Subpart 9-4.9 Unsolicited Proposals

$9-4.900 Scope of Subpart.

This subpart provides policies and procedures applicable to the handling of documents submitted as unsolicited proposals, including those for commercial demonstrations.

(a)

General.

Unsolicited proposals may be accepted upon a determination by the responsible official or designee, that support (such as award of a contract or other arrangement as authorized by law) to the proposer is justified because the proposal was submitted on the proposer's own initiative in accordance with this subpart; and the purpose is to explore a method, approach, or an idea or to carry out an initial development in support of ERDA's mission which (1) does not unnecessarily duplicate work already underway or contemplated by ERDA, and (2) is not already known by ERDA, or (3) has previously unrecognized merit or value; or acceptance is otherwise authorized by stat

ute.

$9-4.902 Policy.

It is ERDA policy to make maximum practicable use of invitations for bids, requests for proposals, program opportunity notices, and program research and development announcements in order to solicit competitive proposals. Because present and future needs demand fullest possible use of all resources in exploring alternative energy sources and technologies, ERDA stresses the value of external sources of innovative methods, approaches, and ideas through unsolicited proposals while preserving the integrity of the procurement process through the application of reasonable controls. In furtherance of this policy, ERDA will:

(a) Disseminate information on areas of broad technical concern whose solutions are considered relevant to the accomplishment of ERDA's mission.

(b) Encourage potential proposers to consult with program personnel before expending resources in the development of written unsolicited proposals.

(c)

Endeavor to distribute unsolicited proposals to all interested organizations within ERDA.

(d)

Process unsolicited proposals in an expeditious manner and, where practicable, keep proposers advised as discrete decisions are made.

(e) Assure that each proposal is evaluated in a fair and objective manner.

(£) Assure that each proposal will be used only for its intended purpose and the information contained therein will not be divulged without prior permission of the proposer.

(a) An "unsolicited proposal" is a written offer to perform work submitted by an organization or individual solely on its own initiative and not in response to a specific request made by ERDA. It does not include advertising material, commercial product offerings, commercial service offerings, contributions, technical correspondence, or capability statements. For purposes of this subpart, the definition does not include initial proposals or extensions or renewals of ongoing projects which fall under the provisions of subpart 9-4.51, Special Research Support Agreements with Educational Institutions.

(1) Advertising material Written material designed to acquaint the Govenment with a potential proposer's present off-theshelf products or capabilities, or designed to determine the Government's interest in buying such products.

(2) Commercial product offerings Offers of standard mercial products usually sold in substantial quantities to the general public and which the vendor wishes to see introduced into the Government's supply system as an alternate or replacement for an existing supply item.

(3) Commercial service offerings Offers of commercial services such as painting, janitorial, trash removal, and related services which are readily available using normal competitive procurement methods.

(4) Contributions Concepts, suggestions, or merely ideas presented to the Government for its use, with no expectation by the offeror that the Government will support the effort.

(5) Technical correspondence Written inquiries regarding Government interest in research areas, proposal explorations, technical inquiries, and research description.
