Question #7

You have responsibilities under section 221 of the law to consult with the head of each federal agency to establish goals for participation by small business in procurement contracts having values of $10,000 or more. Has SBA in fact contacted the head of each agency? How many instances have there been where SBA and the head of an agency have failed to agree on established goals? In how many instances has this disagreement been submitted, as required by the law, to the administrator of OFPP for final determination?

On September 7, 1979, the Office of Federal Procurement Policy (OFPP) in conjunction with the SBA issued OFPP Policy Letter 79-3 addressed to the Heads of Executive Departments and Establishments. This directive implemented section 15 (g) as amended and required agencies to submit goals to SBA by the end of the first quarter of FY 1980. On September 28, 1979, OFPP and SBA jointly convened a meeting of all Directors of Small and Disadvantaged Business Utilization. Discussion of the requirements of OFPP Policy Letter 79-3 was included during the course of the meeting. On October 29 the Administrator of SBA dispatched a letter to the Heads of Executive Departments and Agencies which reminded the agencies of the requirement to submit goals for FY 1980 to SBA by the end of the first quarter of the current fiscal year and additionally requested related historical achievement information as available from 1974 through 1978. It was recognized that in many cases FY 1979 procurement data was not yet available. On November 1, 1979, a letter to the Directors of Small and Disadvantaged Business Utilization enclosing a copy of the October 29, 1979, letter (referred to above) was sent by the SBA Associate Administrator for Procurement Assistance. On December 5 - 7, 1979, the second quarterly meeting of Directors was held together with a meeting of key procurement officials of Small and Disadvantaged Business Utilization. One of the agenda items was further discussion of and answers to questions on the submissions of goals for FY 1980 by the agencies to SBA. On December 11, 1979, a letter from the SBA Administrator to the Heads of Departments and Agencies, among other things, again reminded them of the goaling requirement. As of January 4, 1980, eleven agencies have submitted goals. We are following up with the other agencies and Departments concerning their failure to submit goals in accordance with the established procedure. Nineteen agencies have submitted procurement historical achievement data for prior years. SBA is in the process of analyzing the goals submitted and will reply to the agencies as to agreement or need for further negotiation or clarification. When agreement cannot be reached in a reasonable time, the dispute will be forwarded to OFPP for final determination. At this time no disputes have been referred to OFPP.
