With respect to our recent meeting and your request for information on the President's Private Sector Survey on Cost Control, I am pleased to provide you with the enclosed data in response to your specific questions. If, after reviewing this memorandum and the enclosed attachments, you have additional questions, please do not hesitate to contact me.

The President announced the establishment of the Private Sector Survey on Cost Control on February 18, 1982. The text of that announcement is attached at Tab A.

Key enabling documents relevant to the Private Sector Survey include the following:

for the President's Private Sector Survey, Inc. and

Charter of the Executive Committee for the President's Private
Sector Survey, Inc. (Tab D)

Briefly, members of the Executive Committee are considered
special government employees of the Department of Commerce and
are subject to the provisions of the Federal Advisory
Committee Act. Under the terms of the Cooperative Agreement
signed between the Department of Commerce and the Foundation
for the President's Private Sector Survey, Inc., the Foundation
provides staff assistance to the members of the Executive
Committee with respect to undertaking the review of the Executive
Branch of Government. The Foundation for the President's Private

Sector Survey, Inc. has been organized in the District of Columbia as a charitable not-for-profit corporation, and as a result, is in a position to receive financial contributions, gifts in kind, and volunteer services. Members of the task forces, as opposed to Executive Committee members who serve as co-chairs of task forces, are independent contractors, not federal employees (Tab C, page 4).

Specific questions pertaining to legal matters should be addressed to Ed Wilson of the Office of Counsel to the President (456-2934).

An organization chart for the President's Private Sector Survey is attached at Tab E. On March 3, the President named J. Peter Grace, Chairman of the Board and Chief Executive Officer of W. R. Grace and Company, as Chairman of the Executive Committee. Since that time, approximately 140+ individuals have been asked to serve on the Executive Committee. At the present time, 105 of those individuals have been officially cleared by the White House for appointment. A list of those individuals is attached at Tab F. The Survey Management Office, which is responsible for overseeing the day-to-day operations of the entire project, is headed by James W. Nance, with the assistance of Janet Colson, Deputy Director. Ms. Colson is a government employee.

The review of the Executive Branch of Government has been divided among 35 task forces, 22 of which are organizationally focused and 13 of which are functionally focused. Each task force is chaired by two or more members of the Executive Committee with a project manager heading the effort. A list of task forces is enclosed at Tab G.

2. Participants

The name, company affiliation, and position of the individual Executive Committee members cleared to date is attached at Tab G. Personal Data Statements have been filed by each of the Executive Committee members cleared to date with Fred Fielding, Counsel to the President. A list of Executive Committee task force assignments cleared to date is attached at Tab I. Additional Executive Committee members will be added to the individual task forces once the conflict-of-interest clearance process has been completed by the specific departments and agencies involved. A copy of the Personal Data Statement form to which Executive Committee members responded for purpose of conflict-of-interest review is attached at Tab J. The completed forms have been reviewed by the Office of the Counsel to the President and the offices of the General Counsels of the respective departments and agencies.
