The Executive Committee of the President's Private Sector Survey on Cost Control in the Federal Government ("the Committee") was established by Executive Order 12369 of June 30,1982.

(a) The Committee shall conduct a private sector survey
on cost control in the Federal Government and shall
advise the President, the Secretary of Commerce, and
other Executive agency heads, with respect to improving
management and reducing costs.

(b) The Committee shall conduct in-depth reviews of the
operations of the Executive agencies as a basis for
evaluating potential improvements in agency operations.
(c) In fulfilling its function the Committee shall
consider providing recommendations in the following

areas:

Section 3.

(1) Opportunities for increased efficiency and reduced costs in the Federal Government that can be realized by Executive action or legislation;

(2) Areas where managerial accountability can be enhanced and administrative control can be improved;

(3)

Opportunities for managerial improvements over both the short and long term;

(4) Specific areas where further study can be
justified by potential savings; and

(5) Information and data relating to governmental
expenditures, indebtedness and personnel management.

MEMBERS AND CHAIRMAN

The Committee shall be composed of no more than 150 members who shall be appointed by the President from among citizens in private life. The members shall serve at the pleasure of the President. The President shall designate a Chairman from among the members of the Committee.

(a) The Committee shall report to the President and to the Secretary of Commerce. Thereafter, it shall report to the heads of other Executive agencies and as required by the Federal Advisory Committee Act, as amended (5 U.S.C. App.).

(b) The heads of Executive agencies shall, to the
extent permitted by law, provide the Committee and its
staff units, with such information and appropriate
logistical support as it may require for the purpose of
carrying out its functions.

(c) The Department of Commerce, Office of the Assistant
Secretary for Administration, shall, to the extent
permitted by law and subject to the availability of
funds, provide the Committee with such administrative
services, facilities, staff and other support as may be
necessary for the effective performance of its functions.
(d) The Committee, or subcommittees thereof, is expected
to meet at least monthly before the final report and
recommendations are submitted to the President.

(e) Members will not be compensated for their services, but while engaged in the work of the Survey, may be allowed travel expenses, (including per diem in lieu of subsistence), as authorized by law for persons serving intermittently in the government service (5 U.S.C. S 5702 and 5703).

(f) The estimated Federal cost for operating the
Committee including travel expenses and per diem in lieu
of subsistence, is approximately $50,000, which includes
une person-year of support.

(g) The Committee may establish such subcommittees of
its members as may be necessary, subject to the provisior.s
of the Department of Commerce Committee Management
Handbook (Part H, Chapter 1, Sec E).

Section 5.

FEDERAL ADVISORY COMMITTEE ACT

In accordance with Executive Order No. 12369
notwithstanding the provisions of any other Executive
Order, the responsibilities of the President under the
Federal Advisory Committee Act, as amended (5 U.S.c.
App.), except that of reporting annually to the Congress,
shall be performed by the Secretary of Commerce.

The Committee shall terminate by December 31, 1982,
unless it is terminated earlier or renewed by proper
authority by appropriate action.

AGREEMENT

Between

THE SECRETARY OF COMMERCE

and

THE FOUNDATION FOR THE PRESIDENT'S

PRIVATE SECTOR SURVEY ON COST CONTROL, INC.

THIS AGREEMENT, entered into this 7th day of July

1982, WITNESSETH:

WHEREAS, the President of the United States has established by Executive Order No. 12369, dated June 30, 1982, a Presidential Advisory Committee (the "Committee") to advise the President, the Secretary of Commerce and the heads of other Executive agencies with respect to improving management and reducing costs; and

WHEREAS, Section 3 (e) of Executive Order 12369 provides that to the extent practicable the Committee is to be funded, staffed and equipped without cost to the Federal Government and to accomplish this objective it is expected that the Secretary of Commerce will engage in a joint project, with a nonprofit organization, pursuant to Section i of Public Law 91-412 (15 U.S.C. 1525), for the purpose of providing staff support to the Committee, and

WHEREAS, there has been organized, under the laws of the District of Columbia, a charitable, not-for-profit corporation under the name "The Foundation for the President's Private Sector Survey on Cost Control, Inc." (the "Foundation"), which Foundation is willing to provide facilities, services and staff support and otherwise assist the Committee in carrying out its responsibilities; and

WHEREAS, by reason of the foregoing, the Secretary and the Foundation have a mutual interest in taking such action as may be necessary or desirable to assist the Committee in

carrying out its responsibilities in a timely and efficient

manner.

NOW THEREFORE, the parties hereto have entered into this Agreement this 7th day of July 1982.

Section I

Authority

This Agreement is made under the authority of Executive

Order No. 12369, 15 U.S.C. 1525, and 13 U.S.C. 161.

Section II

Secretary of Commerce

The Secretary at no cost to the Foundation agrees:

To cooperate with and provide such assistance as may be necessary to enable the Foundation to carry out its responsibilities in an efficient and timely

Federal agencies which are to be reviewed. This

& liaison will be performed through the Secretary's designee, Janet Colson, and other Federal personnel as the Secretary shall designate.

To arrange with the General Services Administration to make available for use by the Foundation during the term of this Agreement such surplus furniture and other office equipment as may be available.

Section III

The Foundation

The Foundation at no cost to the Federal Government

agrees:

(a)

To provide such support as may be requested by the
Chairman of the Committee to assist the Committee

in carrying out its responsibilities, including but
not limited to:

(1) facilities, including office space, furniture, equipment, telephonic and computer equipment and services as may be necessary; and

(2) staff support to the Committee as may be
necessary, and in connection therewith to hire
such employees and retain such consultants and
advisors, either with or without compensation,
as the Foundation in its discretion shall deem
necessary or advisable.

To designate a representative to act as liaison
with Janet Colson and other Federal personnnel
designated by the Secretary under Section II.
To require all persons performing services for the
Foundation who shall have access to information to
sign a statement in the form approved by the
Secretary (attached as Exhibit A to this Agreement)
relating to the disclosure of information to

unauthorized persons.

(d) To establish such controls as shall be prescribed
by the Secretary (attached as Exhibit B to this
Agreement) to prevent the disclosure by the Foundation
of information to unauthorized persons.

Section IV

Status of Foundation

The parties hereto acknowledge and agree that the status of the Foundation under this Agreement, and in all of its and its employees agents and representatives dealings and relations with the Secretary, the Department of Commerce and other

Federal agencies shall be that of an independent entity providing services under a joint project and not as one

involving employment, no statutes governing Federal employment shall apply to the Foundation, and the Foundation shall not have any obligation of financial accountability to the Department of Commerce.
