Attached at Tab K is the information form which individual task force members (as opposed to Executive Committee members) are asked to complete. Since the task forces are just now in the process of being staffed, this data is not yet complete for all task forces.

3. Source of Funding

The Foundation for the President's Private Sector Survey, Inc. is the sole source of funding for the President's Private Sector Survey on Cost Control, with the exception of Ms. Colson, who remains a Federal Government employee. Questions relating to the specifics of the Foundation and the funding mechanism should be directed to the Foundation.

4. Executive Branch Monitoring and Participation

WHITE HOUSE:

Craig Fuller, Assistant to the President for Cabinet Affairs, has been designated as the principal point of contact in the White House.

Pursuant to my staff's phone conversation on August 3, 1982, with

Ms. Janet Colson, your Deputy Director, we are formally requesting certain data relating to the President's Private Sector Survey on Cost Control. These items were discussed with your staff at meetings on July 22, 1982, and

July 28, 1982.

The data that we are requesting includes

--personal biographies on all Executive. Committee members as discussed at our July 22 meeting;

--personal data statements for all other participants in the survey
effort including staff that serves the foundation, the management
office, and all task forces (as they become available);

-a list of objectives for each task force;

--a list of all Federal agency contacts and their phone numbers, in-
icluding the Departments of Commerce and Justice's support groups;

-a list of all task force project managers and their phone numbers;
and

--a copy of the task force operations guide which was provided to the
Executive Committee at the May 13, 1982, briefing.

We have been asked by the House Committee on Post Office and Civil Service to focus our efforts on two of the task forces: Personnel and Health and Human Services-Social Security Administration. The committee would like for us to use these two task forces as examples of the structure and methodology of the survey as a whole. We hope to be coordinating directly with the two project managers to obtain the information necessary to fulfill our request.

So that we may be able to respond to the committee in a timely manner, we would appreciate receiving the requested material by Friday, August 13, 1982. We would also like to set up a meeting with you and Ms. Colson some time in the near future.

I want to thank you very much for the invaluable assistance and cooperation that you and your staff have given us thusfar in our efforts, and we look forward to working with you in the future.

Per our discussion yesterday, I am requesting the following information from your office:

--A list of your contacts in the agencies, including the Designated Agency 1
Ethics Officers. Since we have been requested by the Committee to look
at the agencies role in the Survey, we want to be sure that we are con-
tacting the people who were actually involved in this effort.

--Examples of the letters sent to Executive Committee Members notifying them that they have

o been cleared. to work on the original task force assignment;

o received clearance to work on another task force;

o received provisional clearance to work on the foiginal assignment as long as certain areas are avoided where there may be a conflict; and

o not been cleared to work on any task force.

--The advisory opinion letter from the Department of Justice, Office of Legal Counsel, which provided guidance on the way the Survey was structured and any other opinions that relate to the Survey's efforts.

--Memoranda from Mr. Fielding to either Executive Committee or Task Force members providing guidance on standards of conduct and other general guidance.

Once again, I want to assure you that we are only trying to gather data on the Survey. Our primary concern is to clarify all preces in this complex puzzle in order to present a comprehensive and accurate picture to the Committee.

In our August 4, 1982, letter to you we indicated that we planned to obtain task force information directly from the Personnel and Social Security task force project managers. However, Mr. Sy Pranger asked that we obtain certain information from your office.

Specifically, for the Personnel and Social Security task forces; we need copies of work plans and interim progress reports. We would also like to review similar records of the other task forces, including information showing primary contacts at the agencies under review by those task forces.

I realize that this request and our request of August 4, may be a burden to the Survey. In an effort to make both our jobs easier, we are willing to assist in any way we can to help collect the data. Thank you for your cooperation in

this effort.

Dear Cheryl:

This letter concerns the meeting you, Tom Short and I had on Friday, July 30, 1982 regarding the President's Private Sector Survey on Cost Control. I appreciate the time you and Tom are spending to become familiar with the Survey and hope my explanations were reasonably clear.

In accordance with your "document request", enclosed please
find a copy of a memorandum sent by Fred F. Fielding, Counsel
to the President, to each Executive Committee member
concerning conflicts of interest. In a similar vein, I have
included a copy of R. Stanley Harsh's memorandum for the
task force staff members on the same topic. If you will
recall, Mr. Harsh is serving as a legal advisor to the
Survey and is providing guidance to the task force members,
who are employees of the Foundation and not the government.

My notes show that, during the meeting, I gave you a copy of the July 9, 1982 memorandum on Special Government Employees prepared by the Office of Government Ethics. You have received from us (through Janet Colson) a copy of the Personal Data Statement required to be completed by the members of the Executive Committee of the Survey.

I regret to advise you that we cannot provide you with completed Personal Data Statements. This information was provided to

us by the Executive Committee members with the express understanding that it would be held in confidence. You also asked for non-disclosure agreements signed by the task force staff members. As I explained to you, I do not have these documents because the task force staff members are connected with the Foundation and, as noted above, are not government employees.

The final type of document you requested were written procedures/ criteria for clearance of Executive Committee members. As we discussed, the criteria for financial disclosure is provided by the Personal Data Statement, a copy of which has been given to you. This statement was drafted following a review of the standard forms required to be completed by all government employees. The criteria against which the disclosure statements are judged are provided by federal statutes and agency regulations. The Ethics in Government Act of 1978, as amended, relevant provisions of Title 18 and agency standards of conduct provided the guidelines for clearance. If you will recall, I provided you and Tom with citations to the statutes during our meeting.
