at the site of the work, shall be deemed sufficient for the purpose aforesaid. If the contractor fails or refuses to comply promptly, the Deputy Contracting Officer may issue an order stopping all or any part of the work.

Article 22. Domestic Preference.--In the performance of the work covered by this contract, the Contractor, subcontractors, materialmen, or suppliers shall use only such unranufactured articles, materials, and supplies as have been mined or produced in the United States, and only such manufactured articles, materials, and supplies as have been manufactured in the United States substantially all from articles, materials, or supplies mined, produced, or manufactured, as the case may be, in the United States. The foregoing provision shall not apply to such articles, materials, or supplies of a class or kind to be used or such articles, materials or supplies from which they are manufactured, as are not mined, produced, or ranufactured, as the case may be, in the United States in sufficient and reasonably available commercial quantities and of a satisfactory quality, or to such articles, materials, or supplies as may be excepted by the Secretary of the Army under title III, section 3, of the Act of March 3, 1933, 47 Stat. 1520 (U.S. Code, 1934 ed,title 41, section 10b). The term "Chief of Engineers" shall

Instructions for Use of ENG Form 1708.

The plan of operation for use of ENG Form 1708 is for the RecorderCustodian, Army-Air Force Central Welfare Fund to designate the District Engineer of the Corps of Engineers as "Deputy Contracting Officer." The District Engineer, acting in his capacity as deputy contracting officer, enters into the contract and administers such contract in the same manner as civil works contracts. (See JAAFAR 1-11-18, dated 30 April 1948, for instructions relating to the establishment of the Army-Air Force Central Welfare Fund and the office of Recorder-Custodian thereof.)

This Contract, entered into this -by the United States of America (hereinafter called the Government), represented by the contracting officer executing this contract, and

Whereas, the preparation and delivery of the hereinafter described appraisal reports is authorized by law; and

Whereas, the contractor has a well qualified, equipped and experienced organization which is in a position to prepare and furnish to the Government appraisal reports covering the real property hereinafter described; Now, Therefore, the parties here to do mutually agree as follows:

Article 1. Preparation and delivery of appraisal reports.--The contractor shall prepare, furnish, and deliver to the Government appraisal reports covering certain real property described in schedule A attached to and made a part of this contract.

Article 2. Contents of appraisal reports.--(a) The appraisal reports shall be furnished in (quadruplicate unless otherwise indicated

herein) in such form as may be approved by the contracting officer.

(b) The appraisal report in final form will be indexed appropriately and so arranged as to permit of ready reference to all factors contributing to or detracting from the market value of the interest contemplated to be acquired by the Government in the properties appraised.

(c) Each appraisal report will, among other things, include the following:

(1) Name and address of ostensible owners.

(2) Legal description of the land.

(3) Contractor's certificate as to the market value of the fee title and annual rental value.

(4) The land value estimate which will be broken down by classification, grade and unit value.

(5) Reference to the buildings on each parcel which will be numbered and described in sufficient detail to permit ready identification upon inspection, specifically as to construction features, size, capacity, number of rooms and rentable or customarily usable floor space on each level. Present condition of all buildings will be adequately set forth, together with information as to the reproduction cost, depreciation, estimated remaining useful life and adaptability to the most profitable use of the land.

(6) A summary of all important facts and conclusions, a discussion of the appraisal process and an analysis of applicable sales, rentals and listings of comparable properties.

(7) The latest assessed valuation of each parcel including a discussion of any established ratio between the assessed and fair market valuation.

(8) Photographs of each parcel of land appraised, together with sufficient exterior and interior photographs to support the appraisal of each building on the property. Such photographs shall measure not less than 2 by 3 inches.

Article 3. Modification of delivered appraisal reports.--Upon request of the contracting officer and without additional cost to the Government, the contractor shall modify or supplement any and all appraisal reports prepared and delivered hereunder if and when the contractor receives additional information relevant thereto, or if applicable principles of law with respect to appraisals require the modification or supplementing of such appraisal reports.

Article 4. Delivery.-- Time being of the essence, the contractor shall mail or deliver to the contracting officer completed appraisal reports within calendar days from and after the date of the

request therefor.

Article 5. Testimony in judicial proceedings.--Upon request of the contracting officer, the contractor agrees to furnish from his staff and organization qualified witnesses to testify as to the value of any and all property on which appraisal reports are furnished in any judicial proceedings involving a determination of the value of the aforementioned property.

Article 6. Payment.--In consideration of the performance of his undertakings under this contract, the contractor shall be paid

(a) For appraisal reports, the lump sum of $--- which shall constitute full payment to the contractor and shall include costs of all supplies, material and equipment, and all other expenses incurred by the contractor in performing hereunder. Payment shall become due upon the delivery of completed reports accompanied by properly certified invoices to the contracting officer.

(b)

For testimony given in any judicial proceedings pursuant to article 5 hereof, at the rate of $- ------per day per witness for the time actually required in court. A day is to consist of 8 hours. For fractional parts of a day, if any, the contractor is to be paid one-quarter of the daily rate for every 2 hours or fraction thereof. Any and all expenses of witnesses, including travel and subsistence, shall be borne by the contractor.

Article 7. Appraisal reports to be confidential.--All information contained in the appraisal reports to be made hereunder and all parts thereof are to be treated as strictly confidential. The contractor shall take all necessary steps to insure that no member of his staff or organization divulges any information concerning such appraisal reports to any person other than a duly authorized representative of the Government.
