R. 366 IN THE HOUSE OF REPRESENTATIVES JANUARY 3, 1957 Mr. O'HARA of Minnesota introduced the following bill; which was referred to the Committee on Interstate and Foreign Commerce A BILL To amend the Federal Food, Drug, and Cosmetic Act for the protection of the public health, by prohibiting new food additives which have not been adequately pretested to establish their safe use under the conditions of their intended use. 1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That section 201 of the Federal Food, Drug, and Cosmetic 4 Act is amended by adding at the end thereof the following 5 new paragraphs (s), (t), and (u): 6 "(s) The term 'new food additive' means any substance 7 used or intended to be used for any purpose in the manufac8 ture, packing, processing, preparation, or other fabrication 9 of any food, or in the packaging, transporting, or holding of I 2 1 it, which (1) thus becomes or could reasonably be expected 2 to become a component of such food and (2) is not generally 3 recognized among experts qualified by scientific training and 4 experience to evaluate the safety of food, to be safe for use 5 under the conditions of such use or intended use. The term 6 does not include a pesticide chemical in or on a raw agricul 7 tural commodity; or, with respect to a particular food or 8 class of foods, any substance to the extent to which, its use 9 for general consumption in the United States in or on such 10 food or class of foods is authorized or approved by the Food 11 and Drug Administration or the Meat Inspection Branch of 12 the United States Department of Agriculture, or any sub13 stance to the extent to which its use in or on a food is ap14 proved by or under this Act. Each new food additive shall 15 be deemed a food, for the purposes of this Act. 16 "(t) The term 'safe for use' when used with reference 17 to a new food additive shall mean that it is reasonably 18 probable that such new food additive can be used under 19 the conditions of its intended use without rendering the 20 food in or on which it is used injurious to health. 21 "(u) The term 'conditions of its intended use' when 22 used with reference to a new food additive includes, but 23 shall not be limited to, specifications as to the particular 24 food or class of foods in or on which said additive is in25 tended to be used, the quantity intended to be used in or on |
