AUTHORITY OF COMMISSIONERS (a) General: The Commissioners shall serve as the trial judges of the Court to the extent of the authority therefor prescribed by statute and these rules. As such they shall have the power to do and perform any acts which may be necessary or proper under the Court's orders of reference and these rules for the efficient performance of their duties and the regulation of proceedings before them. In the event that a question of authority arises in proceedings before a Commissioner which is not covered by a rule or the order of reference, the Commissioner shall exercise his discretion thereon, subject to review by the Court on application by the dissatisfied party. Any misconduct by attorneys, witnesses, parties, or other persons at any proceeding before a Commissioner may be reported by him to the Court for such disciplinary action, including contempt proceedings, as the Court may deem proper under the circumstances. (b) Responsibility: In all cases referred to him the Commissioner shall be responsible in the first instance: (1) for all orders requisite to the joinder of issue on the pleadings except orders that are dispositive of a case; (2) for disposition of procedural motions; (3) for the direction and conduct of pretrial proceedings (including calls, discovery, and depositions); (4) for trial of issues of fact; (5) for reporting findings of fact; and (6) if so directed by the Court, for the submission of recommendations for conclusions of law. (c) Reference of Cases: Unless otherwise ordered by the Court, every case shall be referred to a Commis |
