TO AUTHORIZE AN EXCHANGE OF LAND BETWEEN THE WAIANAE CO., AND THE NAVY DEPARTMENT (H. R. 9999). MR. KING

MY DEAR MR. SPEAKER: There is transmitted herewith a draft of a proposed bill to authorize an exchange of land between the Waianae Co. and the Navy Department.

The purpose of the proposed legislation is to authorize the Secretary of the Navy to exchange certain land now a part of the naval radio station site, Lualualei, Oahu, Territory of Hawaii, for a tract of land belonging to the Waianae Co. and adjoining the radio station on the south and a surrender of the rights-of-way across the radio station now held by the Waianae Co.

This exchange would transfer approximately 665 acres from the northern end of the radio station site to the Waianae Co. and would add approximately 800 acres to the southern end of the radio station site by transfer from the Waianae Co. The Waianae Co. would then have no further need to use its railroad, flumes, and roads across the radio station in order to work its land and will, as part of the exchange, surrender its rights-of-way across the radio station. The Navy Department considers it highly desirable that these rights-of-way across the radio station should be extinguished.

The enactment of the proposed legislation will not involve any cost to the Government.

This proposed legislation is in accord with the financial program of the President.

The Navy Department recommends that the proposed legislation be enacted.

FOR THE RELIEF OF MRS. OLLIE MYERS (H. R. 8884). MR. MARTIN OF COLORADO

The CHAIRMAN COMMITTEE ON NAVAL AFFAIRS,

House of Representatives, Washington, D. C. MY DEAR MR. CHAIRMAN: The bill (H. R. 8884) for the relief of Mrs. Ollie Myers was referred to the Navy Department by your committee for comment and recommendation.

The purpose of this bill is to authorize and direct the Secretary of the Navy to pay, out of the appropriation "Pay of the Navy, 1935," to Mrs. Ollie Myers, dependent mother of Earl E. Myers, late private in the United States Marine Corps, an amount equal to 6 months' pay at the rate he was receiving at the time of his death.

The records of the Navy Department show that Pvt. Earl E. Myers died at Yali, Nicaragua, February 9, 1928, as the result of a pistol-shot wound received in line of duty. He did not designate any dependent relative as his beneficiary to receive 6 months' pay in the event of his death.

As the dependency clause is usually placed in private gratuity acts by the Congress in order to observe the intent of the 6 months' death gratuity laws, the Navy Department suggests that the following form be substituted for the bill (H. R. 8884) as introduced:

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Secretary of the Navy be, and he is tereby, authorized and directed to pay, out of the current appropriation, "Pay the Marine Corps", to Mrs. Ollie Myers, mother of Earl Eugene Myers, late ivate, United States Marine Corps, an amount equal to six months' pay at the rate of said Earl Eugene Myers was receiving at the date of his death: Proed. That the said Mrs. Ollie Myers establish to the satisfaction of the Secretary of the Navy that she was actually dependent upon her son, Earl Eugene Myers, at the time of the latter's death, and the determination of such fact by the Secretary of the Navy shall be final and conclusive upon the accounting officers of the Government.

If Mrs. Myers should establish her dependency and the bill be amended as indicated and enacted, an expenditure of $144 would be required, based on the rate of pay of $24 a month Myers was receiving on the date of his death.

The Navy Department would interpose no objection to the enactment of the bill (H. R. 8884) if amended as above suggested.
