TOWBOAT REGULATIONS

COMMITTEE ON MERCHANT MARINE AND FISHERIES,

The subcommittee met at 10 a.m., pursuant to call, in room 1334, Longworth House Office Building, Hon. Edward A. Garmatz (chairman of the subcommittee) presiding.

Mr. GARMATZ. The meeting will come to order.

The subcommittee is meeting today to consider H.R. 723 by Mr. Bonner, H.R. 156 by Mrs. Sullivan, and my bill, H.R. 7491.

The first two bills were the subject of an executive communication in the 88th Congress and were presented by the Coast Guard to close what it regards as a gap in its regulation of towing vessels. My bill was introduced after some study of the matter, which led me to believe that the broad approach sought by the Coast Guard might not be necessary to meet the problems reported by it.

The necessity for any of these bills arises out of the fact that while the Coast Guard has had jurisdiction over steam-propelled towboats it has no jurisdiction over diesel-propelled towboats. The past 35 years have seen steam towing vessels almost completely supplanted by the diesel type.

The problem first came to the attention of this committee in 1935 when extensive hearings were held concerning the necessity for such regulation. No action was taken and again in 1951 extensive hearings were held with the same result.

During the past several years the Coast Guard has compiled statistics regarding casualties on unregulated vessels which will be presented during the course of these hearings.

Hearings on this subject were originally scheduled in August 1964 at which time somewhat over 80 witnesses requested to be heard. I do not believe that that number of witnesses are required to present the various viewpoints on the legislation and, accordingly, I request that insofar as possible statements be consolidated and that they be offered for the record instead of orally.

It is planned to continue these hearings at least until July 29 and it is hoped that they can be completed at that time.

While the Chair intends to hear as many witnesses as possible on the subject, it would appear that no good purpose can be served by
