An Act

87 STAT. 947

To provide a 7-percent increase in social security benefits beginning with March

1974 and an additional 4-percent increase beginning with June 1974, to proride increases in supplemental security income benefits, and for other purposes.

Be it enacted by the Senate and House of Representatices of the
United States of America in Congress assembled,

Social security

benefits, INTERIX COST-OF-LIVING IXCREASES IX SOCIAL SECURITY BEXEFITS increase. SECTION 1. (a) Section 201 (a) (1) of Public Law 93-66 is amended Ante, p. 152. by striking out the percentage by which“ and all that follows and inserting in lien thereof the following: "7 per centum.". (b) Section 201(a) (2) of Public Law 93-66 is amendeil

(1) by striking out "May 197+* each place it appears and inserting in lieu thereof "February 1974"; and

(2) by striking ont January 1975" each place it appears and inserting in lieu thereof "June 1974". (c) Section 201(b) of Public Law 93–66 is amended to read as follows:

"(b) The increase in social security benefits authorized under this section shall be provided, and any determinations by the Secretary in connection with the provision of such increase in benefits shall be made, in the manner prescribel in section 215(i) of the Social Security det for the implementation of cost-of-living increases authorizedł 86 Stat. 412. under title II of such Act, except that,

42 USC 415. "(1) the amount of such increase shall be 7 per centum,

(2) in the case of any inclividual entitled to monthly insurance benefits payable pursuant to section 2012 (e) of such Act for 42 USC 402, February 1974 (without the application of section 202(j) (1) or 223 (b) of such Act), inclucling such benefits based on a primary 42 USC 423. insurance amount determined unler section 215(a) (3) of such Act as amended by this section, such increase shall be determined 42 USC 415. without regard to paragraph (2)(B) of such section 202(e), and 42 USC 402.

"(3) in the case of any inclividual entitled to monthly insurance benefits payable pursuant to section 202(f) of such Act for February 1974 (without the application of section 202 (j) (1) or 223(b) of such Act), incluling such benefits based on a primary insurance amount letermined mer section 215(a) (3) of such Ict as amended by this section, such increase shall be determineil without regard to paragraph (3)(B) of such section 202(f).”. (d) Section 201(c) (2) of Public Law 93–66 is amended by striking Ante, p. 152. out “May 1974" and inserting in lieu thereof “February 1974".

(e) Section 201(c) of Public Law 93-66 is amended by striking out December 1974" each place it appears and inserting in lieu thereof May 197+".

(f) Section 2012(e) of the Social Security-Ict is amendeıl by adding 81 Stat. 829. at the end thereof the following new paragraph:

"(7) In the case of an individual entitled to monthly insurance benefits payable under this section for any month prior to January 1973 whose benefits were not realetermineil under section 102(g) of the Social Security Amenilments of 1972, such benefits shall not be reletermined pursuant to such section, but shall be increased pursuant to any general benefit increase (as defined in section 215(i) (3)) or any increase in benefits inade under or pursuant to section 215(i), including for this purpose the increase provided effective for March 1974, as though such redetermination has been macle."

(g) Section 202(f) of the Social Security Ict is amended by adding at the end thereof the following new paragraph:

“(8) In the case of an individual entitled to monthly insurance benefits payable under this section for any month prior to January 1973 whose benefits were not redetermined under section 102(g) of the Social Security Amendments of 1972, such benefits shall not be redetermined pursuant to such section, but shall be increased pursuant to any general benefit increase (as defined in section 215(i) (3) or any increase in benefits made under or pursuant to section 215(i), including for this purpose the increase provided effective for March 1974, as though such redetermination had been made."

(h) (i) Section 215(a) (3) of the Social Security Act is amended by striking out "$8.50" and inserting in lieu thereof ($9.00".

(2) The amendment made by paragraph (1) shall be effective with respect to benefits payable for months after February 1974.

(i) In the case of an individual to whom monthly benefits are payable under title II of the Social Security Act for February 1974 (without the application of section 202(i)(i) or 223(b) of such Act), and to whom section 202(m) of such Act is applicable for such month, such section shall continue to be applicable to such benefits for the months of March through May 1974 for which such individual remains the only individual entitled to a monthly benefit on the basis of the wages and self-employment income of the deceased insured individual.
