§ 60e-4. Same; additional increase in compensation. § 60e-4a. Same; additional increase in compensation. Except as provided in section 5547 of Title 5, each officer and employee of the Federal Government, and each officer and employee of the District of Columbia municipal government, whose rate of compensation is increased by sections 2, 3, 4, 5, or 6 of the Federal Employees Pay Act of 1946 shall receive additional compensation at the rate of $330 per annum: Provided, That any employee paid on an hourly or part-time basis shall receive additional compensation at the rate of 20 cents per hour. § 60e-5. Same; additional increase in compensation; limitation on aggregate amount of annual compensation.

(a) Each officer or employee in or under the legislative branch of the Government whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title shall be paid additional compensation at the rate of 5 per centum of the aggregate rate of his basic compensation and the rate of the additional compensation received by him under sections 60e-3 and 60e-4 of this title, and section 60e-4a of this title.

(b) The provisions of section 5547 of Title 5 shall not apply to officers and employees subject to the provisions of this section or to employees in the offices of Senators, but (except as provided in subsection (d)) no such officer or employee shall, by reason of any provision of such Acts or of this section be paid with respect to any pay period basic compensation, or basic compensation plus additional compensation, at a rate in excess of $10,846 per annum. § 60e-6. Same; additional increase in compensation; limitation on aggregate amount of annual compensation.

(a) Each officer and employee in or under the legislative branch of the Government whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title shall be paid additional compensation at the rate of 10 per centum of the aggregate rate of his basic compensation and the rate of the additional compensation received by him under said sections, section 60e-4a of this title, and section 60e-5 of this title, except that (1) no such officer or employee shall be paid additional compensation at a rate less than $300 per annum or in excess of $800 per annum, and (2) employees paid on an hourly or part-time basis shall be paid additional compensation at the rate of 20 cents per hour.

(b) The provisions of section 60e-4 of this title and section 5547 of Title 5 shall not apply to officers or employees subject to the provisions of subsection (a) of this section or to employees in the offices

of Senators, but no such officer or employee, or any other officer or employee of the Senate or House of Representatives, shall be paid with respect to any pay period basic compensation or basic compensation plus additional compensation at a rate in excess of the highest per annum rate of compensation paid under authority of chapter 51 and subchapter III of chapter 53 of Title 5, unless expressly authorized by law.

(c) The provisions of subsection (a) of this section, and the provisions of law referred to in such subsection, shall not apply to employees whose compensation is paid from the appropriation contained in the paragraph designated "Folding documents" under the heading "Contingent expenses of the Senate" in the Legislative Branch Appropriation Act. § 60e-7. Same; additional increase in compensation.

(a) Each officer and employee in or under the legislative branch of the Government whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title shall be paid additional compensation at the rate of 7.5 per centum of the aggregate rate of his rate of basic compensation and the rate of the additional compensation received by him under said sections, section 60e-4a of this title, section 60e-5 of this title, the Act of October 24, 1951 (Public Law 201, Eighty-second Congress), and any other provision of law.

(b) (1) The provisions of subsection (a) of this section shall not apply to employees whose compensation is paid from the appropriation contained in the paragraph designated "Folding documents" under the heading "CONTINGENT EXPENSES OF THE SENATE" in the Legislative Appropriation Act, 1955, or in any subsequent appropriation act, but the limitations contained in such paragraph are increased by 7.5 per centum.

(2) Repealed. June 27, 1956, ch. 453, § 101, 70 Stat. 363.

(c) The official reporters of proceedings and debates of the Senate and their employees shall be considered to be officers or employees in or under the legislative branch of the Government within the meaning of subsection (a) of this section and the provisions of law referred to in such subsection. EFFECTIVE DATE OF 1956 AMENDMENT

Section 101 of act June 27, 1956 provided in part that the amendment of this section by such act shall be effective July 1, 1956.

COMPENSATION PRIOR TO JULY 1, 1955 Section 4(1) of act June 28, 1955, provided that: "Except as provided in subsection (d) (3) (C) of this section [set out as a note under section 60f of this title], no officer or employee shall be paid increased or additional compensation under this section for any period prior to July 1, 1955, at a rate in excess of 7.5 per centum of the aggregate rate of his basic compensation and additional compensation under the Acts referred to in subsection (a) [subsec. (a) of this section], computed without regard to the amendment made by subsection (b) [amending subsec. (b) of section 60e-6 of this title]."

§ 60e-8. Same; additional increase in compensation.

(a) Each officer and employee in or under the legislative branch of the Government whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title shall be paid additional compensation at the rate of 10 per centum of his gross rate of compensation (basic compensation plus additional compensation authorized by law).

(b) The provisions of subsection (a) of this section shall not apply to employees whose compensation is paid from the appropriation contained in the paragraph designated "Folding documents" under the heading "CONTINGENT EXPENSES OF THE SENATE" in the Legislative Branch Appropriation Act, 1958, or in any subsequent appropriation Act, but the limitation contained in such paragraph is increased by the amount necessary to provide increases corresponding to those provided by subsection (a) of this section.

(c) The official reporters of proceedings and debates of the Senate and their employees shall be considered to be officers or employees in or under the legislative branch of the Government within the meaning of subsection (a) of this section.

(d) Each employee in the legislative branch of the Government whose compensation

(1) is disbursed by the Clerk of the House of Representatives,

(2) is not increased by any other provision of this Act, and

(3) is fixed at a gross aggregate rate per annum, shall receive additional compensation at the rate of 10 per centum of the rate of his existing gross annual compensation.

(e) The limitations on gross rate per thousand and gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the House of Representatives are increased by 7.5 per centum. (d) The limitations on gross rate per thousand and gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the House of Representatives are increased by 7 per centum. The amount of each such increase shall be computed to the nearest cent, counting one-half cent and over as a whole cent.

(e) Notwithstanding any other provision of this section, no rate of compensation which exceeds $21,500 shall be increased by this section, and no increase provided by this section shall cause the gross rate of compensation (basic plus additional compensation authorized by law) or the total annual compensation of any officer or employee to exceed $21,500. § 60e-11. Same; additional increase in compensation. (a) Each officer or employee in or under the legislative branch of the Government whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title shall be paid additional compensation in an amount equal to the greater of the following amounts, as applicable:

(1) an amount equal to 32 per centum of his gross rate of compensation (basic compensation plus additional compensation authorized by law) in effect immediately prior to the effective date of this section plus 1 per centum of such gross rate for each whole multiple, or part of a multiple, of $500 basic compensation; or

(2) an amount equal to 5 per centum of such gross rate.

(b) The total annual compensation in effect immediately prior to the effective date of this section of each officer or employee of the House of Representatives, whose compensation is disbursed by the Clerk of the House of Representatives and is not increased by reason of any other provision of this title, shall be increased by an amount which is equal to the amount of the increase provided by subsection (a) of this section in that gross rate which is nearest in amount to the total annual compensation of such officer or employee.

(c) Each of the limitations on gross rate per thousand and gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the House of Representatives shall be increased by 7 per centum. The amount of each increase under this subsection shall be computed to the nearest cent, counting one-half cent and over as a whole cent.

(d) The limitation on gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the Senate is hereby increased by 7 per centum. The amount of such increase shall be computed to the nearest cent, counting one-half cent and over as a whole cent. The provisions of subsection (a) of this section shall not apply to employees whose compensation is subject to such limitation. (Pub. EFFECTIVE DATE

Effective date of this section, referred to in subsecs. (a) (1), (b)-(d), was the effective date of Pub.L. 88-426, which, under section 501 thereof except to the extent provided in 501(c) was the first day of the first pay period which began on or after July 1, 1964, see section 501 of Pub.L. 88-426.

SHORT TITLE

Section 201 of Pub.L. 88-426 provided that: "This title [enacting this section, sections 61a, 61a-2, 61d, 61e, 84-2, 136a, 136b and 273 of this title, sections 42a and 51a of Title 31, sections 162a, 166b, and 166b-1 of Title 40, and banner section 39a [now covered by section 303] of Title 44, amending sections 31 and 72a of this title and enacting provisions set out as notes under this section and sections 60a and 60f of this title] may be cited as the 'Federal Legislative Salary Act of 1964.'"

LIMITATION ON 1964 INCREASES

Section 205 of Pub. L. 88-426 provided that: "No officer or employee subject to section 202 (a) or 202(b) of this title [subsec. (a) or (b) of this section] shall receive, by reason of any provision of this title, an increase in gross rate of compensation (basic compensation plus additional compensation authorized by law), or in total annual compensation, which is in excess of the amount of the increase in basic compensation provided by the amendment made by section 102(a) of Title I of this Act [to section 5332(a) of Title 5, Government Organization and Employees] for positions in grade 18 of the General Schedule of the Classification Act of 1949, as amended [now covered by section 5101 et seq. and 5331 of Title 5]."

1968 AND 1969 INCREASES IN COMPENSATION Increases in compensation effective July 1, 1968, and July 1, 1969, for officers and employees of the Senate and the House of Representatives, see Salary Directives of the President pro tempore of the Senate and of the Speaker of the House of Representatives, set out as notes under section 60a of this title.

§ 60e-12. Same; additional increase in compensation. (a) Except as otherwise provided in this section, each officer or employee in or under the Legislative branch of the Government, whose rate of compensation is increased by sections 60e-3 and 60e-4 of this title, shall be paid additional compensation at the rate of 3.6 per centum of his gross rate of compensation (basic compensation plus additional compensation authorized by law).

(b) The total annual compensation in effect immediately prior to the effective date of this section of each officer or employee of the House of Representatives, whose compensation is disbursed by the Clerk of the House and is not increased by reason of any other provision of this section, shall be increased by an amount which is equal to the amount of the increase provided by subsection (a) of this section; except that this section shall not apply to the compensation of student congressional interns authorized by H. Res. 416 of the Eighty-ninth Congress.

(c) The limitation on gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the Senate is hereby increased by 3.6 per centum. The amount of such increase shall be computed to the nearest cent, counting one-half cent and over as a whole cent. The provisions of subsection (a) of this section shall not apply to employees whose compensation is subJect to such limitation. (Pub. (b) The total annual compensation in effect immediately prior to the effective date of this section of each officer or employee of the House of Representatives, whose compensation is disbursed by the Clerk of the House of Representatives and is not increased by reason of any other provision of this section, shall be increased by 2.9 per centum. Notwithstanding section 303 of this title or any other provision of this section, the total annual compensation of the Clerk of the House of Representatives and the Sergeant at Arms of the House of Representatives, respectively, shall be an amount which is equal to the total annual compensation of the Secretary of the Senate and the Sergeant at Arms of the Senate, respectively.

(c) This section shall not apply with respect to the compensation of student congressional interns authorized by House Resolution 416, Eighty-ninth Congress, and the compensation of employees whose compensation is fixed by the House Wage Schedule under the House Employees Position Classification Act.

(d) The limitation on gross rate per hour per person provided by applicable law on the effective date of this section with respect to the folding of speeches and pamphlets for the Senate is hereby increased by 2.9 per centum. The amount of such increase shall be computed to the nearest cent, counting one-half cent and over as a whole cent.
