A BILL

To amend title 38 of the United States Code to provide for cost-of-living adjustments to disability compensation rates payable to veterans residing outside the contiguous United States.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) chapter 11 of title 38, United States Code, is 4 amended by adding at the end thereof the following new 5 section:

1 "§ 362. Cost-of-living adjustments in disability compensa

3 "(a) The Administrator shall adjust from time to time 4 the respective rates of disability compensation payable under 5 subchapters II and IV of this chapter to veterans who reside 6 in any area outside the contiguous United States in order to 7 offset the difference between the cost of living in any such area and the cost of living in the District of Columbia, if 9 such cost in the outside area is substantially higher. tory rate payable under either of such subchapters may be

increased to an amount in excess of 125 per centum of such

rate by reason of adjustments made under this section.

"(b) The Administrator shall by regulation prescribe 14 the amounts of the adjustments made under subsection (a) 15 and define the areas in which, and the conditions under 16 which, such amounts will be paid."

17 (b) The analysis of such chapter 11 is amended by add18 ing at the end thereof the following:

"362. Cost-of-living adjustments in disability compensation rates."

SEC. 2. This Act shall take effect on the first day of 20 the second calendar month which begins after the date of its 21 enactment.

A BILL

To amend title 38 of the United States Code to provide for costof-living increases in compensation, dependency, and indemnity compensation, and pension payments.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) chapter 1 of title 38, United States Code, is 4 amended by adding at the end thereof the following new 5 section:

6 "§ 113. Cost-of-living increases in benefits

"(a) As soon as possible after the beginning of each 8 calendar quarter, the Administrator shall determine the 9 extent by which the price index in the preceding calendar quarter was higher than the price index in the applicable

14 base period (as those terms are defined in subsection (e)). 15 If he determines that the price index had risen by a per16 centage (of its level in the base period) equal to 3 per 17 centum or more, the amount of each benefit otherwise pay18 able under this title or the first sentence of section 9 (b) of 19 the Veterans' Pension Act of 1959 shall be increased by the same percentage (adjusted to the nearest one-tenth of 1 per 21 centum), effective with respect to benefits for months after 22 the quarter in which the determination is made.

"(b) In the case of any individual who first becomes 24 entitled to a benefit in or after the month in which an in25 crease becomes effective under subsection (a), the amount of 14 the benefit payable to or with respect to him on the basis 15 of such entitlement shall be determined by applying such 16 increase (or, if more than one increase has become effective 17 under subsection (a), by applying all such increases succes18 sively) to the amount of the benefit which would be payable 19 under the provisions of this title or the first sentence of 20 section 9 (b) of the Veterans' Pension Act of 1959 without 21 regard to this section.

"(c) Any increase under subsection (a) shall apply 23 with respect to all benefits payable under this title or the 24 first sentence of section 9 (b) of the Veterans' Pension Act 25 of 1959 during the period in which such increase is effective
