Sensitive Compartmented Information will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives and prior approval and certification of "need to know" by the designated contract monitor identified in item 12b of this DD. Form 254.

e. Names of contractor personnel requiring access to Sensitive Compartmented Information will be submitted to ASD/YFA for approval. Unon written approval of the program monitor, ASD/TD/SP will provide the company security officer with the necessary data to submit request(s) for Special Background Investigation (SBI) in accordance with DOD 5220.22-M, Industrial Security Manual for Safeguarding Classified Information, to DISCO.

f. Sensitive Compartmented Information and material furnished in support of this contract remains the property of the DOD department, agency or command that released it. Upon completion or cancellation of the contract, all sensitive compartmented information and material furnished will be returned to the direct custody of the applicable AFSSO.

This contract requires that a limited number of selected key contractor personnel have access to Sensitive Compartmented Information for contract completic purposes only at the sponsoring agency or other government facilities. These persons will be cleared and indoctrinated by the sponsoring agency.

h. Inquiries pertaining to classification guidance on Sensitive Compartmented Information will be directed to the responsible contract monitor as indicated in Item 12b.

1. The following controls will apply to foreign intelligence material provided under the contract:

(1) The Contract Monitor for this contract is (name, organization, office symbol and telephone number)."

(2) Any classified foreign intelligence material released to the contractor remains the property of the Government and may be withdrawn at any time. He/she must maintain accountability for all classified foreign intelligence released into his/her custody (including CONFIDENTIAL information) and must not reproduce any classified foreign intelligence without the written permission of the releasing agency. If permission is granted, each copy will be controlled in the same manner as the original.

(3) The contractor must designate an individual who is working on the contract as custodian. The designated custodian will be responsible for receipting and accounting for all classified intelligence material received under the contract. This does not mean that the custodian must personnally sign for all classified material. The inner wrapper of all classified material dispatched from DOD agencies is marked for the attention of a designated custodian and must not be opened by anyone not working directly on the contract.

(4) The contractor must restrict access only to those individuals who possess the necessary security clearance and who are actually providing services under the contract. Further dissemination to other contractors, subcontractors, other Government agencies, private individuals or organizations is prohibited unless authorized in writing by the releasing agency. Prior

to granting an employee access to classified foreign intelligence materials, the contractor must brief the employee on the special security requirements for this material and maintain records of the names of individuals who have had access to this material in such a manner that will enable him/her to provide the Government such information on demand.

(5) Classified foreign intelligence material must not be released to foreign nationals or immigrant aliens whether or not they are also consultants, U.S. contractors or employees of the contractor, and regardless of the level of their security clearance, except with advance written permission from the originator.

(6) The contractor must not destroy any classified foreign intelligence (including CONFIDENTIAL) without advance approval of the releasing agency. (Exception: Classified waste shall be destroyed as soon as practicable in accordance with the provisions of DOD 5220.22-.)

(7) Within 30 days after the final product is received and accepted by the contracting organization, classified intelligence materials released to, or generated by the contractor,. must be returned to the releasing agency unless written instructions authorizing destruction or releation are issued. Requests to retain material will be directed to the Procuring Contracting officer (PCO) for this contract through the Administrative Contracting Officer (ACO) (notwithstanding paragraph 51(3), DOD 5220.22-) in writing and clearly indicate the justification for retention and the retention period desired.
